21. Title to Territory in the Post-Colonial Era: Original Title and Terra Nullius in the ICJ Judgments on Cases Concerning Ligitan/Sipadan (2002) and Pedra Branca (2008)

Abstract:
This article approaches two International Court of Justice judgments on the cases concerning Ligitan/Sipadan (2002) and Pedra Branca (2008) from the perspective of the law of territory in the post-colonial context, showing that the Court managed to free the concepts of ‘original title’ from ‘terra nullius’. It is prefatorily explained that the concepts of ‘original title’ and ‘terra nullius’, which operate in combination, had both functioned as bases for the traditional law of territory and as unilateral justification for colonization by European powers. By contrast, analysis of the two recent judgments illustrates that the Court contrived to separate the two concepts from the context of colonialism by avoiding the determination of the islands as ‘terra nullius’ and expanding the concept of ‘original title’ while preserving the existing framework of law of territory. The problem is presented with a caveat, however; overemphasizing the significance of ‘original title’ in the post-colonial context might lead to disregard for the foundations of title to territory, that is effective control of territory and its legitimizing logic, on which the territorial order of today’s international society is based.

Abstract:
The hottest topic in world trade these days is the Trans-Pacific Partnership (TPP). Hailed as a state-of-the-art free trade agreement (FTA), it will unite 11 countries—Australia, Brunei, Canada, Chile, Malaysia, Mexico, New Zealand, Peru, Singapore, the United States, and Vietnam—with a combined GDP of almost $21 trillion (about 30 percent of world GDP) and $4.4 trillion in exports of goods and services, or about a fifth of total world exports. If you add Japan and South Korea—who are actively exploring entry later this year—TPP would cover 40 percent of world GDP and nearly a third of world exports.

Abstract:
In the space of just over five decades, Malaysia has transformed from a largely agrarian economy to a manufacturing economy with a sustained high rate of economic growth. While Malaysia‟s achievement in terms of raising the per capita income of its citizens is pretty much universally acclaimed, recent concerns have been expressed that Malaysia is now in a middle-income trap. Moreover, there are a growing number of commentators who are arguing that Malaysia‟s New Economic Policy (NEP) needs an overhaul if Malaysia is to progress to become a high-income country. This paper provides an overview of the evolution of the Malaysian economy and critically evaluates recent strategic reform initiatives, encapsulated in the New Economic Model (NEM) and Economic Transformation Programme (ETP) that are designed to assist Malaysia in its aim to become an innovation-intensive, high-income country by 2020.

Tensions in the South China Sea have continued to build over the last year, with the Philippines submitting its evidence against Chinese claims to an arbitration tribunal, Beijing parking an oil rig in waters claimed by Vietnam, and Malaysia growing increasingly anxious about Chinese displays of sovereignty at the disputed James Shoal. These and other developments underscore just how critical managing tensions in the South China Sea are, for the region and for the United States.

Moscow's aggression against Ukraine has truly been a “game changer” for the Atlantic Alliance. Its implications for NATO's further evolution can hardly be over-estimated and after the likely shoot-down of a Malaysian civil aircraft over Ukrainian territory, controlled by pro-Russian rebels, the situation is even more unpredictable. Even if the catastrophe has put heavy political pressure on President Putin to reduce Russian involvement in Ukraine, Moscow is still not likely to revert the annexation of the Crimean peninsula. As a result, the crisis will dominate the international security debate for a long time to come. Thus, signs of resolve directed at Russia, measures to reassure the NATO members in Eastern Europe and indications of further cooperation with Ukraine will rank very high on the agenda of the NATO summit in Wales in September 2014. With the draw-down of the operation in Afghanistan, some Allies tend to see NATO's future role as primarily to preserve the territorial integrity of its member states. Hence, they argue in favour of a “back to basics” approach with an Alliance concentrated on its defence mission, according to Article 5 of the Washington Treaty.

The negotiation of the Trans-Pacific Partnership (TPP), a megaregional agreement to lower barriers to trade and investment and promote economic integration in the Asia-Pacific region, has been a dynamic process with a number of countries joining the talks in midstream. Since negotiations began in March 2010, participation in the TPP talks has expanded several times to include Malaysia (October 2010), Vietnam (December 2010), Canada and Mexico (October 2012), and Japan (July 2013). In November 2013, Korea announced its interest in participating in the TPP and began consulting with the countries involved. The TPP now has 12 participants. Korea is still considering whether to become lucky 13.

28. Trading Forests: Quantifying the Contribution of Global Commodity Markets to Emissions from Tropical Deforestation

Abstract:
This paper aims to improve our understanding of how and where global supply-chains link consumers of agricultural and forest commodities across the world to forest destruction in tropical countries. A better understanding of these linkages can help inform and support the design of demand-side interventions to reduce tropical deforestation. To that end, we map the link between deforestation for four commodities (beef, soybeans, palm oil, and wood products) in eight case countries (Argentina, Bolivia, Brazil, Paraguay, Democratic Republic of the Congo, Indonesia, Malaysia, and Papua New Guinea) to consumption, through international trade. Although few, the studied countries comprise a large share of the internationally traded volumes of the analyzed commodities: 83% of beef and 99% of soybean exports from Latin America, 97% of global palm oil exports, and roughly half of (official) tropical wood products trade. The analysis covers the period 2000-2009. We find that roughly a third of tropical deforestation and associated carbon emissions (3.9 Mha and 1.7 GtCO2) in 2009 can be attributed to our four case commodities in our eight case countries. On average a third of analyzed deforestation was embodied in agricultural exports, mainly to the EU and China. However, in all countries but Bolivia and Brazil, export markets are dominant drivers of forest clearing for our case commodities. If one excludes Brazilian beef on average 57% of deforestation attributed to our case commodities was embodied in exports. The share of emissions that was embodied in exported commodities increased between 2000 and 2009 for every country in our study except Bolivia and Malaysia.
