631. OECD Health at a Glance - How France Compares

Abstract:
In many respects, France fares well among OECD countries in terms of indicators of the health status of its population and resources allocated to its health care system. The French population (and particularly French women) enjoys a relatively high life expectancy compared with the average across OECD countries. The French have a free choice of doctor, and can approach relatively easily both generalists and specialists. Also, the French health system has not generally experienced the problems of long waiting lists for certain treatments, as has been the case in several other OECD countries. The health care system in France is predominantly funded through public sources, but with services delivered by both the public and private sector. Universal access is provided to doctors and hospital services, with some co-payments for patients which vary depending on the type of services. Since the introduction of the Universal Health Coverage Law (Loi de la Couverture médicale universelle or CMU) in 2000, people with low income who are not covered by complementary insurance have access to doctors and hospitals free of charge. Overall, public satisfaction with the health care system in France has traditionally been much higher than in most other countries. However, health spending in France is relatively high in comparison with the OECD average.

Abstract:
After several years of rapid expansion, the French economy has entered into a period of below potential growth, with a negative output gap opening up. Monetary conditions have been relaxed, while fiscal policy has eased excessively, provoking the European Commission to initiate an excessive deficit procedure. As uncertainty dissipates towards the middle of this year, the economy should pick up speed, reaching a growth rhythm of around 2 per cent in 2004. Nevertheless, over the medium term, in the absence of substantial reforms the ageing of the population risks threatening economic and fiscal equilibrium. Current pension and healthcare reform initiatives and plans to redress spending over the medium term go in the right direction. However, in order to ensure medium and long-term fiscal sustainability, additional policies to slow the expansion of health and pension spending are required, while efforts to raise employment rates and potential output are needed to improve the economy's ability to finance future ageing-related expenditure. Here, programmes that offer the possibility of on-the-job training should be expanded so as to reactivate young and lowskilled workers, while reforms to early-retirement schemes and the pension system need to be continued so as to restore work incentives for older workers. Ongoing tax and labour market reforms and policies to facilitate the development of high-tech and fast growing enterprises, which should help promote investment and higher productivity growth, also need to be pursued. The opening of the capital of stateowned enterprises and their eventual privatisation, and planned improvements to governance structures should help promote growth, but revenues from sell-offs ought to be used to reduce debt. Finally, in order to better manage the totality of public expenditures, the authorities need to implement reforms that can be used to ensure that all spending organisms contribute to controlling spending. Here, it will be necessary to implement mechanisms that would improve the effectiveness of measures to control healthcare spending. Moreover, decision-makers need to be more directly confronted with the long-term consequences of their actions. Initiatives such as decentralisation and the new budget framework law should help in this regard. Pursuit of reforms along all of these lines should permit society to meet the fiscal challenge posed by population ageing, while retaining high levels of service.

633. Disenchanted Conscription: A Military Recruitment System in Need of Justification

Abstract:
The Economist's point of view is a widely shared one. It also seems warranted by current trends in policy-making in developed democracies. The US, the UK, the Netherlands, Belgium, Italy, Spain, and Portugal have abolished or are phasing out conscription. Even France, mother of citizens armies through the revolutionary levée en masse, just saw (literally as the event was broadcasted as a main feature of the evening television news) its last conscript leave the armed forces. The Nordic countries and Germany have not abolished conscription, but conscripts make up a shrinking share of the armed forces, which governments plan to shrink even further. For many observers this confirms that they simply lag behind. They will soon be brought to reason and abolish conscription. But this is a simplistic understanding of what determines the fate of conscription.

634. Do Judicial Councils Further Judicial Reform? Lessons from Latin America

Abstract:
JUDICIAL REFORM EFFORTS IN LATIN AMERICA, and by extension worldwide, seem to fall easily prey to magic bullets. In the past two decades, reformers in the region and aid providers from North America and Western Europe have seized upon a whole series of entry points for judicial reform—including model codes, accusatory criminal justice systems, court administration reforms, information technology, alternative dispute resolution, legal services, and constitutional courts. Sometime during the late 1980s, as the issue of judicial independence came to receive more serious attention, judicial councils joined the list, and nearly a dozen countries adopted them. It was not until the late 1990s that questions about their utility began to emerge. Although Latin America is beginning to reexamine its love affair with the councils, the model has been gaining ground in other regions. Western Europeans, who invented the mechanism, have been suffering their own doubts. This has not prevented their joining with U.S. reformers in recommending it to postcommunist nations in Eastern Europe and the former Soviet Union and in Africa, Asia, and the Middle East. The cautionary lessons from Latin America's several-decade experiment with judicial councils have not yet been analyzed and disseminated. This essay is a start in that direction.

635. National Role Conceptions and Foreign Policies:France and Germany Compared

Abstract:
In spite of domestic and international political changes, French and German foreign policies have displayed high degrees of continuity between the late 1950s and the mid-1990s. Over the same time period, the directions of the two states' foreign policies have also continued to differ from each other. Why do states similar in many respects often part ways in what they want and do? This article argues that the French and German national role conceptions (NRCs) account for both of these continuities. NRCs are domestically shared understandings regarding the proper role and purpose of one's own state as a social collectivity in the international arena. As internal reference systems, they affect national interests and foreign policies. This article reestablishes the NRC concept, empirically codes it for France and Germany for the time period under consideration, and demonstrates comparatively how different NRCs lead to varying interests and policies across the major policy areas in security, defense, and armament.

Abstract:
The paper is an attempt to assess continental welfare state reforms that use the window of the end-of-career inactivity trap. The question addressed is: what is the most effective way to break up the vicious circle of early exit from the labor market, which is a specific pathology of continental welfare states. The cases of the Netherlands and Finland, two countries that have succeeded in reversing the early exit trend in recent years, prove that only a radical change in paradigms that govern social protection may turn the vicious circle of welfare without work for aging workers into a virtuous circle of active aging. In states in which reforms have focused on changing the rules and regulations that govern retirement systems, or on restricting early exit pathways, as is the case in France, they have failed to break up with the end-of-career inactivity trap.

637. Historians as political trouble-shooters: Officially Commissioned Surveys of Holocaust Legacies in France and Switzerland

Abstract:
In the 1990s, revelations, disclosures of archival documents, and class-action suits shed light on legacies of the Holocaust that had been neglected during the Cold War era. Since 1996 most European countries, the U.S. and many private businesses have appointed commissions of historians and other experts to investigate the still unresolved questions of property restitution and compensation payments. Such surveys caused controversies about the necessity and the meaning of a reevaluation of the memory of the Naziera in most countries. The authors of this paper both have worked as staff historians for such commissions, in France and Switzerland respectively. Based on their experience, they reflect upon the impact of officially appointed investigations on images of the past and their significance for the current political situation of the two countries.

638. French Democracy Without Borders

Abstract:
There are intense debates in France today over globalization and its impact on democratic values and practice. The arguments retrace in many respects a much older inquiry into the compatibility of democracy and capitalism. The history of the past two hundred years suggests that despite the inequities that capitalist economies generate, the majority of the electorate has not been willing to vote out the system. Capitalism was protected, in part, by the fact that these systems were never wholly democratic, but provided constitutional protections for property. And democracy was preserved, in part, by the fact that these systems were never wholly capitalist, but in fact within national borders found a variety of solutions for blunting the impact of market forces. If globalization means a world without national borders, one may question whether this co-existence of capitalism and democracy can continue, and in fact, much of the French debate focuses on this point. This article retraces the history of the borders of France and suggests that borders are political, not geographic, constructions and as such, are far from disappearing even between the US and Canada, even within the European Union. As long as states can still regulate economic exchanges in ways that differentiate their societies from adjacent countries, borders persist. Globalization does create serious new challenges, but the stark dilemma of choosing either a world of economic openness or a world of liberal democracy does not capture the real stake and choices available to France and other democratic societies.

Abstract:
This article compares the regulation of asbestos, the regulatory impact of the health crisis associated with AIDS and the regulation of genetically modified agricultural products in the United States and France. These cases trace the evolution of health, safety and environmental politics and polices in the two countries over the last three decades. In general, risk management policies have become more politicized and risk averse in the United States while they have become more politicized and risk averse in France. In many respects, regulatory politics and policies in France during the 1990s resemble those of the US during the 1960s and 70s.

Abstract:
A few months ago, the massacre of Algerian civilians by the French police on October 17, 1961 was finally officially recognized, as the new socialist mayor of Paris, Bertrand Delanoë, placed a commemorative plaque on the Pont Saint-Michel. In his declaration to the press, Delanoë was careful to focus on the "Parisian" character of this ceremony, although the 1961 massacre was committed by the French national police. Perhaps Delanoë's noble and courageous gesture hides an ambiguity, an injustice to the victims? In order to understand the symbolic importance of this plaque in the construction of France's official memory of the Algerian war, this essay analyzes how the French government since 1962 has attempted to "forget" the conflict in the name of "national unity," in particular through the use of amnesty laws. In a discussion on forgiveness inspired by J. Derrida, the possibility of a French national memory of the Algerian war (and of the October 17, 1961 event) that would include the voices of the victims is considered.
