21. Reconstructing Gaza – Lessons from Lebanon

Abstract:
Last week's international donor conference to address the question of humanitarian assistance to Gaza underscores the myriad challenges confronting the process. Namely, how should the international community respond to the complex issues surrounding assistance in post-conflict recovery and reconstruction, particularly when several key donors reject any contact with Hamas, the governing authority on the ground? By any estimation, the Gaza reconstruction process will face several perplexing issues: How can billions of US dollars be effectively, transparently and accountably dispersed in a coordinated way, when several key donors and the Government of Israel reject any moves that will bolster the fortunes of Hamas, who m they classify as a terrorist organisation? What impact will an emerging Palestinian National Unity Government have on the mechanisms for overcoming many donors' reluctance to deal directly with Hamas? What opportunities and challenges does the reconstruction of Gaza pose for a rapprochement between Hamas and Fatah? Who will lead the reconstruction process and how will meaningful activity take place in the face of severe restrictions on access and movement? With Hamas in power in Gaza and Israel ref using to consider opening their common borders until kidnapped Israeli Defence Forces Corporal Gilad Shalit is released by Hamas, how is meaningful recovery and reconstruction even possible? In the absence of a credible political process, what use is reconstruction anyway if it merely returns the population of Gaza to their pre-conflict socio-economic imperilment? Lebanon faced a similar situation following the 2006 war between Hezbollah and Israel.

Abstract:
As they emerge from conflict, states can rarely commence the arduous task of reconstruction and consolidate their governments until they undertake extensive restructuring of their security forces. Palestine, Lebanon, and Yemen are all fractured, quasi-democratic states with divided societies, and deep disagreement over what constitutes the national interest. Successful reform in each will require security institutions that answer to democratically-elected civilian leaders, but the U.S. and European approach has thus far focused largely on providing military training and equipment, targeted toward counterterrorist capabilities.

Punctuated by conflict in Iraq, an ascendant ran, and continued instability in Lebanon and the Palestinian territories, rising volatility in the Middle East threatens U.S. interests in the region. Meanwhile, sectarianism, al-Qaeda–inspired terrorism, and the proliferation of weapons of mass destruction (WMD) all serve as troubling overlays to this complex mix. Mired in Iraq and Afghanistan, the United States has yet to develop a comprehensive strategic framework that addresses these interrelated challenges. Instead, U.S. policy has been largely crisis-driven, attempting to put out fires by confronting issues on an ad hoc basis rather than seeking to respond to the underlying forces and tensions that catalyze conflict and instability in the Middle East.

Abstract:
On December 14, the European Union is slated to initial an association agreement with Syria. The pact had been on hold since 2004 because the EU "deemed that political circumstances were so far not right for its signature and ratification." These "circumstances" mostly concerned Damascus's pernicious policies in Lebanon, including its presumed role in the 2005 assassination of former Lebanese premier Rafiq Hariri. In recent months, however, Syria has rehabilitated its image in Europe, helping the pariah state end a lengthy period of international isolation. If it is signed, the agreement would be the latest in a series of cost-free diplomatic gains for Damascus in Europe.

Abstract:
In response to criticisms that its military attacks on Gaza following Hamas Qassam rocket strikes in Sederot were causing unnecessary civilian casualties, Israel's Ministry of Foreign Affairs (MFA) released a background paper in March, excerpted below, to clarify and justify the Israel Defense Forces' (IDF) understanding of the principle of proportionality. This principle, along with the principle of intentionality, forms the jurisprudence of International Humanitarian Law. Citing a number of international legal scholars and Article 52(2) of the Additional Protocol I of the Geneva Conventions (1977), to which Israel is a signatory, the background paper attempts to redefine proportionality in order to legitimate attacks on targets that are not strictly military, placing the blame for any civilian deaths on Hamas for using civilians as "human shields." Although the IDF and the MFA have advanced this argument in response to international criticism about IDF strikes causing civilian deaths in Lebanon and the occupied Palestinian territories, this background paper represents an attempt to subordinate the need to cause as little harm to civilians as possible to Israel's stated need to preempt future attacks. Last week, Lebanese president Michel Suleiman met with President Bush at the White House -- the first visit by a Lebanese head of state since 1996 -- and reportedly pressed for a continued U.S. commitment to the bilateral military assistance program. Since the program's revitalization after the election of the pro-West March 14 coalition in 2005, the administration has provided nearly $400 million in foreign military financing (FMF) to Beirut, making Lebanon the second largest per capita recipient of U.S. military assistance after Israel. While Washington continues to back Beirut (the administration has requested $60 million in military assistance for Lebanon for 2009), Hizballah's recent political gains and lingering questions about the future disposition of the Lebanese government will likely prevent the administration from expanding either the quantity or quality of the military requests.

Abstract:
After September 11, 2001, the Bush administration launched an ambitious policy to forge a new Middle East, with intervention in Iraq as the driver of the transformation. "The establishment of a free Iraq at the heart of the Middle East will be a watershed event in the global democratic revolution," declared President Bush on November 7, 2003. In speech after speech, Bush administration officials made it abundantly clear that they would not pursue a policy directed at managing and containing existing crises, intending instead to leapfrog over them by creating a new region of democracy and peace in which old disputes would become irrelevant. The idea was summarized in a statement by Secretary of State Condoleezza Rice during the war between Lebanon and Israel in the summer of 2006. Pushing Israel to accept a cease- fire, she argued, would not help, because it would simply re-establish the status quo ante, not help create a new Middle East. The new Middle East was to be a region of mostly democratic countries allied with the United States. Regimes that did not cooperate would be subjected to a combination of sanctions and support for democratic movements, such as the so-called Cedar Revolution of 2005 in that forced Syrian troops out of the country. In extreme cases, they might be forced from power.

The Middle East is immersed in its worst crisis in years following the capture of three Israeli soldiers by the Palestinian Islamic Resistance Movement (Hamas) and Lebanese Party of God (Hizbollah) in late June 2006 and early July, Israel's comprehensive offensive throughout the Gaza Strip and Lebanon, and the daily firing of rockets deep into Israel. And horrific as it is, the current toll of death and destruction could reach entirely different proportions should a new threshold be crossed – a Hizbollah rocket that strikes a chemical plant or a heavily populated area in Tel Aviv or Haifa, an Israeli bombing raid resulting in massive casualties, a major ground offensive, or the expansion of the war to Syria or Iran. A political solution to the twin crises of Lebanon and Palestine must be the international community's urgent priority. Waiting and hoping for military action to achieve its purported goals will have not only devastating humanitarian consequences: it will make it much harder to pick up the political pieces when the guns fall silent.

The adoption of Security Council Resolution 1701 brought a halt to the month-long Israeli-Hezbollah war. UNIFIL will be greatly expanded with a more vigorous mandate to back Lebanese assertion of full sovereignty and control over southern Lebanon and the disarmament of Hezbollah’s militia and missile sites. But is an agreement hammered out in Manhattan sustainable on the ground? Was success in New York confirmation that the Bush administra- tion has come to terms with the utility of the United Nations and the facility of our friends and allies? Or does the agreement’s ambiguity and fragility underscore the costs of dogged non-engagement with our adversaries, even in times of crisis?

Few political actors in the Middle East have seen their environment as thoroughly affected by recent events in the region as Hizbollah, the Lebanese political-military organisation that first came on the scene in the mid-1980s. In U.S. political circles, calls for action against Hizbollah, which is accused of global terrorist activity, are heard increasingly. With the ouster of Saddam Hussein's regime, the U.S. has upped its pressure on Syria and Iran - Hizbollah's two most powerful patrons. Meanwhile, Israel has made clear it will not tolerate indefinitely the organisation's armed presence on its northern border. Within Lebanon itself, weariness with Hizbollah and questions about its future role are being raised with surprising candour.
