Abstract:
The effects of authoritarianism are amplified and obfuscated by growing economic interconnectivity. Combating authoritarianism and addressing the dark networks that support its consolidation are the unavoidable strategic challenges to global security. The authoritarian-corruption nexus is the growing convergence of licit and illicit state and non-state actors that facilitates and launders the profits of illegal activity, reinforcing the strength and survival of authoritarian systems of governance everywhere. It depends on and resides in the complex and rapidly changing global economic currents flowing in and out of American markets and is the defining threat to freedom in the 21st century. Domestic and international efforts are needed to dismantle the authoritarian-corruption nexus, including addressing the (ab)use of anonymous shell corporations and reestablishing the Group of Seven.

Democratic governments are under siege around the world from forces that threaten the basic principles of representative government—freely elected leaders, democratic institutions, and the rule of law. In countries as diverse as Azerbaijan, Cambodia, and Egypt, authoritarian leaders have “snuffed out civil society, suborned or faked elections, asphyxiated free expression, and repressed human rights.” Populist regimes are consolidating power in Europe and Latin America where citizens have lost faith in political institutions and rejected conventional leaders. Centralized authoritarian governments in Russia and China have put forward an alternative autocratic governance model and are striving for world leadership. Meanwhile, democracy in the United States has taken a dangerous turn.

Abstract:
Corruption is recognised as a major stumbling block to development and is associated with injustice and abuse of power. The consensus on the detrimental effects of corruption stands in contrast with the lack of agreement on the set of phenomena that fall under the heading ‘corruption’ and there is little discussion on whether the economics of corruption should also include corruption in the private sector. This question is relevant since different foci will have different theoretical bases and policy ramifications. We analyse the issue from two complementary perspectives: whether the impacts of corruption are limited to corruption in the public sector and whether a large public sector is associated with more corruption. First, we review theoretical and empirical perspectives on corruption, showing how concern over corruption in the private sector has a long history, dating back to Marshall and Coase. Second, we analyse corruption’s determinants using a panel data approach. The econometric analysis demonstrates how our indicator of government involvement in the economy is a poor predictor of corruption prevalence. Finally, the paper highlights the policy implications of the one-sided focus on corruption in the public sector and proposes an explicit acknowledgment of the role of corruption in the private sector.

Abstract:
The space for people to speak out, organize and take action against poverty, inequality and injustice is shrinking on a global scale. People in many countries around the world face serious restrictions and repression when exercising their basic rights. This includes citizens who raise their voices against corruption and political dysfunction, organizations that save lives and provide basic services to people in need, communities that defend their sustainable livelihoods and demand a fair share of natural resources, and activists who fight for gender justice. This paper outlines the analysis and strategic focus which inform Oxfam’s contribution to the global defence of civic space and sets out four key changes that we believe are necessary to reclaim and create it. It also gives some key principles and an open invitation to every civil society organization, donor, government, business and individual who subscribes to these same principles to join our common struggle to protect, defend and expand civic space.

Brazilian anticorruption law and institutions were significantly transformed in recent decades. This article traces those transformations and explains how the international anticorruption and money laundering regimes contributed to their development. It argues that those international regimes were internalised in the Brazilian system through three mechanisms: inspiration and legitimation, coercion, and implementation support, and were critical to the transformation of Brazilian institutions.

Abstract:
This paper deals with the conceptual framework of so-called ‘modern authori- tarianism’, allegedly a form of government typical of non-democratic regimes at the begin- ning of the twenty-first century. The paper is based on the approach of Tyler Roylance, who divided the sources of legitimacy employed by modern authoritarian regimes into five spheres: the economy, the media, political competition, civil society and the rule of law. Following the arguments presented by various authors in their efforts to conceptualise different examples of modern authoritarianism, the paper aims to contrast this debate with the classical approaches to the research of non-democratic regimes.

Abstract:
A growing body of analysis has explored how kleptocrats systematically capture and loot their domestic state institutions, but scholars and policy makers have paid less attention to how globalization enables grand corruption, as well as the laundering of kleptocrats’ finances and reputations. Shell companies and new forms of international investment, such as luxury real-estate purchases, serve to launder the ill-gotten gains of kleptocrats and disimbed them from their country of origin. Critically, this normalization of “everyday kleptocracy” depends heavily on transnational professional intermediaries: Western public-relations agents, lobbyists and lawyers help to recast kleptocrats as internationally respected businesspeople and philanthropic cosmopolitans. The resulting web of relationships makes up a “transnational uncivil society,” which bends global-governance institutions to work in its favor.

48. Abuse of State Resources Research and Assessment Framework

Abstract:
The International Foundation for Electoral Systems (IFES) recently concluded a two-year Technical Leadership project examining the abuse of state resources (ASR) in election campaigns. This research initiative, led by the Center for Applied Research and Learning and funded by the United States Agency for International Development under the Global Elections and Political Transitions mechanism, focused on ASR (sometimes referred to as administrative resources) for the purpose of gaining an electoral advantage. The Abuse of State Resources Research and Assessment Framework: Guidelines for the Democracy and Governance Community of Practice is an abbreviated companion document to the complete Abuse of State Resources Research and Assessment Framework developed in this effort. Both documents are based on in-depth, comparative analysis of laws and regulations that target ASR in election campaigns and the effectiveness of these provisions in deterring or remedying these abuses. In many countries, uses of state resources during electoral periods are not sufficiently regulated and enforcement of violations is weak or nonexistent due to deficits of political will or limited capacity of oversight institutions. As highlighted in an IFES publication, individuals and parties in power may capitalize on these gaps to marshal public goods – including state personnel, state funds and physical assets, and official government communications – in service of political campaigns. Beyond undermining electoral competitiveness, another often-overlooked component of this abuse of power is the role elections play in cycles of entrenched corruption. Not only do abuses during the campaign period undermine competitiveness by conferring an unfair electoral advantage, they threaten the appropriate distribution of government services and do long-term damage to the legitimacy of governance institutions. This is because abuses do not stop after parties use the assistance of the state apparatus to win elections; corrupt politicians subsequently use their access to levers of the state to enrich themselves and distribute perks to supporters. The cycle of government personnel, media, and other resources being used in service of political campaigns is then likely to continue. This ASR assessment tool focuses on legal and regulatory provisions specific to ASR, but it also delves into some other common areas of abuse (for example, government procurement and contracting, public works spending around elections, campaign finance, and vote buying). These guidelines were designed for use by international and domestic civil society actors, implementers, and advocates to evaluate the effectiveness of the ASR legal framework in a given country and develop additional tools for monitoring and advocacy. This shorter version of the tool will help these groups identify priority issues and vulnerabilities that they can use in developing their strategy for monitoring, addressing, and/or advocating for measures to mitigate ASR. Findings could also point to specific recommendations for improving transparency and enforcement surrounding ASR, including enhanced training programs, strengthened regulatory provisions, investments in investigative journalism, and increased transparency in public procurement.

49. The evolution of the EU law against criminal finance: the "hardening" of FATF standards within the EU

This article examines the recent evolution of the EU anti-money-laundering (AML) and counter-terrorist financing (CTF) legislative framework, focusing on the relationship between the main international standards in the field and the newest EU legislation. It suggests that international soft law norms—in particular, the Financial Action Task Force (FATF) Recommendations—have had a decisive influence on the latest development of legislation at the EU level and within its member states. It further argues that mainly the preventive component of the AML/CTF legislation will be strengthened by the EU instruments adopted in mid-2015. However, this Article concludes that the adoption of global soft standards has posed significant challenges to the EU legislative framework. The arguments are developed in four parts. The Article first highlights the main regulatory prescriptions that stem from the study of the phenomenology and the economics of AML/CTF regulation and underpin the current international regulatory paradigm. Second, it explores the evolution of the main international instruments in the field with a special focus on the role played by the FATF Recommendations. It also illustrates the relation between these instruments and the adoption of the new EU AML/CTF legislation from two different, but complementary, angles: (1) noting that the current international AML/CTF framework has a multidisciplinary approach, the Article focuses on the framework's repressive component and assessing the limits of the EU criminal approach against money laundering and terrorist financing; and (2) examining the recent EU preventive legislation and addressing the main challenges posed to the EU legislative framework when attempting to accommodate global standards, especially regarding tensions with fundamental freedoms and human rights protected within the EU.

For democracies to flourish and succeed, voters need accurate information on which to base their decisions; to weigh up the relative merits of proposed policy A over proposed policy B, to judge whether this candidate is more trustworthy or reliable than that one, or that these promises are more likely to be kept than those. But recent elections, most notably that of Donald Trump as US President, have highlighted the dangers to this process posed by those using social media and the internet to spread malevolent propaganda and fake news.
