Abstract:
Judge Goldstone, who led the UN - commissioned investigation into allegations of war crimes committed during Israel's winter 2008–9 operation in Gaza (see Special Doc. File in JPS 154) and later, in a much-publicized move, repudiated one of the commission's major findings (see Doc. A1 in JPS 160), elicited further controversy with his op-ed in the New York Times defending Israel against accusations of apartheid. The op-ed was occasioned by the third session of the Russell Tribunal on Pales- tine (an “international people's tribunal” created by activists to promote peace and justice in the Middle East and funded by the Bertrand Russell Peace Foundation), scheduled to begin on 4 November in Cape Town, South Africa, which was to focus on the question of whether Israel's practices with regard to the Palestinians constitute apartheid differences (see un- der “Other” in this issue's Quarterly Up- date). The current political pre-eminence of the African National Congress in South Africa was not inevitable. The ANC was often overshadowed by other organizations and there were moments in its history when it nearly collapsed. Sometimes it was 'more of an onlooker than an active participant in events'. It came into being, as the South African Native National Congress (SANNC), in 1912, at a time of realignment within both the white and the conquered black communities. In the aftermath of their victory over the Boers in the South African War (1899-1902), the British were anxious to set about reconciling their former enemies to British rule. This included allowing former Boer territories to continue denying franchise and other rights to Africans, thus disappointing the hopes raised by British under - takings to the black population during the war years. For Africans, this 'betrayal' signified that extension of the Cape franchise, which at that time did not discriminate on racial grounds, to the rest of South Africa was unlikely. Indeed, when the Act of Union of 1910 transferred sovereignty to the white population even the Cape franchise was open to elimination through constitutional change—and in course of time it was indeed abolished.

"We have just heard a brie!ng from Mr Fernandez-Taranco about the situation in Israel and the Occupied Palestinian territories. One of the themes that emerged was the severely damaging effect that increased settlement construction and settler violence is having on the ground and on the prospects of a return to negotiations. The UK, France, Germany, and Portugal are dismayed by these wholly negative developments.

Abstract:
When the Group of Eight (G-8) industrialized countries decided at their 2001 meeting in Genoa to establish the Global Fund to Fight AIDS, Tuberculosis, and Malaria to increase international funding for interventions against the three diseases, the United States was a leading supporter. The fund was a public-private partnership set up in 2002 with formal status as a foundation under Swiss law. In the fund's first two years, the United States accounted for nearly half the total amount pledged and challenged other donors to increase their contributions. By 2008 the Global Fund had committed $15.6 billion to AIDS activities in 140 country.

146. SACU Revenue Sharing Formula: Towards a Development Agreement

Abstract:
The South African Customs Union (SACU) Revenue Sharing Formula (RSF) has been revised substantively twice; once in 1969 and in 1994-2002 since the creation of the customs union in 1910 and each time the changes in the treaty were a reflection of the historic changes occurring in Southern Africa. The apartheid regime created a RSF that served to increase the share of revenue of Botswana, Lesotho and Swaziland (BLS), leaving the South African share as a residual of revenues. As this made South Africa a residual claimant it was unsustainable and required reform in the post-apartheid era. The 2002 formula increased the share to the Botswana, Lesotho, Namibia and Swaziland (BNLS) and removed South Africa as a residual claimant but did not change the fundamental economic relationship between members. While the International Monetary Fund (IMF) supports orthodox fiscal adjustment imbalances this paper argues that the order of magnitude makes those adjustment implausible and a new political arrangement is needed between South Africa and Lesotho and Swaziland to create a viable way forward for Southern African Development Community (SADC). It is argued that even in the case of Botswana and Namibia a new developmental formula, based on investing SACU revenues for regional and national development projects is needed to relieve those countries that have suffered the effects of polarization.

Abstract:
The climate change negotiations in Cancun saved the multilateral negotiation process under the UNFCCC, but what were the African political dynamics at the negotiations? In this Africa policy brief the international climate change negotiations are analysed as a “political marketplace” where international, regional and national agendas meet and have an impact that goes far beyond the theme of the negotiations. It addresses three questions to understand the African political processes at the climate negotiations. First, why did the African Union endorse the Copenhagen Accord after COP 15? Second, why was Kenya so active in the high-level segment of the negotiations in Cancun? Third, what could South Africa do to bring the negotiations forward in Durban?

Abstract:
Europe has been the privileged economic and political partner of Africa, but more recently China has increased its foothold in Africa through important financial investments and trade agreements. Against this backdrop, the empirical research conducted in 2007-08 in Kenya and South Africa as part of a pioneering international project investigates the perceptions of public opinion, political leaders, civil society activists and media operators. While confirming their continent's traditional proximity to Europe, African citizens are increasingly interested in China and its impact on Africa's development. Europe is criticised for not having been able to dismiss the traditionally 'patronising' attitude towards Africa. While African civil society leaders and media operators describe China as an opportunity for Africa to break free of its historical dependence on European markets, other opinion leaders warn against too much enthusiasm for the Asian giant. There is a suspicion that the Chinese strategy might, in the long run, turn into a new form of economic patronage.

Abstract:
Under colonialism and apartheid, the ruling white minority stole vast amounts of land from black Africans in Zimbabwe and South Africa. Reclaiming this land became an important rallying cry for liberation movements in both countries; but in the years after white minority rule ended, it was extremely difficult for the new regimes to redistribute the land fairly and efficiently. In recent years, as the unaddressed land inequality in Zimbabwe became a pretext for President Robert Mugabe's demagoguery and led to Zimbabwe's demise, many observers have asked: Could South Africa be next? When Nelson Mandela took power in South Africa in 1994, 87 percent of the country's land was owned by whites, even though they represented less than ten percent of the population. Advised by the World Bank, the ruling African National Congress (ANC) aimed to redistribute 30 percent of the land from whites to blacks in the first five years of the new democracy. By 2010 -- 16 years later -- only eight percent had been reallocated. In failing to redistribute this land, the ANC has undermined a crucial aspect of the negotiated settlement to end apartheid, otherwise known as the liberation bargain. According to Section 25 of the new South African constitution, promulgated in 1994, existing property owners (who were primarily white) would receive valid legal title to property acquired under prior regimes, despite the potentially dubious circumstances of its acquisition. In exchange, blacks (in South Africa, considered to include people of mixed racial descent and Indians) were promised land reform. But the new government upheld only one side of the liberation bargain: South African whites kept their property, but blacks still have not received theirs. Political apartheid may have ended, but economic apartheid lives on.
