11. Civilian Drones: Privacy Challenges and Potential Resolution

Abstract:
This paper, authored as part of the New America US-India Public Interest Technologies Fellowship 2019, examines the privacy implications of drones in civilian airspaces. Though a technology with significant benefits, drones can also carry out extensive snooping and surveillance. As India transitions to a regulatory ecosystem supportive of drone technology, it is imperative that the attention of policy makers be directed to the various privacy harms that lie in store. Here, the different kinds of harms are mapped into two: traditional privacy challenges arising from a spatial invasion by drones into private spaces, and big data risks on account of the business models that the drone industry has paved the path for. Dealing with the first category of risks, the paper argues that serious criminal enforcement, along the lines of what some States in the United States have pursued, is imperative to safeguard the private domain from the prying eyes of third parties. It also points out serious gaps in Indian constitutional jurisprudence when it comes to structural interventions like drone surveillance, and recommends an overall assessment of the impact on privacy baseline from such technologies when the judiciary evaluates their legality against the touchstone of the fundamental right to privacy. On the second kind of risk, the paper argues for privacy dashboards that help citizens evaluate the purpose of drone operations and assess whether equipments retrofitted alongside the drone are truly required to fulfil these purposes or merely meant to gather unrestricted amount of personal and community data.

Abstract:
The United States has been using Remotely Piloted Aircraft (RPA) to assassinate terrorist targets since its first RPA strike on November 3, 2002, when a U.S. Predator fired a hellfire missile at a car traveling through the Mar’ib province of Yemen. The intelligence cycle of this targeted killing process is murky at best, and the policy has changed throughout the successive administrations of U.S. presidents. Details exist but there is no defined tangible chain of analysis concerning the selection of the target, the monitoring of the target, and finally, the assassination of the target. This paper attempts to elucidate the intelligence chain of analysis concerning American targeted killing and examine how the intelligence cycle of targeted killing varies through successive presidential administrations. ​ This paper will begin with a short analysis of relevant literature, although sources concerning this topic are scarce. The occurrence of targeted killings of U.S. citizens will also be explained in the literature section. The paper will continue with an elaboration of a generic intelligence cycle model, which will be used to illustrate the intelligence cycle of U.S. targeted killings using both the Reaper and the Predator RPA.[1] The paper will then address differences in the intelligence cycles and processes that have occurred between successive presidents since targeted killing first began in 2002 with President George W. There has been much controversy and criticism about drone strikes conducted by the United States, especially those that have targeted Al Qaeda operatives outside Afghanistan in Yemen, Somalia, and the border regions of Pakistan. Many questions have surfaced about the effectiveness of using drone strikes. There is also a widespread perception that strikes have killed many civilians and that they are illegal. The Obama administration recently promised to release information about the number of civilians killed, as well as its policy guidance governing drone strikes outside Afghanistan. However, this new information is unlikely to directly address the question of what legal framework governs such drone strikes. In fact, the Obama administration has never been completely clear about its views on the legal basis for the drone program. But an understanding of the legal framework is necessary to evaluate the new information and the legality of the drone program.

A concoction between the technology, entertainment and military has resulted in a ‘new’ kind of warfare, which has started to determine the American counterterrorism strategy, the dronified warfare. The U.S. for a long time now has been the leader in the production and usage of armed drones and has attracted a lot of criticism regarding the way how it conducts the drone strikes, which in many cases has resulted in civilians killed. The U.S. dronified warfare has become the main determinant when discussing the legality, morality and effectiveness of the drone as the weapon, as many critics fail in distinguishing drone as a weapon and dronified warfare as a process. This paper argues that if analyzed separately from the U.S. example, drone is a legal and moral weapon. Nevertheless, the paper emphasizes the fact that the U.S. must change its current way of conducting the strikes by being aware of the fact that the irresponsible way it is acting in the Middle East and regions around, sooner or later will backfire

Abstract:
What are the prospects for implementation of Unmanned Aerial Vehicles (UAVs) in the Canadian military? Holman explores many aspects of how UAVs operate, their strengths and shortcomings. Examining them in the context of the overall systems that enable their capabilities, he looks at communications vulnerabilities, degrees of automation and autonomy, categories of UAV, rotary versus fixed wing applications, legal and airspace management constraints, and the potential roles in which UAVs might offer an immediate advantage. He concludes that surveillance is a very likely application, particularly in Canada’s far north. He is less sanguine about armed UAV roles, particularly when it comes to air combat. Improved reliability, a matured regulatory framework, and a more stable customer base are the critical elements for future system development.

Drone strikes on militants capture the negative headlines, but increasingly UAVs are winning fans amongst war fighters and civilians by other means. From providing eyes in the sky to taking on high-risk life support missions, the use of unmanned platforms is growing with no slowdown in sight. There are five fronts where UAVs are supporting the troops in ways that exploit their capabilities beyond offensive missions: surveillance/reconnaissance, intelligence, logistics, chronological reach back, and perhaps most surprisingly, community engagement. While context specific intelligence analysis is inseparable from its acquisition via surveillance and reconnaissance missions, it is separable for the purpose of this discussion about UAVs and how they are challenging traditional practices. UAVs can be both tactical and strategic assets – they are not only informing today’s missions, and they do not solely provide data that informs theater level decision making. These systems are achieving both tactical and strategic objectives, and they are sometimes doing so with the same machine in the same mission.
