1. Disarmament and demobilisation in comparative perspective: patterns and policy recommendations

Abstract:
Disarmament and demobilisation (DD) programmes are vital components of strategic peacebuilding. DD provisions govern the collection and disposal of arms and ammunition, and oversee the discharge of active-duty combatants from the state's armed forces, rebel groups, or both. Using data from the Peace Accords Matrix database, this report compares the five most recent cases of DD implementation: Nepal (2006), Liberia (2003), Macedonia (2001), Indonesia-Aceh (2005) and South Sudan (2005). A comparative analysis reveals several common patterns in the kinds of provisional and operational choices associated with efficient DD implementation. Having a definite timeline and largely completing the process prior to the first elections creates an incentivised environment for a timely DD process while diminishing the risks of election-related violence. Economic incentives associated with the process of cantonment can increase the duration of DD programmes. External actors with a strong mandate can solve problems faster and have been instrumental in achieving a swift DD progression. Disarmament programmes must be realistically matched to conflict settings. This can include the use of mobile collection units, which have proved to be successful in cases where a primary centralised site is not sufficient.

Abstract:
Nepal's peace process has moved into a phase of definitive progress. More than five years after the ceasefire, the parties have reached a deal on the Maoist fighters, who will leave the cantonments and enter the army or civilian life. An unofficial deal sets out power-sharing arrangements until the next election. The parties are focusing on the critical task of writing a new constitution, which promises a deep restructuring of the state to become more representative and decentralised. Challenges remain, including from continuously evolving coalition dynamics and divisions within parties. There will also have to be further discussions on the combatants. As the parties discuss federalism, which of all peace process issues goes most to the heart of ordinary Nepalis' expectations and anxieties, groups within and outside the Constituent Assembly will see their options narrow, which could strain the process. Yet, this is still the best chance the parties have had to reach formal closure on the war and to institute some of the fundamental changes they promised, provided they have the courage to make far-sighted compromises.

Failure to address the systematic crimes committed during Nepal's ten-year civil war is threatening the peace process. There has been not a single prosecution in civilian courts for any abuses. The cultures of impunity that enabled the crimes in the first place have remained intact, further increasing public distrust and incentives to resort to violence. The immediate priorities should be prosecutions of the most serious crimes, investigation of disappearances and action to vet state and Maoist security force members.

Nepal's transition from war to peace appears chaotic. Many commentators warn of coming anarchy; the establishment fears a collapse of the social order and the fragmentation of the nation. But such fears are misguided. Nepal is not in chaos; its transitions may be messy and confusing but they are not anarchic. There is an order within the political change, albeit one that can be mysterious and unappealing to outsiders; the resilience of Nepal's political processes acts against fundamental transformations.

5. Nepal's Faltering Peace Process

Despite successful elections and a lasting military ceasefire, Nepal's peace process is facing its most severe tests yet. Major issues remain unresolved: there is no agreement on the future of the two armies, very little of the land seized during the conflict has been returned, and little progress has been made writing a new constitution. Challenges to the basic architecture of the 2006 peace deal are growing from all sides. Key political players, particularly the governing Maoists and the opposition Nepali Congress (NC), need to rebuild consensus on the way forward or face a public backlash. International supporters of Nepal must target assistance and political pressure to encourage the parties to face the threats to peace.

Over the past decade, the United States Institute of Peace (USIP) has trained members of police and military forces around the world to prepare them to participate in international peacekeeping operations or to contribute to post-conflict stabilization and rule of law interventions in their own or in other war-torn countries. Most of the training takes place outside the United States, from remote, rugged bases to centrally located schools and academies, from Senegal to Nepal, from Italy to the Philippines.

Abstract:
Nepal's peace process faces a crucial test this month. Elections for a Constituent Assembly (CA) are likely to go ahead on 10 April 2008 as scheduled but political unrest and violence could mar – or even derail – preparations, and the aftermath could bring turbulence. Elections in a delicate post-conflict situation are never straightforward and Nepal has many possible flashpoints, not least that the two armies that fought the war remain intact, politically uncompromising and combat-ready. Once results are in, all political players must be prepared for a difficult period in which they will need to compromise to make the CA an effective body, extend the number of parties with a role in government and urgently tackle crucial issues left aside during the campaign, including security sector reform. The international community has an important election observation function and should listen to Nepal's political and civil society groups in assessing the credibility of the process.

8. Nepal's Constitutional Process

Abstract:
With the formation of an interim legislature incorporating mainstream parties and Maoists, Nepal's peace process hinges on writing a constitution that permanently ends the conflict, addresses the widespread grievances that fuelled it and guards against the eruption of new violence. Most political actors have accepted the Maoist demand for a constituent assembly (CA) tasked with framing a new dispensation, although royalists are worried over the future of the monarchy, which has in effect been suspended. The major challenge is to maintain leadership-level consensus while building a broad-based and inclusive process that limits room for spoilers and ensures long-term popular legitimacy. Recent unrest in the Tarai plains illustrates the dangers of ignoring popular discontent. Key political actors need to prepare more seriously for the CA. Led by the newly established United Nations mission in Nepal (UNMIN), the international community should pressure all sides to abide by their stated commitments and global norms and provide technical assistance to the electoral process.

On November 21, 2006, Nepal's government and the Communist Party of Nepal (Maoist) signed a comprehensive peace agreement (CPA) to formally end their ten-year conflict, which has resulted in an estimated 13,000 deaths. The agreement has been widely hailed as historic and many observers feel cautiously optimistic, in spite of the hurdles that lie ahead. On January 22, 2007, the U.S. Institute of Peace sponsored a one-day program in Washington, D.C., to address the challenges Nepal now faces. It brought together a broad spectrum of attendees, from representatives of academia and international organizations such as the International Monetary Fund (IMF) and World Bank to the U.S. Departments of State and Justice. Presenters were asked to comment on particular challenges that Nepal faces during the peace process. This USIPeace Briefing provides an overview of the presentations given at the conference, and includes remarks from Ambassador Julia Chang Bloch (former U.S. ambassador to Nepal and president of the U.S.–China Education Trust); Dr. Chitra K. Tiwari (journalist, The Washington Times); Dr. Jaya Raj Acharya (senior fellow, USIP); and Kul Chandra Gautam (assistant secretary-general of the UN and deputy executive director of UNICEF). Nepal is in a period of transition to peace and democracy, progressing on many fronts but encountering some challenges and threats to sustainable peace along the way. King Gyanendra relinquished absolute control and reinstated the House of Representatives on April 24, 2006, underscoring the movement toward democracy. The Maoists and the government of Nepal signed a peace agreement on November 21, 2006, and then a ceasefire agreement on December 8, 2006, ending the ten-year insurgency. An Interim Constitution was adopted on January 15, 2007, and the Maoists joined the government. Despite these positive steps, the Terai region, located in the southern lowlands of Nepal near the border of India, has experienced a surge in violence from the last six months.
