Abstract:
This briefing paper summarizes the important lessons learned since 2018 by Oxfam Denmark and the wider Oxfam confederation while promoting the women, peace and security (WPS) agenda and supporting WPS programming in Burkina Faso, Colombia, Ghana, Kenya, Lebanon, Mali, Niger, the Occupied Palestinian Territory, South Sudan, Syria, Uganda, Ukraine and Yemen, including under the Danish International Development Agency (Danida) strategic partnerships. It contains practical and policy-level recommendations for international actors working on the WPS agenda in various crisis and conflict contexts globally. The briefing paper shows that supporting and amplifying locally led feminist action by diverse women-led, women’s and LGBTQIA+ rights organizations, networks and groups is a central foundation for peace and justice.

Abstract:
The slow pace of decarbonisation of buildings and transportation threatens the European Union’s goal of reducing emissions by 55 percent by 2030 and achieving net zero by 2050. To address this, a new emissions trading system, ETS2, is being introduced to put a carbon price on fuels used in buildings and road transport. However, the resulting cost increases risk a disproportionate impact on vulnerable households and small and medium sized enterprises. The European Union has created the Social Climate Fund (SCF) to address these distributional challenges. This instrument redistributes a portion of auction revenues generated by the ETS2 among EU countries, in order to protect the most vulnerable. A much larger share of ETS2 revenues will flow directly to national governments, offering significant opportunities for social measures and investments in the green transition. The use of those revenues will dictate how successful EU countries are in managing the transition and protecting households, particularly in higher-income member states, which will receive relatively smaller shares of SCF funding. ETS2 is an essential part of the EU climate policy toolkit. Governments should employ good practices, as identified by the European Commission, to tackle emissions from buildings and transport and to gradually phase out income support, in line with the achievement of investment targets and milestones. Higher-income EU countries should develop additional targeted financing levers to protect the vulnerable and to introduce extra enablers to encourage private investment. Proper sequencing, outreach and communication will be essential to ensure the uptake of measures and public support for policy instruments. Cross-country learning should be leveraged, including through the creation of a European policy registry that will help countries compare their approaches and potentially amend their SCF spending plans on the basis of learning from policies that been successful elsewhere.

The report also notes a correlation with the rise of right-wing factions, indicating a concerning trend towards discriminatory beliefs in society. It is concluded that urgent scholarly and policy interventions are necessary to address these challenges. This emphasises the need for comprehensive interfaith dialogues and educational initiatives to mitigate emerging threats and uphold the values of religious freedom and social cohesion in contemporary European societies.

4. Strengthening Protection Mechanisms of Gender Based Violence in Kosovo

Femicide and insufficiently addressed gender-based violence represent major security concerns in Kosovo, yet they have not been adequately prioritized as immediate issues by the full spectrum of state mechanisms. Activists in Kosovo have consistently demanded that gender-based violence be declared and treated a national emergency, a plea that state institutions have not taken into consideration. Within just five days in April 2024, two women in Kosovo were victims of femicide, murdered by their partners. Gender-based violence and femicide pose significant security threats to women. From January to March 2024, 698 cases of gender-based violence were reported to the police, compared to 2,638 cases reported throughout 2023. Despite the high number of reported cases, many cases remain unreported due to the complex socio-economic challenges’ women face across different regions of Kosovo. There are several reasons highlighting the inadequacies in addressing the prevention of gender-based violence. Recent research conducted by the Kosovo Centre for Security Studies elaborates on several problems concerning gender-based violence in Kosovo. There are some of them: Women’s trust in security and justice institutions is critical for reporting gender-based violence. However, the leniency of the judicial system towards perpetrators and the prolonged duration of domestic violence cases discourage women from seeking justice. There is a lack of sensitivity and expertise among law enforcement authorities, especially in rural areas, to handle genderbased violence cases effectively. The absence of property ownership among women is a significant barrier to their economic independence and security. Despite legal provisions for equal property rights, women often relinquish their inheritance, leaving them with limited resources and options when facing violence. This lack of financial autonomy leaves women in a troubling situation where they may feel compelled to return to their abusers. Many women withdraw their complaints of gender-based violence due to third-party interventions, often under family pressure. There is a tendency among family members and officials to blame women for reporting abuse, further discouraging them from seeking help. Women reporting domestic violence often endure double discrimination from institutions, society, and their families. There is limited information about rights and available support services for victims of gender based violence in Kosovo. The lack of awareness intensifies feelings of vulnerability and exacerbates the sense of helplessness when seeking solutions. There is also insufficient investment in support services for victims and consequences for perpetrators. Insufficient and unstable funding for shelters poses a significant challenge to supporting survivors of domestic violence. Without adequate resources, shelters struggle to maintain essential services and meet the increasing demand for their services. There is also a lack of sustainable institutional support for victims, leading some to return to their abusers. Addressing gender-based violence and femicide requires a holistic approach from all institutions involved in handling cases arising from diverse circumstances. In this analysis, we aim to examine the shortcomings in implementing protection orders for victims and the physical protection of shelters and the Centre for Social Work (CSW) from perpetrators.

Abstract:
The article considers the issue of the migration crisis of Ukrainian refugees to EU member states caused by Russia’s full-scale invasion of Ukraine on February 24, 2022. An elucidation was made as to the quantity of Ukrainian refugees taken in by European states since the Russia’s full-scale military invasion of Ukraine commenced. An analysis of forms of protection for individuals in the European Union is conducted, including refugee status and temporary protection. The legislation of refugee status in the EU is represented through the prism of the analysis of the Council Directive 2001/55/EC on temporary protection. The key difference between temporary protection and refugee status is defined. The key problems faced by European countries are highlighted; concurrently, the obstacles experienced by Ukrainian refugees are presented, namely, obtaining housing and employment. Special attention was paid to the issue of “fatigue” and exhaustion of social systems and ordinary citizens in EU countries. The authors present the results of the study on the mechanisms of providing protection and asylum to Ukrainian refugees in the EU. Furthermore, the 10-point strategy suggested by the European Commission to the European Council and the Justice and Home Affairs Council in order to support EU countries in their endeavor of admitting Ukrainian refugees has been duly given attention. The core research objectives revolve around the effectiveness of protection mechanisms for Ukrainian refugees in the EU, and any consequences said system may bring about for both the EU and Ukraine.

6. Between Humanitarian Assistance and Externalizing of EU Borders: The EU-Turkey Deal and Refugee Related Organizations in Turkey

Abstract:
This paper examines whether multilevel transnational cooperation makes a difference in refugee protection, especially in protracted displacement. In response to the forced migration of millions of Syrians to Turkey starting in 2011, the EU and Turkish government published a joint statement in March 2016. The so-called EU-Turkey deal (EUTD) provided a substantial flow of money (EUR 6 billion in four years) from the EU to Turkey. In return Turkey had to commit to contain and control migration movement toward the EU. In social science, there are quite diverse evaluations of the EUTD. Whereas some studies focus on its effectiveness and efficiency in reaching the outlined goals, other publications stress its geo-political effects on migrants’ mobility and (externalized) border control. Meanwhile some studies look for points to improve the EUTD while others criticize it fundamentally. This article analyzes the involvement of different types of international governmental and non-governmental organizations (IGOs and INGOs) in the four main action fields of the EUTD and its implicit side effects on the Turkish regime of migration management. It first summarizes some crucial findings and pending questions in the social science literature. Based on analysis of available documents and our own interviews in Turkey, we then shed light on the organizations involved in the implementation of the EUTD and its effects on the Turkish regime of refugee protection. In 2022, Turkey hosted some 3.7 million Syrian refugees of a total of almost four million registered international forced migrants. The EUTD of 2016 was mainly a response by the EU to the large numbers of Syrian refugees arriving in its members’ territories. When more than 1.2 million asylum seekers were registered in the then EU-28 in 2015 alone — more than twice the number in the preceding year — some EU member states (MS) negotiated with the Turkish government (Eurostat 2015, 2016). Based on a meeting of the European Council and its “Turkish counterpart” the so-called “EU-Turkey statement” was published on March 18 in 2015 (European Council 2016). From the very beginning, this EUTD was controversial — both in public discussions and in the social science literature. Was it primarily a payment from the EU to the Turkish government for externalizing its responsibilities of refugee protection? Or was it an appropriate measure for sharing the burden of an urgent humanitarian crisis? Was the money spent for refugee-oriented humanitarian aid and development expenses or was it instrumentalized by the Turkish government for its own ends? How did refugee related IGOs and INGOs participate in the management of the EUTD? In the following sections, we focus on some selected aspects of the role of national and international, governmental and non-governmental organizations active in the field of refugee protection, specifically the role and cooperation dynamics of these refugee related organizations (RRO) in implementing the Facility for Refugees in Turkey (FRIT) as part of the EUTD. Based on expert interviews in Turkey and an analysis of spending under the EUTD, the paper analyzes (1) how the landscape of RROs developed in the context of the EUTD, (2) how the budget of the EUTD was spent, and (3) how the cooperation between these RROs developed. The paper adds new insights into the contradictory dynamics between organizing services for refugees and controlling and containing refugee movements to the EU, between assisting and instrumentalizing forced migrants in Turkey, and between humanitarian aid and development activities. Especially the last point is relevant for contexts of protracted displacement as instruments of immediate humanitarian assistance have to be combined with means of longer-term development. From a perspective of organizational sociology, it argues that the EUTD contributed to a multi-level transnational organizational field of refugee protection, where collective and corporate actors relate in conflict and cooperation between the poles of rational self-interests and mutually recognized norms, between control-oriented state authorities up to grass root action networks. Analysis of the EUTD enables us to draw out specific insights and practical lessons for a broader audience. Before presenting our own empirical findings we first will sketch out the broader landscape of social science research and analysis of the EUTD.2

Abstract:
What can the states and governments do to protect civilians in conflict and prevent further civilian losses in war in Ukraine? Read about it in the new analysis written by a member of the BCSP International Advisory Committee, Marta Martinelli. The war in Ukraine marks a turning point in the history of Europe and of the relations between the West and Russia, as well as more broadly, the configuration of alliances that the conflict contributes to shaping as it protracts and evolves. The situation in Ukraine is a powerful indication of a world we used to take for granted. The old framework provided a more or less reliable ecosystem designed to provide predictability and a level of stability acceptable to the world’s large powers. It included the use of diplomacy to address international confrontations, reliance on international law to regulate relations amongst states including in the conduct of hostilities, and a general ‘agreement’ that provoking a direct confrontation between Russia and the West belonged to the realm of the irrational and unacceptable. That predictability was shattered in February 2022. If there is one element that emerges starkly from the conduct of the war in Ukraine, it is the insignificance of diplomacy to restore peace and the total disregard for International Humanitarian Law and civilians caught in the war. Whilst not new to contemporary conflicts (as seen in Darfur, the Central African Republic, Yemen, and Syria, amongst others) the scale and speed of the harm inflicted to civilians and civilian infrastructure in Ukraine is unprecedented, facilitated also by the use of new technologies.

This paper reflects upon the issue of statelessness, Palestinians and a recent evolution of Belgian caselaw. When seeking to apply the definition of a ‘stateless person’, as found in art 1 of the 1954 Convention Relating to the Status of Stateless Persons to Palestinians, judges are confronted with specific challenges. Since 2016, divergent standards are developing as to the question of whether, and in which circumstances, Palestinians may be stateless for the purposes of international law. This evolution takes place in a national landscape characterised by a statelessness determination procedure that falls short of standards set out in the United Nations High Commissioner for Refugees Handbook on Protection of Stateless Persons in a number of areas, while a growing number of asylum seekers originating from Palestine are registered over the period 2016–19. This paper exposes, anno 2020, the protection gaps left open by the remarkably divergent approaches to this question taken by the different national actors involved.

A generation after Rwanda and Bosnia, many of the world powers who apologized for their lack of an early and effective response to genocide during the 1990s have yet to organize themselves sufficiently to act early and effectively to prevent or stop mass atrocities. The horror of Syria is Exhibit A. As responses to past atrocity crimes show, averting and halting atrocities requires a coordinated and sustained effort by local, regional, and international actors. This report argues that a multilateral response is necessary and that the transatlantic region has a critical role to play in shaping and leading these efforts. The governments of the transatlantic community—the United States, Canada, and Europe—already devote significant resources and political capital to the prevention and amelioration of crises and conflicts, as well as to the pursuit of international development agendas. Without better cooperation among themselves and their like-minded cousins, efforts to address mass atrocities will continue to be reactive, slow, and devastating to human life and potential. Individual transatlantic countries should be involved in those efforts, each bringing its unique capacities to the table. From the vantage point of the report's authors, the United States has a particularly important role to play in encouraging greater transatlantic cooperation among states on this issue.
