501. Iraqi Tribunal Imposes Death Sentence on Saddam Hussein

Abstract:
The Iraqi High Tribunal (IHT), or Iraqi Higher Criminal Court, previously known as the Iraqi Special Tribunal (IST), announced Nov. 5, 2006, that it was sentencing former Iraqi dictator Saddam Hussein Al-Majeed to death by hanging. The verdict comes in the first prosecution Saddam has faced before the tribunal, for the 1982 mass killing of villagers in the Shia town of Dujayl and related atrocities. Bringing Saddam and his henchmen to justice has posed unique challenges to an Iraq that seeks to make a former totalitarian dictatorship subject to rule of law, and in the process respect rule of law by providing fair trials. Unclear is the extent to which efforts to establish an historical record of atrocities, and undertake national healing, would be thwarted by executing Saddam before he can be tried for additional incidents. Of added significance are concerns raised by some voices that the death penalty itself is immoral and inconsistent with rule of law.

Abstract:
The second phase of the Center for Strategic and International Studies' Transatlantic Dialogue on Terror took place against a backdrop of rapid change. When the first conference in this series took place in Berlin in the spring of 2005, scholars and practitioners were still absorbing the details of the previous year's attacks against the Madrid light rail system, the murder of Dutch artist Theo van Gogh and a host of other attacks and foiled plots. Global radicalism continued to be shaped by the deepening insurgency in Iraq, in which radical Islamists from inside and outside that country play a pivotal role. In the months following the Berlin meeting, the bombing of the London Underground, the attacks in Sharm el-Sheikh and Amman, and a stream of revelations about radical Islamist activity from Europe to the Middle East to South Asia and Australia — where a group of conspirators were arrested for plotting an attack against that country's sole nuclear facility — had also to be taken into account.

503. Mapping the Jihadist Threat: The War on Terror Since 9/11

Abstract:
Secretary of Defense Donald Rumsfeld famously bemoaned the challenges of measuring success in a long twilight struggle with Islamic fundamentalists. There are the “known unknowns” and “unknown unknowns” that confront the United States in the most unfamiliar set of foreign policy challenges in the country's history. In addition to the difficulties of establishing “metrics” – as Rumsfeld would put it – in our war on terror, there is also the intrinsically related and perhaps more vexing question of how the global ideological virus of Islamic fundamentalism is morphing and evolving. An influential and well-funded cohort of radicalized Islamists, seizing upon an unyielding interpretation of religious text (a kind of Koranic original intent), has been at war with the West for nearly a generation, and the pace of operations globally is accelerating. According to recently released U.S. government reports, there has been a sharp surge in the number of global terrorist attacks in recent years, a tally substantially comprised of incidents initiated by Islamist instigators. Taken in its totality with all its many manifestations, the jihadist challenge stretches from the Taliban strongholds in the rugged Afghan mountains and the dense jungle hideouts of the Philippines, to the ornate mosques of Saudi Arabia, from a quiet neighborhood in Leeds, England to, just possibly, a place near you.

Prior to his current assignment, Ambassador Burns was the United States Permanent Representative to the North Atlantic Treaty Organization. As Ambassador to NATO, he headed the combined State-Defense Department U.S. Mission to NATO at a time when the Alliance committed to new missions in Iraq, Afghanistan and the global war against terrorism, and accepted seven new members.

As Iraq teeters on the precipice of a civil war, Abu Musab al-Zarqawi, al Qaeda's leader in Iraq, continues to search for ways to push the country over the edge.1 Yet questions linger about Zarqawi's ultimate motivation: Is it his loathing of foreign occupation forces that make him tick? Or is his hatred of Iraq's Shia the essential and irreducible sentiment that sustains his violent jihad? This distinction between Zarqawi's quest to promote a Sunni-Shia civil war and al Qaeda's broader goal of waging a universal battle that unites all Muslims against Western "infidels" has many implications, not merely for the future of Iraq, but also for the Middle East and the war on terror itself.

The landslide victory of the Palestinian Islamist movement Hamas in the January 25 Palestinian legislative elections has been met with concern and alarm by Israel, the United States, and others in the international community. This concern is rooted in Hamas' history as an organization that sponsors terrorism and that is ideologically committed to the destruction of Israel. For many observers in Israel and throughout the international community, Hamas' victory signaled the end of Israeli-Palestinian peacemaking.

President Bush recently likened the war oon terror to the struggles American faced in World War II, expkaning that our enemies are “successors to Fascists, to Nazis ... and other totalitar- ians of the 20th century.”1 The analogy to World War II is useful and illuminating. Important lessons from World War II apply to the war on terror. Yet the Bush administration has itself left the lessons of World War II largely unheed- ed. Its conduct of the war on terror departs from the policies that brought the United States victory in World War II and success in the postwar years.2 The administration will have more success against our terrorist enemies if it learns and applies the methods that won the Second World War.

508. The Bush Administration is Weak on Terror

The U.S. public widely credits President Bush with toughness on terror. An August 2006 poll found 55 percent of Americans approving his handling of the campaign on terror and only 38 percent disapproving. Republican candidates are running successfully on the terror issue in this fall’s election campaign. In fact, the Bush administration is weak on terror. The administration wages a one-front war against al-Qaeda, the main terror threat, when effort on every relevant front is needed. Specifically, it has focused on an offensive military and intelligence campaign abroad while neglecting five other critical fronts: bolstering homeland security, securing weapons and materials of mass destruction from possible theft or purchase by terrorists, winning the war of ideas across the world, end- ing conflicts that fuel support for al-Qaeda, and saving the failed states where al-Qaeda and like groups can find haven. The administration has also bungled parts of the mili- tary offensive by diverting itself into a counterproductive sideshow in Iraq and by alien- ating potential allies. As a result, al-Qaeda and related jihadi groups remain a potent threat more than five years after the 9/11 attacks.3 Assessments by U.S. intelligence and other analysts actually indicate that the terror threat has increased since 9/11.4 The Bush administration’s toughness on terror is an illusion. Its counterterror cam- paign has been inept and ineffective.5 President Bush talks the talk of strong action but doesn’t walk the walk. And his weakness on terror is a putting the United States in great danger.

Abstract:
When Israel reacted with military force to the Hamas and Hezbollah raids of June and July, world leaders recognized Israel's right to respond, but some charged it was using disproportionate force. International law supports both points. States may take defensive measures, but every use of force must be proportionate to the harm inflicted. These rules are found in the law regulating resort to force (jus ad bellum) and the law regulating the conduct of force (jus in bello). The most important rule in either category may w ell be the principle of proportionality. Respect for proportionality in the use of force can help foster stable, long-term peace.
