1. What the Compact Impact Fairness Act Means for Compact Host Governments and Migrants

Abstract:
The Biden-Harris Administration’s 2024 Department of the Interior (DOI) budget proposal supports passing the Compact Impact Fairness Act (CIFA). CIFA would restore federal benefits to migrants from three Pacific countries: Palau, the Federated States of Micronesia (FSM), and the Republic of the Marshall Islands (RMI). Support for CIFA is a welcome development for Compacts of Free Association (COFA) migrants and the US states and territories that host them. Yet, the budget proposal’s omission of funding support for host governments and uncertainty on implementation and prioritization for COFA migrants present acute issues that may linger for years ahead.

Abstract:
Climate change and sea-level rise are existential threats to low-lying island States, which face the looming submergence of their territory and the correlative depopulation and severe restrictions on their governmental capacity, at a national and international levels. Four States are particularly endangered because they are exclusively (or almost exclusively) composed of coral islands and atolls below 10 or even five meters of altitude. They are Tuvalu, Kiribati, the Marshall Islands in the Pacific Ocean, and the Maldives in the Indian Ocean. In its Fifth Assessment Report, the Intergovernmental Panel on Climate Change foresaw an average rise of sea level of 98 cm by 2100. This prospect, often regarded as conservative, in fact represents a possible death sentence for these States. As a result, low-lying island States are considering and deploying legal and physical strategies to protect their continuity as States, sparking new debates on the potential evolution of the law on Statehood and the international law of the sea.

Abstract:
Climate change impacts--temperature and rainfall changes, extreme events, sea-level rise, and ocean acidification--are amplifying health risks in vulnerable populations throughout the Pacific Islands, and also influence their mobility. This nexus of climate change, health, and migration is evident in the experience of the Marshall Islands. The nation and its population are dispersed over almost two million square kilometers of ocean, with sizeable diasporas in the United States. Climate impacts in the Marshall Islands exacerbate ongoing health threats, such as limited drinking water supplies, inadequate nutrition, and poor infrastructure. The out-migration of Marshallese is largely motivated by health, economic, education, and environmental reasons; therefore, planning for migrant movements should include adaptation strategies that also reduce health risks. A better understanding of how health, mobility, and climate change interact will help shape policy responses and provide useable climate information for focused, timely interventions that maximize health and well-being among populations in motion.
