81. There and Back Again: On the Diffusion of Immigration Detention

Abstract:
From Mexico to the Bahamas, Mauritania to Lebanon, Turkey to Saudi Arabia, South Africa to Indonesia, Malaysia to Thailand, immigration-related detention has become an established policy apparatus that counts on dedicated facilities and burgeoning institutional bureaucracies. Until relatively recently, however, detention appears to have been largely an ad hoc tool, employed mainly by wealthy states in exigent circumstances. This paper uses concepts from diffusion theory to detail the history of key policy events in several important immigration destination countries that led to the spreading of detention practices during the last 30 years and assesses some of the motives that appear to have encouraged this phenomenon. The paper also endeavors to place the United States at the center of this story because its policy decisions appear to have played an important role in encouraging the process of policy innovation, imitation, and imposition that has helped give rise to today's global immigration detention phenomenon. Nevertheless, many US offshore practices have not received nearly the same attention as those of other important destination countries. More broadly, in telling this story, this paper seeks to flesh out some of the larger policy implications of the externalization of immigration control regimes. Just as offshore interdiction and detention schemes raise important questions about custody, accountability, and sovereignty, they should also spur questions over where responsibility for the wellbeing of migrants begins and ends.

Abstract:
Apartheid South Africa's nuclear related activities in Southern Africa have a long history. Apart from, inter alia, the development and existence of at least six nuclear devices (which was denied for decades), South Africa operated a nuclear test site in the Kalahari Desert on the border of Botswana, utilised uranium from Southwest Africa (now independent Namibia), and employed a nuclear deterrent strategy in response to Soviet support for Angola and liberation movements in the region. This elicited responses from the so - called Frontline States (FLS) as well as the members of the Southern African Development Community (SADCC). Therefore, the purpose of this contribution is to determine the extent of South Africa's nuclear activities as well as its impact on the region from the mid - 1970s until 1991. This period covers the period since the Portuguese regime's collapse in 1974 and its domino effect in Southern Africa, the disintegration of the Soviet Union and the termination of the Cold War.

84. The Cost and Cost-Effectiveness of Alternative Strategies to Expand Treatment to HIV-Positive South Africans: Scale Economies and Outreach Costs

Abstract:
The South African government is currently discussing various alternative approaches to the further expansion of antiretroviral treatment (ART) in public-sector facilities. Alternatives under consideration include the criteria under which a patient would be eligible for free care, the level of coverage with testing and care, how much of the care will be delivered in small facilities located closer to the patients, and how to assure linkage to care and subsequent adherence by ART patients. We used the EMOD-HIV model to generate 12 epidemiological scenarios. The EMOD-HIV model is a model of HIV transmission which projects South African HIV incidence and prevalence and ARV treatment by age group for alternative combinations of treatment eligibility criteria and testing. We treat as sunk costs the projected future cost of one of these 12 scenarios, the baseline scenario characterizing South Africa's 2013 policy to treat people with CD4 counts less than 350. We compute the cost and benefits of the other 11 scenarios relative to this baseline. Starting with our own bottom-up cost analyses in South Africa, we separate outpatient cost into non-scale-dependent costs (drugs and laboratory tests) and scale-dependent cost (staff, space, equipment and overheads) and model the cost of production according to the expected future number and size of clinics. On the demand side, we include the cost of creating and sustaining the projected incremental demand for testing and treatment. Previous research with EMOD-HIV has shown that more vigorous recruitment of patients with CD4 counts less than 350 appears to be an advantageous policy over a five-year horizon. Over 20 years, however, the model assumption that a person on treatment is 92 percent less infectious improves the cost-effectiveness of higher eligibility thresholds over more vigorous recruitment at the lower threshold of 350, averting HIV infections for between $1,700 and $2,800 (under our central assumptions), while more vigorous expansion under the current guidelines would cost more than $7,500 per incremental HIV infection averted. Granular spatial models of demand and cost facilitate the optimal targeting of new facility construction and outreach services. Based on analysis of the sensitivity of the results to 1,728 alternative parameter combinations at each of four discount rates, we conclude that better knowledge of the behavioral elasticities would be valuable, reducing the uncertainty of cost estimates by a factor of 4 to 10

Abstract:
The volume under review publishes the proceedings of a colloquium held at the University of Paris in July 2010. The aim of this colloquium was to fill a lacuna that characterizes the contemporary francophone international legal scholarship. Indeed, as noted by the editors in their foreword to the book, after a prolific period during the 1970s and 1980s, French and francophone scholars have gradually lost interest in Third World-related issues and ignored this topic in their research and teachings. This trend is regrettable and unfortunate because despite some progress and improvements, international relations are still marked by significant inequalities and disparities between rich and poor countries, while several regions of the world remain in a situation of extreme poverty. Therefore, there is an urgent need to renew and revive the reflection of French-speaking international lawyers on their discipline by inciting them to critically question the present existence and effects of the rules of international law relating to the Third World in the current globalized context. To achieve this goal, Mark Toufayan, Emmanuelle TourmeJouannet and Hélène Ruiz Fabri had the idea of bringing together, in Paris, francophone and anglophone scholars and prominent representatives of the critical Third World Approaches to International Law (TWAIL). TWAIL scholars were invited to expose their ideas and thoughts, and their French-speaking counterparts were asked to react and comment on these thoughts.

Abstract:
The increasing feminization of Zimbabwean migration is part of an overall increase in migration from Zimbabwe since 1990 – primarily to destinations in South Africa and the UK, though Zimbabweans now live in countries throughout the world. There are currently three to four million Zimbabwean cross-border migrants, or about 25 percent of Zimbabwe’s total population of twelve million. Most Zimbabweans leaving the country in the last two decades have been forced to do so because of economic and political instability, and it is women who have experienced the most dramatic changes in patterns of migration. Based on interviews with twenty-three Zimbabwean women migrants, this study seeks to explain the dramatic increase in the number of women who have migrated to work outside of Zimbabwe, and the impact of women’s migration on family structures and gender roles.

In June 2003, Brazil's then-President Luiz Inácio Lula da Silva found himself on the sidelines of a G8 summit in France, along with his counterparts from India and South Africa. They had been invited to the summit as observers, but the invitation served mostly to underscore a common frustration. "What is the use of being invited for dessert at the banquet of the powerful?" as Lula later put it. "We do not want to participate only to eat the dessert; we want to eat the main course, dessert and then coffee."

Abstract:
For decades, lending to the poor meant microcredit, and energy related projects rarely fit into that model. The few attempts at intersecting energy and microfinance faltered for various reasons, ranging from the poor energy technologies available at the time to an aversion among microfinance institutions (MFIs) to move to a broader energy-lending program. Even in cases where microcredit clients could use funds to buy clean energy technology, few did. Instead, many continued to use traditional, inefficient and often dangerous means- kerosene, candles, animal dung, or diesel-to light their homes and cook their food.

Abstract:
Much has been written about the role of the rising or emerging powers and their accelerating economic engagement in Africa. Much less is known about how they contribute to or impact on the African peace and security agenda. This report takes a comparative look at the roles of China, India, Brazil and South African in relation to the African Union and its African Peace and Security Architecture. Each of these four countries has a distinct commercial and corporate approach to Africa, despite a shared political commitment to South-South cooperation. However, as they extend their economic engagement they are becoming more sensitive to insecurity and volatility. The Asian and Latin American countries, which traditionally have strongly emphasised non-intervention, are gradually becoming more involved in the African security agenda. They are increasingly concerned about their image and reputation and the security of their citizens and business interests, and are becoming more prepared to act multilaterally and to work with others in facilitating security and stability. As an African power, South Africa plays a more direct role and has emerged as a major architect of the continent's evolving peace and security architecture. This report summarises elements from a broader research project on rising powers and the African peace and security agenda undertaken by CMI in cooperation with NOREF.

90. New Technologies for Constitution Making

Abstract:
Public participation has become an integral part of constitution making, particularly since the end of the Cold War. It has strengthened national unity, built trust between governments and citizens, promoted reconciliation, and helped produce national con sensus. Constitution drafters in the past were mostly limited to using official statements and press releases, workshops, meetings, radio and television programs, and printed materials to engage with citizens. These methods were often costly and time-consuming, and failed to reach significant segments of the public. New technologies can increase participation in and the perceived legitimacy of constitutional processes. Constitution drafters have recently begun using the web and mobile phones to educate citizens on the constitution-writing process and engage them on issues of concern. Increasingly constitution writers are also using the web to consult international experts on specific technical issues. Given the rapid growth of the Internet and mobile phone penetration in the developing world, the increased use of new technologies in constitution writing is nearly inevitable. People and organizations considering using these tools should bear four things in mind. New technologies will affect different groups differently. The people who use these tools should respect social and cultural norms. They should keep control of the process in the hands of national actors. Last, they should fit their work within the larger context of the conflict or postconflict environment in which they work. Constitution making is a difficult field, however, and new technologies are tools, not panaceas.
