61. The Sarayaku and the Inter-American System on Human Rights: Justice for the “Medio Dia” People and their Living Jungle

Abstract:
How was it possible for an indigenous people in the middle of the Amazon to protect their life and territory from oil exploitation? What was the response of the Government of Ecuador to the claims of the Sarayaku people? How is a human rights strategy developed at different geographical levels? In this text, Mario Melo Cevallos, lawyer of the Kichwa people of Sarayaku, addresses these questions by presenting his version of the history of resistance and mobilization of the indigenous people before the State plans to exploit the oil that was in the heart of the Amazon. From the jungle, through the national courts, to the inter-American human rights system, the author shows the different sources of political and legal mobilization used by the people. Based on the work of more than a decade that Melo has done with the descendants of the jaguar, the book combines anecdotal references with judicial decisions and social mobilizations to show the story behind one of the most important sentences of the Inter-American Court of Human Rights. Undoubtedly, the case of the Sarayaku people is a symbol for the other indigenous peoples of the Global South. Your experience, we hope, will serve as an example for all indigenous peoples who mobilize against the expansion of the extractive border over their territories.

62. What Drives Religious Politicking?

Abstract:
In the last decade, scholars have begun to elaborate the diverse ways religion manifests in democracies. We draw on theories related to modernization, secularism, and religious competition, as well as survey data from the Comparative National Elections Project, to explain individual-level and country-level variation in religious politicking—religious leaders’ and organizations’ engagement in electoral campaigns. At the country level, though human development depresses the rate at which citizens receive political messages from religious organizations and clergy, both secularism and religious pluralism boost it. At the individual level, “civilizational” differences across religious groups are muted and inconsistent. However, across the globe, citizens with higher levels of education are consistently more likely to receive political messages—an effect that is stronger where religious politicking is more common. A case study of Mozambique further confirms the insights obtained when we unpack modernization and secularization theories.

However, constant surveillance may have a negative impact on emerging state–society relations. The digital transformation provides developing economies new opportunities to leapfrog industrial age infrastructure, to draw on the vast knowledge spillovers from the internet, to take advantage of new markets offered by digital platforms and to exploit production possibilities enabled by digital technologies. It also increases the distance to the technological frontier as leading-edge countries race forward, creates new competitive challenges in capturing production mandates in tasks that can be automated and poses daunting new governance challenges. Developing countries can leverage the valuable data they generate, given their population size, rapid adoption of mobile technology and digital procurement potential, to improve the bargains they strike with advanced country suppliers and platforms and in trade negotiations.

Abstract:
Populism is a style of politics that attacks the existing normative consensus within society, making systematic use of marginalisation and bogeyman tactics. Typical marginalisation strategies target minorities within the population and adopt an anti-scientific world view. Restrictions on civil society are one of the consequences of government action dominated by populism. When it comes to mobilising voters, populists draw upon selected topics which differ according to political camp (left-wing versus right-wing populism) and national context. Nonetheless, it is possible to identify certain patterns of populist expression, such as the practice of contrasting the “people” and their supposed will with an allegedly out-of-touch political “elite”. The values of the population are largely set within the national context, while representatives of the elite are often portrayed as primarily interested in interactions outside of the nation state and thus perceived and characterised as proponents of globalisation. Populist trends can be seen in Western nations, former Eastern Bloc states and countries in the global South. Populist movements pose considerable threats to multilateral efforts aimed at tackling transnational political challenges.

The global movement of postsecondary students is a remarkably unidirectional phenomenon: students from the developing world, or Global South, take their knowledge and talents to the developed world, or the Global North. This is particularly true for countries such as India and China. Framed by the broader issues of access and equity within postsecondary education and released on the occasion of the fourth IC3 Conference in Mumbai, India, on August 28, 2019, the current report raises the following questions: Are the current global flows of students advantaging wealthier nations over developing ones? Are students from the developing world returning at higher rates to their countries of origin? How do we ensure that the mobility of students and talent is based on principles of access, equity and inclusiveness, both at the individual student level and at a national level? While it is not the goal of this report to suggest that the north-to-south flow of students should be reversed or that countries in the Global South would even have the capacity to host large volumes of international students, the report does argue that when it comes to international student recruitment policies, host countries in the Global North need to consider how to balance their own needs to fill critical knowledge and skill gaps by attracting global talent with the needs of developing countries to retain their valuable human capital. Thus, the report proposes solutions for programmatic and national-level initiatives to create a balance between the home and host countries of globally mobile students. This joint briefing from Oxfam, Christian Aid, ActionAid and the CBI reflects a growing convergence between businesses and tax advocacy groups on the use of tax incentives in the Global South. It argues that tax incentives can be a useful tool in promoting decent jobs and growth. But it also contends that too often tax incentives are used in inefficient and ineffective ways, and in the worst cases are entirely redundant. We hope that its message will be heard by policy makers around the world, and that it will contribute to better policy making that encourages responsible investment. Promoting domestic resource mobilization should mean that governments have more money to invest in essential public services to tackle poverty.

The chapters in this volume illustrate many complexities of transitional justice processes from the perspective of young human rights advocates involved in these struggles, many with their own complicated personal connections to the search for justice. These advocates hail from countries that have divergent relationships with the notion of transitional justice, from places deeply embedded in its norms and processes, such as Argentina and Colombia, to countries undergoing various kinds of transitions on very different terms, such as Turkey and Mexico. All of the chapters, however, write the messiness of seeking justice through transitions, spanning from the personal and intimate to the national and global. Together, these chapters beautifully illustrate both the pain and the political possibilities that come from the inability to leave history in the past, as well as the creativity of individual and collective efforts to seek justice through transitions.

Activists, particularly those based in the global South, have accumulated a wealth of experience in dealing with a range of transnational networks operating in diverse issue areas. New theoretical understandings have reflected this accumulating experience. As the twentieth century came to a close, the practice of global and transnational politics was undergoing a sea change. Understandings of its dynamics were changing along with the practice. Classic paradigms of international relations, which had focused almost exclusively on relations among nation-states, were being expanded to consider the impact of transnational civil society organizations. Recognition of the role of new nonstate actors in global politics was epitomized by the impact of Margaret Keck and Kathryn Sikkink’s Activists beyond Borders in 1998. Their framework is a foundational reference point for the analyses of recent and future trends that are set out in this book. This volume brings together a set of ten essays by reflective activists who draw on their experience to provide new insights into what has been happening in the world of transnational advocacy, and by engaged academics who are committed to using the tools of their disciplines to contribute to the same agenda. The essays reflect not only the views of individual authors but also the collective dialogue among the authors at the workshop where the papers were originally presented in the spring of 2015.

Abstract:
The purpose of this article is to offer some reflections on how to interpret the International Criminal Court (ICC)’ s fractious relationship with Africa in the context of the historical lineage of a dual structure of the global constitutional order and further scrutinize its implications for life cycles of the international norm. First, we begin by setting out the ICC process (norm emergence) led by middle power sand global civil society during the early post-Cold War period. We then scrutinize the limits of this new normative order by focusing on its dualistic nature, as well as the asymmetrical relation between the Global North and the Global South, in particular African countries. Finally, we reexamine the remaining injustice issue inherent in the liberal normative order by paying attention to structural problems such as the predatory capitalism behind the serious humanitarian crisis, which international judicial interventions seem to have superficially mask.
