2. Integrating Human Rights into the Operational Readiness of UN Peacekeepers

The effectiveness of UN peace operations depends on the “operational readiness” of their personnel, which refers to the knowledge, expertise, training, equipment, and mindset needed to carry out mandated tasks. While the need to improve the operational readiness of peacekeepers has been increasingly recognized over the past few years, the concept of “human rights readiness”—the extent to which consideration of human rights is integrated into the generation, operational configuration, and evaluation of uniformed personnel—has received less attention. This policy paper analyzes opportunities and gaps in human rights readiness and explores ways to improve the human rights readiness of peacekeepers. A comprehensive human rights readiness framework would include mechanisms to integrate human rights considerations into the operational configuration and modus operandi of uniformed personnel before, during, and after their deployment. This paper starts the process of developing this framework by focusing on the steps required to prepare and deploy uniformed personnel. The paper concludes with concrete recommendations for how troop- and police-contributing countries can prioritize human rights in the force generation process and strengthen human rights training for uniformed peacekeepers. These actions would prepare units to uphold human rights standards and better integrate human rights considerations into their work while ensuring that they deliver on this commitment. Ultimately, improved human rights readiness is a key determinant of the performance of UN peacekeepers, as well as of the UN’s credibility and reputation.

This year the world will celebrate the 75th anniversary of the adoption of the Charter of the United Nations. But celebrations recognizing this historical landmark will occur at a time when the entire post-1945 structure of human rights, humanitarianism and multilateral diplomacy are under threat. Not since the UN was first formed have so many people been displaced by persecution, conflict and war. Not since the peak of the Cold War has the UN Security Council appeared so bitterly divided and incapable of decisive action. And as a new decade begins, there are renewed threats to international peace and security, and fresh assaults on human dignity.

4. Building a Multi-Directional Transnational Solidarity Movement

Transnational solidarity movements have typically flowed from a central point located in the West, particularly in the United States, to the East and the Global South. Shadi Mokhtari describes this phenomenon as the “traditional West-to-East flow of human rights mobilizations and discourses.” Viewed individually, this phenomenon is not problematic in all cases. However, as Mokhtari argues, this one-directional flow of human rights politics precludes non-Western non-governmental organizations (NGOs) from weighing in on human rights violations committed in the United States. Human rights violations in the United States are typically experienced by marginalized communities, from the mass incarceration and disenfranchisement of African-Americans to the detention and ill-treatment of immigrants, migrants, and refugees. For a truly global human rights movement to emerge—one that is not grounded in Western paternalism and perceived moral superiority—this must change.

5. Addressing Data Gaps on Child, Early, and Forced Marriage in Humanitarian Settings

Abstract:
The United Nations and its partner agencies have pledged to focus on the problem and eradication of early, child, and forced marriage. On November 12, 2018, the United Nations General Assembly passed a resolution on child, early, and forced marriage. As part of this resolution, the General Assembly highlighted the need for better data collection and disaggregation of that data for improved analysis and learning. This report is a comprehensive and user-friendly concept note for a database on child marriage in humanitarian settings, a first step in eradicating the problem. The report identifies the existing knowledge and data on child marriage in humanitarian settings, gaps in that evidence base, and provides recommendations for moving forward with the creation of a comprehensive database. The authors interviewed key stakeholders on child marriage across program, policy, and academia in combination with a comprehensive literature review. The report was commissioned and funded by Save the Children U.S.

6. Justice for All and the Public Health Emergency

The COVID-19 pandemic is an unprecedented global emergency. It is not only a health crisis but also a human rights crisis. Justice actors face daunting responsibilities as they design, implement, and enforce new measures to prevent the spread of infection. Measures that heighten the risk of human rights abuses can undermine trust, at a time when the justice system most needs to maintain the public’s confidence. For better or for worse, justice systems and justice workers are on the frontline of this pandemic. This Pathfinders briefing, drafted by lead authors David Steven, Maaike de Langen, Sam Muller, and Mark Weston with the input of more than 50 justice experts from around the globe, discusses the most pressing priorities that the public health emergency poses for justice leaders and proposes seven areas for urgent action as the tide of infections continues to rise. It is the first in the Justice in a Pandemic series.

7. Adopting a Sustaining Peace Lens to the COVID-19 Response

COVID-19 is creating a series of crises that increase the risk of conflict worldwide. Beyond the health impact, issues like worsening inequality, food insecurity, human rights abuses, and political tensions can deepen pre-existing social fractures in any country, creating additional layers of grievance. Addressing these risks early on and building resilience to them is key to preventing the potential for violence. But the pandemic also brings new opportunities for peacebuilding. A system-wide implementation of the sustaining peace approach is critical to ensure that United Nations response contributes to decreasing risks for violent conflict in the longer term—including efforts to “build back better.” This report draws on interviews with 25+ individuals across the UN system and member states to highlight some of the key challenges for peacebuilding in the immediate COVID-19 period as well as in the longer term. The report documents how entities across the UN have made positive steps toward implementing a sustaining peace approach, and provides recommendations for deepening these gains across the system.

8. Business, Armed Conflict, and Protection of the Environment: What Avenues for Corporate Accountability?

Abstract:
In July 2019, the International Law Commission (ILC) provisionally adopted, on first reading, a series of draft principles on the protection of the environment in relation to armed conflict (the Draft Principles). The role of businesses in armed conflict is addressed in Draft Principle 10 and Draft Principle 11. The latter, in particular, requires States to implement appropriate measures to ensure that corporations operating in or from their territories can be held accountable for environmental harm in the context of armed conflict. The inclusion of those two Draft Principles reflects increasingly vocal calls for corporate accountability, which has been the focus of the growing field of Business and Human Rights (BHR), an umbrella term encompassing a variety of legal regimes from tort law to criminal law. This contribution will look at the link between businesses, the environment, and armed conflict. Using the newly adopted Draft Principle 11 as a starting point, it explores three major liability regimes through which businesses could be held accountable for damage to the environment in armed conflict: State responsibility, international criminal law, and transnational tort litigation. Using case studies, the article discusses some of the challenges associated with each of those regimes, before concluding that the cross-fertilization phenomenon observed in this article (between public/private law, domestic/international level, and across various jurisdictions) is making BHR an increasingly salient discipline and useful tool in the fight against impunity for corporate environmental harm in armed conflict.

Environmental protection is not specifically included in treaty law relating to State obligations during situations of occupation. While clearly not of the same scale as damage caused to the environment during armed conflict, damage caused during occupation is often similar in nature – largely due to those who seek to exploit any governance vacuum and a failure to restore damaged environments. What can human rights offer in helping to protect the environment during occupations? What protection can be offered by an analysis of environmental human rights law?

10. A Comprehensive Framework for Studying Migration Policies (and a Call to Observe Them beyond Immigration to the West)

Abstract:
This piece is both an exercise in critical conceptual landscaping in the field of Migration Studies and the proposal of an analytical framework that can correct some of its most serious biases. The framework I propose allows the observing of migration policies as if they constituted a comprehensive policy field. This will permit comparisons across the whole spectrum of migration policies on a rigorous basis, and for all countries and regions. I identify two constitutive sides to the proposed framework, each dealing with how state‐like polities regulate the mobility of incoming or outgoing persons. I further suggest that it include regulations on the rights of individuals to pass through three stages of any international migration journey: the right to enter/exit; the rights as immigrant residents/emigrant non‐residents; and, the rights to citizenship and nationality. This comprehensive framework for studying migration policy promises advances for empirical agendas, but also for connecting them to normative ones rooted in global justice and democratic concerns.
