31. Authoritarian Regime Learning: Comparative Insights from the Arab Uprisings

Abstract:
This paper examines the learning of authoritarian regimes in the early phase of the Arab uprisings. Differentiating conceptually between learning and policy change, we analyze and compare the authoritarian regimes of Algeria, Bahrain, Jordan, and Syria and their reactions to the challenge of "late riser" oppositional protests. We first show that the four regimes initiated very diverse measures in the domains of repression, material co‐optation, and legal reforms. With regard to the sources of learning, we find that proximity is a determining factor, in terms of both geography and political similarity. Using the case of Bahrain, we then demonstrate that structural factors such as internal power structures, regional and international pressures, or state capacity can decisively constrain the implementation of learning‐induced policy change. Abstract:
Penitentiaries and penal policies have been one of the many areas subjected to changes in the context of the judicial reform taking place in Turkey over the last several years. Officials have been inspired to develop new policies in this field by a number of factors: the rise in the number of inmates and the resulting capacity problem; the inefficacy of outdated municipal prisons; and the need to support the resocialization of inmates through new penal policies. Efforts to increase the resocializing impact of the penal system in Turkey and the mentality transformation aiming at overcoming the historical baggage the penal system carries in Turkey are positive. However, these have not yet produced satisfactory results. This is why human rights violations in penitentiaries in Turkey are still continuing. This report argues that the general aim of the penal regime should be based on ‘resocialization’. Therefore, individuals after going through all stages of the penal process and after facing their crime, should be given the opportunity to fully participate in society again. With this perspective the report assesses the current penal reform process in Turkey and puts emphasis on the need for a holistic penal regime that focuses on resocialization of offenders in all penal stages and applies international human rights standards.

33. Dispute Resolution and Justice Provision in Yemen's Transition

Abstract:
Yemen has long had a vibrant tradition of community-based dispute resolution, particularly tribal dispute resolution, which has become even more dominant in the transition period that followed the 2011 Arab Spring protests. As the Yemeni state has struggled to regain political equilibrium, rule of law has deteriorated and criminality and armed conflict have increased. State institutions have weakened and now struggle to meet citizens' demands. In response, citizens increasingly turn to traditional or community-based dispute resolution for their justice needs. In addition to long-standing actors or mechanisms, a number of new dispute resolution actors have emerged. Some areas have seen a retribalization, while in others, armed actors dominate. Although alternative dispute resolution actors have been an important gap-filler during this time, they have also found their authority challenged. The political uncertainty and the rise in lawlessness have simultaneously weakened both formal and informal actors' ability to resolve disputes sustainably and to prevent conflict. The result has been more limited options for peaceful dispute resolution overall, which feeds instability and has the potential to exacerbate broader conflict dynamics and weaknesses in the rule of law. Strengthening the options for lower level dispute resolution and conflict prevention are critical to restoring stability. Because of the centrality of these community-based justice mechanisms in Yemen, efforts to strengthen rule of law must take a more holistic view of justice provision to include these mechanisms and practices. Program interventions should not preference or target one system over the other but instead take an integrated approach and consider the significant role that alternative dispute resolution plays. Critical elements include supporting greater understanding of and dialogue with dispute resolution actors, incorporating alternative dispute resolution into the justice sector strategy, and focusing on reforms and adaptions on both sides.

Abstract:
Far from disenfranchising certain groups, the pending legislation could spur smaller parties to form new political alliances that would likely favor the center-left opposition in future elections. As the Israeli Knesset prepares to pass a series of electoral reforms under the rubric of a new "Governance Law," one provision has drawn particularly strong criticism: the raising of the threshold required for political parties to obtain seats in the legislature to 3.25% of total votes cast. Media attention has focused on opposition concerns about the measures being "anti-democratic" and potentially disenfranchising Arab Israeli citizens. Yet close analysis of recent electoral results and political realities indicates that the new law could actually help the Israeli center and left.

The 2011 protests against corruption, lack of accountability, limited access to basic services, and the extreme centralization of power transformed Yemen. In November of that year, the main political parties signed a transition plan, brokered by the Gulf Cooperation Council, which provided the framework and process to achieve a peaceful transfer of power. Two of the key steps agreed upon in the transition plan were the convening of the National Dialogue Conference (NDC), followed by drafting a new constitution based on the outcomes of the National Dialogue.

The popular uprisings that swept the Arab world in 2011 passed Algeria by. While there were sporadic street demonstrations calling for political change, principally in the country's capital Algiers, they quickly petered out due to lack of support from the general public. Unlike in Egypt, Libya, and Tunisia, the political power system in Algeria remained intact. The autocratic government of Abdelaziz Bouteflika, who has been the president since 1999, retained complete control, culminating in his reelection on April 17 for a fourth term despite his obviously failing health.

Abstract:
A number of amendments for criminal law have been instituted in Turkey in recent years within the framework of the judicial reform process that especially were geared towards the realization of the fair trial principle. Between 2011 and 2013, four groups of legal amendments named “Judicial Reform Packages” were passed. These brought about important improvements regarding fair trial, freedom of speech, personal liberty and security. The TESEV Democratization Program published a report evaluating the effect of these four judicial reform packages on rights and freedoms in September 2013. This brief report provides an evaluation of the amendment package instituted in March 2014 that included important changes vis-a-vis the specially empowered judicial system.
