Abstract:
Tunisians are waiting for a new constitution to cement a democratic order after decades of dictatorship. The constitution-making process has dominated politics since the January 2011 revolution; what can be expected when the constitution is complete? How will presidential and parliamentary elections proceed under this new constitution, expected early next year? Although the constitution will initiate a form of legal stability, party politics and new institutional arrangements could converge to complicate decision-making and obscure consensus.

302. Linking People, Crossing Borders: A Conversation with Mo Ibrahim

Born in northern Sudan at the end of World War II, educated in England with a Ph.D. in engineering and mobile communications, Mo Ibrahim returned to Africa in 1998, bringing cellular technology with him. At the time of his arrival, there were barely three million landline telephones on the entire continent—the bulk of them in North Africa and the nation of South Africa. Most of sub-Saharan Africa was all but inaccessible to terrestrial telephone lines. The Democratic Republic of Congo had only 3,000 phones to serve its population of about 55 million. Seeing demand for mobile phones and with little competition from landlines, Mo Ibrahim created Celtel, beginning in Kenya, branching quickly into Uganda and Tanzania. The company allowed millions of mobile subscribers to roam freely across borders, recharging with local cards as they went. Quickly, Celtel expanded across Gabon, the Democratic Republic of Congo, the Republic of Congo, Malawi, Zambia, and finally his native Sudan—a vast pan-African territory almost devoid of telecommunications boundaries. By the time he sold Celtel five years ago, he had linked 24 million people—a number that was growing exponentially.

Abstract:
In post-Qadhafi Libya, the authorities are in search of a new art of governing. Despite the legitimacy accorded them by elections, they remain very weak. Without any means of coercion, they are constantly obliged to negotiate for their survival, threatened by those who were not chosen by voters but who instead draw their legitimacy from their participation in the revolution – the militias. The challenge facing the Libyan authorities is not so much to combat these forces but to harness them. Libya has not undertaken a process of “de-Qadhafication.” But for the militias, in particular the Islamists, the presence of former officials and leaders in the state apparatus is intolerable. Thus, on May 5, 2013 they pressured the parliament into passing a law excluding from politics persons who occupied positions of responsibility under the old regime. If the revolutionary brigades continue to impose their will on the government, the fall of Qadhafi’s regime will have not brought about political change in Libya but rather the continuation of former political practices under a new guise.

Abstract:
This study examines the current state of private equity in North Africa, particularly in the countries of Morocco, Tunisia and Algeria. It has been developed from two perspectives: as a document research task and from the point of view of an operational fund manager in the region. The aim of the study is to share with the key stakeholders of this industry a few recommendations and challenges for private equity and to point out the great opportunities this industry can offer the region. Private equity is a key catalyst for growth in terms of job creation, increasing tax revenues, improving SME governance and many other very positive outcomes, all of which could create significant benefits for the region.

The democratic transitions in Egypt, Tunisia, and Libya will remain reversible unless and until their security agencies are reformed to carry out their functions without abusing citizen rights or interfering in politics. This is true of both internal security forces and armed forces; this report focuses on the latter. The future role of the armed forces is vital to the outcomes of the transitions and to the attainment of US political and strategic interests in the region.

Abstract:
Este artículo se centra en la consideración de dos factores a los que se enfrenta en campo magrebí en Marruecos, Argelia y Túnez y que son tanto el envejecimiento de su población rural como las deficiencias estructurales que inciden en el desinterés de la población más joven por permanecer en el medio rural. En primer lugar se revisan las tendencias actuales en lo que a envejecimiento se refiere, para así determinar que el envejecimiento del agro magrebí se debe principalmente al fenómeno de emigración hacia las ciudades. Seguidamente se explican las deficiencias estructurales existentes, centradas principalmente en el escaso apoyo institucional, la baja capacitación de los agricultores, las deficiencias en infraestructuras, sin olvidar claro está, las menciones al cambio climático y al proceso de desertización. De esta explicación se deduce que ambos factores se retroalimentan, siendo cada vez más difícil mejorar la situación a medida que se profundicen ambos fenómenos, pues las deficiencias estructurales privan de oportunidades a los jóvenes agricultores y dejan a una población envejecida menos capacitada para introducir mejoras en la agricultura. La víctima de este círculo vicioso será la productividad y la seguridad alimentaria.

307. How to Make Change in Egypt a Human Rights Success Story

Abstract:
The U.S. government has made a firm commitment to support peaceful democratic change in Egypt. The challenge now is how to fulfill that commitment while at the same time pursuing U.S. national security and economic objectives. In the long term these objectives are mutually consistent and re inforcing. But in the short term the challenge is to craft policies that lay the foundation for building strong democratic state institutions in Egypt and supporting those in civil society who are committed to working toward that objective, while at the same time dealing with the formidable economic challenges now facing Egypt as well as the local and regional security issues in which the government of Egypt has a key role to play. President Mohamed Morsi's November 23 decree and the various reactions to it, have underscored both the scope of these challenges and the critical need for the U.S. government to respond well.

For those concerned with the international community's Responsibility to Protect (R2P), the implementation of United Nations (UN) Security Council Resolution 1973, which authorized a military intervention in Libya, has caused much controversy and dissension. From the start of Muammar al-Qaddafi's violent crackdown against protesters in February 2011, R2P informed the Security Council's response. Adopted at the UN World Summit in 2005 and intended as an antidote to the inaction that had plagued the UN during the genocides in Cambodia, Rwanda and Srebrenica, R2P represents a solemn commitment by the international community to never again be passive spectators to genocide, war crimes, ethnic cleansing or crimes against humanity. While R2P played some role in preventing an escalation of deadly ethnic conflict in Kenya during 2007, it had never been utilized to mobilize the Security Council to take coercive action against a UN member state before.

Abstract:
Throughout their ten-month campaign to topple Colonel Qaddafi, Libya's opposition forces struggled to reconcile two competing streams. While fighters fired with revolutionary zeal rushed off to the front, politicians tried to establish a semblance of order in the territory that these fighters had won. Since the fall of Tripoli in August 2011 tensions have escalated into a power struggle between the thuwar, or militia forces, waving the banner of revolution, and the architects of would be reconstruction, seeking stability to give their designs foundation. As elections approach in mid- June 2012, this rivalry is coming to a head. Both sides view the ballot as the seminal event that could break the deadlock and signal the transfer of power from centrifugal revolutionary forces to a sober central authority.

310. Hamas's leadership struggle and the prospects for Palestinian reconciliation

When the West Bank and Gaza first split between two rival Palestinian governments in 2007, Western governments promised to turn the West Bank under President Mahmoud Abbas, their Fatah protégé, into a model state and reduce Gaza under its Islamist rulers, Hamas, to a pariah. Almost five years on, the tables have turned. While the West Bank slips into economic and political crisis, Gaza is fast reviving. Abbas finds himself bereft of a political horizon for achieving a two-state settlement and the state-building experiment of his prime minister, Salam Fayyad, has reached an impasse. Gaza's economy, by contrast, has grown strongly under Prime Minister Ismail Haniya, who is experiencing a wave of increasing popularity, as Hamas looks to tie the enclave ever more closely to the political economies of North Africa, where the Arab awakening is bringing affiliated Islamist movements to power. A recent agreement signed in the Qatari capital, Doha, between Abbas and Hamas's exiled leader, Khalid Meshal, is intended to heal the split between Palestine's two halves. Under the agreement, the separate governments governing Gaza and the West Bank would be replaced by a single technocratic government under Abbas, which is a radical about-turn on the part of the exiled Hamas leadership that Hamas politicians in Gaza find difficult to swallow. For its own reasons, Israel too rejects the agreement. With so many previous attempts at intra-Palestinian reconciliation ending in failure and so many obstacles dogging this latest round, the prospects for the Doha agreement remain bleak, but not beyond the realm of the possible.
