Abstract:
More than half the world’s population is under 30, yet young people remain underrepresented in government and decision-making processes. There is a growing consensus among practitioners and scholars that politically and civically engaged youth are integral to a country’s economic and democratic health. As national governments, international donors, and local advocates increasingly recognize that youth participation is vital to stability and success, a variety of public measures, policy mechanisms and legal reforms aimed at promoting youth engagement have gained traction. roponents of these measures contend that pro-youth policies and reforms can increase youth participation and, ultimately, result in better policy outcomes across a range of issues. However, there has been relatively little empirical research on if, and under what conditions, these pro-youth measures improve the quantity or quality of youth participation and representation in political processes.

Abstract:
The connection between women’s economic participation and global prosperity is undeniable. Over the past two decades, international organizations and world leaders have increasingly recognized how critical women’s economic empowerment and financial inclusion are to economic prosperity and growth. Analyses from the International Monetary Fund (IMF), Organization for Economic Cooperation and Development, the World Bank, and other leading institutions demon- strate the growth potential of women’s increased economic partici- pation. UN frameworks such as the Sustainable Development Goals recognize the relationship between economic opportunity for women and development, and include time-bound targets—such as equal access to financial services, natural resources, and technology, and equality in property ownership and inheritance—to advance women’s economic participation. However, despite growing awareness that women’s economic empowerment is critical to women, their families, and broader eco- nomic prosperity, many countries still legally undermine women’s economic participation and undervalue women’s work. Of the 189 economies surveyed in the World Bank’s Women, Business and the Law 2018 report, 90 percent have at least one regulation that impedes wom- en’s economic opportunities. More than one hundred economies still prevent women from working in certain jobs; fifty-nine economies provide no legal recourse to women who experience sexual harassment in the workplace; and in eighteen countries, men can legally prevent their wives from working outside the home. An array of other legal barriers—from limitations on access to finance to laws restricting women’s agency and mobility—prevent women from fully participat- ing in the economy. Even in 2018, the legal landscape for women in the economy fails to reflect the value women’s participation adds to eco- nomic growth. But change is on the horizon. Over the last decade, several countries have enacted legal reforms that significantly advance women’s rights. Today, all but thirty-two countries legally guarantee gender equality in their constitutions, and a record number of countries now have laws prohibiting discrimina- tion or violence against women. While these gains—rightfully cel- ebrated—show that progress is possible, proposals to eliminate the critical barriers that limit women’s economic potential remain absent from mainstream discussions on international and national economic policy, and barriers to female economic enfranchisement persist in every region of the world. In order to realize the economic potential of 50 percent of the world’s population, nations need to do more to level the legal playing field for women. This volume collects in-depth analysis and commen- tary on legal barriers to women’s economic participation, with a focus on five areas in which the greatest obstacles to women’s economic par- ticipation endure: financial inclusion, identification laws, land rights, workplace discrimination, and family law. In the opening essay, I make the economic case for eliminating legal barriers that inhibit women’s economic participation. Closing gender gaps in the workplace could add an estimated $12 trillion to the global economy. Countries simply cannot afford to waste this economic poten- tial—and governments from Saudi Arabia to Japan are taking notice and enacting policies to promote women’s workforce participation. A web of discriminatory laws impedes women’s access to financial services and undermines their capacity to borrow, save, or obtain insur- ance. In an essay on financial inclusion, Council on Foreign Relations (CFR) Senior Fellow Jamille Bigio highlights how banks stand to ben- efit economically by ensuring women’s access to and use of financial services, by sharing the experience of a Nigerian woman who employed digital tools to save for her daughter’s school fees. CFR Senior Fellow Gayle Tzemach Lemmon, reporting on a successful financial inclusion program in Tanzania, explores how education can help women over- come legal and social barriers to opening bank accounts. The economic case for legal reform to promote women’s financial inclusion is strong: when women can use financial services without spousal consent and have control over where they live, and when unpaid work is recognized in marital property regimes, gender gaps in financial inclusion are nar- rowed. Legal reform needs to be a central component of any strategy to advance women’s access to and use of savings, credit, and insurance.

3. Strengthening Women’s Civic and Political Participation: A Synthesis of the Scholarly Literature

In 2016, USAID’s Center of Excellence on Democracy, Human Rights, and Governance launched its Learning Agenda—a set of research questions designed to address the issues that confront staff in USAID field offices working on the intersection of development and democracy, human rights, and governance. This literature review—produced by a team of WSU professors and graduate students representing the academic disciplines of communication, history, and political science—synthesizes scholarship from diverse research traditions on the following Learning Agenda question: What are the most effective ways to encourage women’s civic (e.g., volunteer, advocacy, etc.) and political (e.g., voting, running for office) participation? What are the risks to women of these strategies in contexts where resistance to changing gender norms is strong? The team identified four strategies for increasing women’s civic and political participation that are analyzed in academic scholarship: Using quotas to enhance women’s representation. Using social media platforms to mobilize women and amplify their voices. Targeting women as participants or beneficiaries of social programs. Mobilizing women through their intersecting identities. The team found that quotas are effective in increasing the number of women in elected office at the national and local levels and may also encourage women to participate in political and civic activity more generally. However, how quotas are designed and implemented greatly influences their success, and it is unclear whether more women in office leads to substantive changes to women’s agency within the legislature. In addition, although gender equity reforms implemented in the legislature can make such reforms more likely in other institutional settings, quotas are not common in other government branches. Social media is a double-edged sword: it provides a relatively inexpensive, accessible tool for women to participate in civic and political life and bring attention to issues that disproportionately affect women; however, it also creates a new space in which women are contested, harassed, and silenced. Social programs that target women also can be effective, but they almost always impose unanticipated costs, burdens, or risks on the women who participate, and so can depress women’s participation while seeking to increase it. These adverse effects have predictable patterns, and programs that target women as beneficiaries should take these patterns into consideration during the design phase. Mobilizing women through their intersecting identities—as mothers, workers, members of a religious group—is an underdeveloped area of the literature. Although several articles covered cases of this sort of mobilization, the results are ambivalent. In addition, although mobilizing women through certain frames—such as “motherhood”—can be effective, this strategy also reinforces traditional norms of gender roles.

4. Increasing the Civic and Political Participation of Women: Understanding the Risk of Strong Resistance

This literature review—produced by a team of UVA professors and graduate students representing the academic disciplines of anthropology, history, political science, religious studies, and sociology—synthesizes scholarship from diverse research traditions on the following Learning Agenda question: What are the most effective ways to encourage women’s civic (e.g., volunteer, advocacy, etc.) and political (e.g., voting, running for office) participation? What are the risks to women of these strategies in contexts where resistance to changing gender norms is strong? Building on an ODI report, “Women’s Voice and Leadership in Decision-Making: Assessing the Evidence” (2015) that identified seven strategies to support women’s civic and political representation, the UVA team focused on the second half of the research question, using a flexible systematic review process that included defining and operationalizing strong resistance. Overall, the team found that 1) research on resistance that aims to limit or end challenges to the status quo is under-theorized and in need of concept-building before researchers can make the analytical distinctions necessary to assess resistance fully and 2) where the literature does exist, it has an almost exclusive focus on female politicians. With these limitations in mind, key findings include: Resistance—which may include physical and sexual violence; social and familial censure; ostracization by the religious community; and various overt or subtle forms of restriction, deprivation, and exclusion—varies according to multiple factors, including by not limited to gender norms, the broader cultural context, regime type, local power structures, economic opportunities, and the form of participation sought. All women do not experience the same levels of risk, and are not vulnerable to the same types of resistance. For example, even within a single socio-cultural context, women who are marginalized (economically, racially, linguistically, religiously, or otherwise) are likely to bear greater burdens of risk. Strong resistance in response to the seven strategies identified in the ODI report is not pervasive but does occur, and that it can discourage women’s participation. Low to moderate resistance is ubiquitous, but generally has less deleterious effects. Sites where strong resistance occurs vary within countries and even among local areas within a single country, suggesting that a country-level analysis of gender norms is inadequate and ineffective for assessing and understanding women’s risk of strong resistance. The implications of these findings are that practitioner risk assessments should be: Routine and done prior to engaging in any intervention, and require information extending far beyond local gender norms. Focused on low to moderate forms of resistance in situations of backlash, and attentive to the possibility of strong resistance in situations of entrenched resistance. Designed for the specific site where the intervention occurs, while remaining attentive to national- and individual-level factors that shape resistance.

5. IFES Experts Contribute to American Bar Association Book on International Election Remedies

Abstract:
The right to an effective remedy is well established in international law, and stems from the fundamental rights of political participation and universal suffrage. It is the violation of these rights – intentional or otherwise – that necessitates a remedy to restore them. Election experts from the International Foundation for Electoral Systems (IFES) were invited to contribute four chapters to a publication of the American Bar Association’s (ABA) Standing Committee on Election Law, entitled International Election Remedies, published in November 2016. In “Measuring Effective Remedies for Fraud and Administrative Malpractice,” Senior Legal Specialist Katherine Ellena and Center for Applied Research and Learning Director Chad Vickery take on the difficult task of addressing what are effective remedies where fraud and malpractice affect the election. They emphasize the need for electoral remedies that protect the integrity of the process and electoral rights. In "Voter Registration," Michael Yard, a former chief of party in Kenya and Uganda, explains that registration of eligible voters is one of the most time-consuming activities undertaken by many electoral management bodies. To further explore this critical component of election administration, Yard explains the difference among passive, man¬datory and optional registration systems. IFES Indonesia Chief of Party David Ennis and former U.S. Elections Adviser Cameron Quinn describe in “Voting and Election Day” the balance between due process and the need for timeliness in addressing problems on Election Day.

6. Let the Sunshine In An Assessment of the Open Government Partnership

It is tempting to think that in a globalized, interconnected world, values such as democracy, human rights, and freedom would naturally converge. Instead, there is divergence, with some countries becoming more open and inclusive and others more closed. The past few years, especially, have seen the growing repression of civil society by authoritarian leaders. Repressive regimes block Internet activities; control online content; and use the Internet and mobile communications to track, target, harass, and prosecute activists. Shifts in geopolitical power toward governments such as China—those that embrace illiberal models and narrow space for civil society—have challenged the spread of norms such as openness and participation. Crackdowns in Russia, Hungary, Venezuela, and many other places show an alarming suppression of freedom of expression and a resurgence of authoritarianism. Yet in the midst of this seeming retrenchment, a promising initiative has shown that the global appetite for transparent, participatory, and accountable governments remains unsatiated.
