Abstract:
On 22 January 2019, Emmanuel Macron and Angela Merkel signed a new treaty on “Franco-German cooperation and integration” in Aachen. Complementing the 1963 Elysée Treaty which symbolized the reconciliation between Germany and France in the post-war period, the Aachen Treaty aims to further strengthen the ties between the two countries in the domains of economy, culture, administration, environment, diplomacy and defence. Although the Treaty has been criticised for its lack of ambition, a closer reading of its text reveals some hidden gems, including its mutual defence clause. What does this new clause mean for the Franco-German tandem and for collective defence in Europe?

112. Europe in a multipolar missile world – Why the EU and NATO should not try to salvage the INF Treaty

Abstract:
On 1 February 2019, the US Secretary of State Mike Pompeo announced that his country had suspended its compliance with the Intermediate-range Nuclear Forces Treaty, or INF Treaty, and would withdraw from it within six months. The INF Treaty, little known outside of arms control and disarmament circles, was a landmark Cold War agreement between the United States of America and the USSR – the first to ban an entire category of weapons (ground-based medium- and intermediate-range missiles). The US withdrawal, announced in dramatic terms by President Donald Trump in October 2018, followed the claim that Russia had recently developed and fielded a missile with performances forbidden by the INF Treaty. The end of this little-known treaty is not anecdotal. Not only will it further strain the US-Russia relationship and antagonise allies, it will also contribute to the erosion of what is left of the global arms-control architecture and incentivise arms-race behav- iours among great powers. In a world where security is increasingly less a question of multilateral deliberation and rules-based interactions, the end of the INF Treaty is a further signal that missile technologies are again becoming a venue for competition between great powers: only this time, at least three are playing the game (United States, China and Russia) rather than two (United States and USSR). Additionally, missile technology proliferation has turned into a major dimension of contemporary battlefield realities, and missile programmes of countries such as Iran and North Korea continue to pose important diplomatic and non-proliferation challenges. Meanwhile, Europe is, by and large, left watching as its regional security architecture erodes. Welcome to what US National Security Advisor John Bolton recently termed ‘a multipolar missile world’. The EU should not try to salvage the INF Treaty. Its diplomatic capital might be better spent in areas where it could potentially make a difference, rather than in a treaty to which it is not even party. Existing multilateral regimes and agreements with the EU or its Member States as parties are already in dire need of reinforcement in the face of technological progress, a volatile diplomatic environment and self-centred, competitive political narratives. These include, inter alia, the Organization for Security and Co-operation in Europe (OSCE) framework (including its Structured Dialogue), multilateral export control regimes (MECR) like the Missile Technology Control Regime (MTCR), transparency and trust-building mechanisms like the Hague Code of Conduct against missile proliferation (HCoC), and nuclear-related frame- works like the Joint Comprehensive Plan of Action (JCPOA or ‘Iran deal’) or the Non- Proliferation Treaty (NPT) Review Process. These, however, may simply fail to meet the challenge of a multipolar missile world. Renewed efforts, both conceptual and in the realm of capabilities, are needed in a NATO framework to reinforce the linkage between deterrence and diplomacy. NATO-EU dialogue and cooperation on defence issues could be further enhanced, and European countries should work more with like-minded partners at both bilat- eral or multilateral levels on the challenges of non-proliferation and disarmament in the twenty-first century. The demise of the INF Treaty should therefore re-energise the debate on European strategic autonomy, help support collective capability building – not least in NATO – and prompt new discussions on stronger multilateral rules on missile development, use and proliferation.

Abstract:
In 2014, the European Parliament staged a small 'coup' when it imposed the EPP "Spitzenkandidat" Jean-Claude Juncker as the new Commission President, on the basis of a rather innovative reading of the Treaty. In 2019, the attempt at renewing this operation failed, because of some of the inherent flaws in the concept, and because the conditions were no longer the same. The European Council was quick to reclaim its prerogatives as set out in the Treaty. This may however not be the last word and a revised version of the Spitzenkandidaten could possibly emerge from the upcoming conference on the future of the EU. But any such move towards a more federal Europe requires an informed and transparent debate and cannot be introduced via the back-door.

Abstract:
The need for the European Union’s involvement in the Western Balkans, Georgia, Moldova, and Ukraine has never been more acute. The European Commission’s structures are not up to the job. A new approach is needed to respond to the realities on the ground and in member states. The European Union needs to boost the tools of the European Commission to move the process on from enlargement and move decisively towards the unification of Europe. This means creating a directorate general that would have the resources to drive forward the accession process with the Western Balkans countries and the ambitious trade and reform agenda in Ukraine, Georgia, and Moldova. A new directorate general Europe could play this role.

Abstract:
Will the U.S. unilateral withdrawal from the American-Soviet INF Treaty of 1987 become a possible reality? The Treaty prohibits ground-launched shorter and the middle-range missiles (500–5,500 kms) with nuclear or conventional warheads. The Treaty´s security significance and its main parameters, the legal framework of the withdrawal and the reasons of both parties for accusing each other of violating the Treaty, are discussed in the article as well. In its conclusion, the article, among other things, explains the context of the possible termination of the Treaty, and its consequences for the U.S.-Russia arms-control architecture. The dispute over auto trade between the United States and the European Union is becoming more heated and uncertain. US President Donald Trump has threatened to slap additional tariffs of 25 percent on autos imported from the EU if the bloc doesn't agree to a trade agreement favorable to the US. Although Dutch Prime Minister Mark Rutte told CNBC on Monday that there's a lot happening behind the scenes to ensure the US and the EU reach a trade deal, Bloomberg, citing a senior EU official, reported on Friday that the EU is ready to target Caterpillar and Xerox if Trump hits cars.

Abstract:
This is the second Clingendael Policy Brief on climate policy development in the Netherlands. The first 'Are the Dutch going Green' was published in January 2019 and dealt with the political context and policy proposals made between autumn 2017 and the end of 2018. This policy brief focuses on the most recent developments until mid-September 2019. During this period the Dutch Parliament adopted a Climate Bill, provincial elections were won by a climate-sceptical party, and political agreement was reached on a comprehensive package of climate policies: the national Climate Agreement. This agreement, referred to as the ‘biggest refurbishment of the Netherlands since the Second World War’, was pre-cooked in an extensive negotiating process between government and civil society. The policies target especially the industrial, energy, transportation, housing and agriculture sectors. A key element of the societal debate focused on the costs of climate policies and how they should be allocated. In order to hammer out a political deal, the Dutch government had to change key assumptions of its constituting coalition agreement of 2017, and adjust some of the proposals developed by civil society, notably those favoured by industry. A lesson learned from the Dutch case is that setting ambitions may be relatively easy, but translating them into effective climate action is a tougher job, particularly when political decisions have to be taken on who will pay for what.

The EU needs more and better capabilities in civilian crisis management to fulfill its level of ambition and to more effectively contribute to security and peace in its wider neighborhood. In this, the Civilian CSDP Compact plays an important role. It has introduced an annual review process to take stock of implementation and identify ­capability shortfalls. This review process has great potential to improve the way the EU and its member states plan and develop capabilities for missions.

The Eastern Partnership’s tenth-anniversary celebration in May 2019 by the European Union and its Eastern neighbors was anything but grandiose and festive. Internal EU developments, the overall political dynamics in the region and the indeterminacies of the Eastern Partnership project were the main cause. As the EU’s flagship policy initiative towards its Eastern European neighborhood is currently undergoing auditing and revision, this article seeks to cast a look back at how the Eastern Partnership has functioned over the past decade – and to think forward to its future(s) with regard to design and deliverables in face of the enduring and imminent policy dilemmas in this highly contested region.

Abstract:
Since 2009, the main mechanism of Eurointegration in Ukraine, in addition to the bilateral diplomatic efforts and internally driven pro-European reforms, has been the Eastern Partnership (EaP), a multilateral project has that brought Kyiv both new opportunities and additional challenges and uncertainty. Although the positives outcomes have generally been welcomed, these have not detracted from the commonly held view among experts that despite good outcomes in stimulating economic reform, support for the new government and citizen institutions, and a tangible contribution to stability on the EU borders, the current strategy alone will not secure the stable development of the democracy and market economy in Eastern Europe generally, and Ukraine in particular. The commitment of these countries to general European principles has to be supported by the prospect of EU membership and that means revisiting the current format and especially the philosophy behind the Eastern Partnership. One possible scenario could be the formation of EaP+3 within the European Partnership, which would bring together Ukraine, Georgia and Moldova – the countries with Association Agreements with the EU – and a commitment to EU membership.
