Abstract:
Parliamentary oversight refers to the ongoing1 monitoring, review, evaluation and investigation of the activity of government and public agencies, including the implementation of policy, legislation and the expenditure of the state budget. Parliamentary oversight is one of the most important manifestations of the separations of powers in a democracy. Parliamentary oversight must extend to all areas of government, including intelligence and security services. Intelligence services work in secrecy and have the authority to make use of special powers that potentially are highly invasive of human rights. Communications interception and secret surveillance are only two of such powers. For these reasons, intelligence services are regarded by the public with suspicion and lack of confidence. Therefore, the need for legality, legitimacy and accountability is even higher for intelligence services than for other government agencies. As the lawmaker, parliament is responsible for enacting clear, accessible and comprehensive legislation establishing intelligence services, their organisation, special powers and limits. Parliamentary oversight activities review, evaluate and investigate how laws are implemented and how intelligence operations are in line with the constitution, national security policy and legislation. Parliament also approves the budget of intelligence services and can play a strong role in scrutinizing expenditure. Effective parliamentary oversight ensures a bridge between intelligence and the public and brings benefits to all: intelligence community, parliament itself and most importantly, the citizens.

2. OSCE Principles in Practice: Testing Their Effect on Security Through the Work of Max van der Stoel, First High Commissioner on National Minorities 1993–2001

Abstract:
This monograph tests the OSCE approach to security. The OSCE approach to security encompasses all areas that can cause tensions and conflict between States, and is the result of a sustained effort by almost all of the world’s democracies on how to achieve both security and individual freedom. An important basis of the OSCE security concept is that international security cannot be achieved without the protection and promotion of individual rights and freedoms. The study first extracts from official OSCE documents a set of principles designed to achieve international security, and then uses the work of the first OSCE High Commissioner on National Minorities (HCNM), Max van der Stoel, to test the effectiveness of the principles in practice. From 1993 to 2001, HCNM Max van der Stoel applied OSCE principles in cases involving minority tensions with a high potential for international conflict, and this experience provided the means to assess the practical effects on security when OSCE principles are implemented. The study examined three cases that involved potential conflict: Ukraine and separatism in Crimea; Estonia and tensions regarding the Russian minority; and Macedonia and tensions regarding the Albanian minority. The study found that in each of the three cases, the implementation of OSCE principles reduced national and international tensions involving minority issues, and increased security. The increase in security was seen within each State, between States, and in the region, and reduced the potential for conflict within and between OSCE States. The results were particularly significant in view of the instability, conflicts, and tensions of the post–Cold War period; the OSCE’s ongoing institutionalization during the period; and the limited resources and tools available to the OSCE and the HCNM. The study identified and articulated twenty OSCE security principles that addressed national and international security. The principles addressed the rights and responsibilities of State sovereignty; a comprehensive, cooperative, and common security approach; the prevention of security threats and the peaceful resolution of issues; the protection and promotion of individual rights and freedoms through democracy, the rule of law, and the market economy; rights and responsibilities pertaining to national minorities; the development and advancement of shared values; and processes and mechanisms. The monograph extended the research on the OSCE principles to express an OSCE security concept. The OSCE security concept is a security framework based on the idea that security depends on the development and implementation of principles guiding three areas: how States deal with each other and resolve problems; the protection and promotion of individual rights within States; and the processes and mechanisms to review and advance values, principles, and commitments. The study showed that the implementation of OSCE principles in Ukraine, Estonia, and Macedonia significantly increased security in those three countries and the OSCE region. The study found that the OSCE principles and the OSCE security concept constitute a significant body of thought and practice regarding security, and respect for the individual. The OSCE principles, the OSCE security concept, and the work of the High Commissioner on National Minorities merit further examination, development, and application to national security policy and practice. The application to national security policy and practice is relevant to all security threats and problems.

3. Disarmament and demobilisation in comparative perspective: patterns and policy recommendations

Abstract:
Disarmament and demobilisation (DD) programmes are vital components of strategic peacebuilding. DD provisions govern the collection and disposal of arms and ammunition, and oversee the discharge of active-duty combatants from the state's armed forces, rebel groups, or both. Using data from the Peace Accords Matrix database, this report compares the five most recent cases of DD implementation: Nepal (2006), Liberia (2003), Macedonia (2001), Indonesia-Aceh (2005) and South Sudan (2005). A comparative analysis reveals several common patterns in the kinds of provisional and operational choices associated with efficient DD implementation. Having a definite timeline and largely completing the process prior to the first elections creates an incentivised environment for a timely DD process while diminishing the risks of election-related violence. Economic incentives associated with the process of cantonment can increase the duration of DD programmes. External actors with a strong mandate can solve problems faster and have been instrumental in achieving a swift DD progression. Disarmament programmes must be realistically matched to conflict settings. This can include the use of mobile collection units, which have proved to be successful in cases where a primary centralised site is not sufficient.

4. Launch of the Western Balkans Parliamentary Forum

Abstract:
On 01 November 2006, an initial exploratory meeting for a Western Balkans Members of Parliaments took place in Belgrade. The meeting was organised by SEESAC with the assistance of the Parliamentary Forum on Small Arms based in Sweden. Members of the European and EU member states' Parliaments, the Secretary General of the Parliamentary Forum for SALW, and UNDP technical advisors and project managers informed the parliamentarians from the Western Balkans about EU SALW strategies and engagement, the involvement of EU parliamentarians in SALW Control, the importance of a national SALW control strategy, and the need for co-ordinated action and increased parliamentary diplomacy, oversight and advocacy.

Abstract:
The Chairman recalled the reasons for holding this particular session. On the one hand, at the Thessaloniki meeting of the European Council (June 2003), the prospect was laid out of the Balkans being included, over time, within the European Union; hence, the title of the session. How that vision is to be fulfilled is obviously very much open to question, which is indeed one of reasons underlying the work of the new International Commission on the Balkans chaired by former Italian Prime Minister Giuliano Amato. On the other hand, short-term events are going to put the Balkans at the centre of European concerns over the coming months in the run-up to the final status discussions in mid-2005: the Macedonian referendum in early November, the deployment of European Union forces in Bosnia-Herzegovina (operation Altea) in December and the rising expectations of Kosovar Albanians following the October 2004 elections. To introduce the session three papers were presented.

Abstract:
It is an understatement to say that the presence of small arms and light weapons is a significant problem in the Balkans. Guns contributed significantly to the violence, death, and destruction that surrounded the inter-ethnic conflicts of the 1990s and early 21st century. Since the conclusion of hostilities, the effects of violent conflict persist in the area, as does the circulation of many SALW. In fact, these weapons continue to cause civilian injuries and deaths, constrain social and economic development, enhance criminal capability, and contribute to ethnic and societal tensions that may incite future conflicts throughout the Balkans.

Abstract:
This study was commissioned by the South Eastern Europe Clearinghouse for the Control of Small Arms and Light Weapons (SEESAC). The purpose of the Ammunition Detection Study is to determine if there is evidence to support the SEESAC hypothesis that it may be more productive to specifically target the detection of ammunition for Small Arms and Light Weapons rather than the weapons themselves. SEESAC is a developing organisation, with a responsibility to identify information on the precise level of smuggling activity and also advise on measures to reduce cross border trafficking; clearly current search methodologies used to detect weapons and ammunition within the region are an important component of this advice. Following discussions with the SEESAC Team Leader a set of assumptions, to support the Terms of Reference (TOR), were agreed.Initial desktop research examined weapons and ammunition design and manufacture to determine if and why weapons can be more easily concealed than ammunition and what constituent parts are common or exclusive to one particular commodity. Further analysis was conducted to determine if ammunition and weapons are consistently transported together and examples of occurrences are provided. The investigation has involved visits to specialist organisations and national security agencies that have undertaken to provide data on suitable search and detection methodologies. Recent events require that policymakers revise substantially the conventional assessment that Macedonia is the foremost political “success story” of the Balkans. In fact, it is an underperforming post-conflict country still very much at risk, unable to tackle – operationally or politically -- its security challenges without upsetting an uncertain ethnic balance. Clear-eyed analysis of the dynamics driving unrest, from criminality and weak policing to an equally weak economy and corruption, is needed if a country that narrowly avoided war in 2001 is to secure long-term stability. Specifically, Macedonia cannot yet safely do without the presence of an international security force.

10. Assessing Democratic Oversight of the Armed Forces

Abstract:
There is no such thing as the model for democratic control of the armed forces. Perhaps more influential than constitutional arrangements; historical legacies and political cultures are setting conditions. However, a few essentials or principles of democratic oversight can be discerned. This paper aims to provide an overview of the efforts of different post-communist states in establishing democratic oversight over their armed forces. The comparative analysis is based on a study that the staff of the Centre for European Security Studies has conducted last year (Organising National Defences for NATO Membership - The Unexamined Dimension of Aspirants' Readiness for Entry) and the experiences gained from a three-year multi-national programme that CESS has started in 2001 (Democratic Control South East Europe: Parliaments and Parliamentary Staff Education Programme - DEMCON-SEE). This programme is running in seven countries: Albania, Bosnia-Herzegovina, Bulgaria, Croatia, Macedonia, Romania, and Serbia-Montenegro.
