21. The EU in Bosnia and Herzegovina: Powers, Decisions and Legitimacy

Abstract:
This Occasional Paper analyses the issue of the Bonn Powers in Bosnia – whereby the Office of the High Representative (OHR) can enact laws and remove elected officials – by comprehensively assessing the legitimacy of past OHR decisions. Adopting an established theory of legitimacy developed by Harold Lasswell and Myres McDougal, it argues that empirical legitimacy is best conceived as serving common interests of effective actors within an authorised process, and normatively prescribes that such process should be shaped to maximise values of human dignity. Given this theoretical framework, it examines the process authorised under the Dayton Agreement, which created the political structure that currently exists in Bosnia. It discusses the origins of the Bonn Powers and surveys the various criticisms that have been levelled against them. It then develops an overall analysis of all OHR decisions to date and provides a critique of those categories of decisions that appear inconsistent with the Dayton order and its proclaimed organising principles. Moreover, it provides a focused assessment of a sample of the most problematic decisions, e.g. the removal of elected officials, to show how their empirical legitimacy can be analysed. Finally, the paper concludes with policy recommendations, focusing on the issue of whether the Bonn Powers should be renounced or retained in the future.

Abstract:
From a broad perspective, political economy analyses economic and political exchanges proper to some social groups, embedded in particular historical periods. The great innovation of Max Weber's analysis is to highlight the intersubjective orientations that support these exchanges and characterize a particular period of history. This study firstly compares different features between free market economy and the soviet-type economy. Secondly, it measures their difference in accordance to the "ideal type" of "market", bureaucracy" and "forms of domination". Finally, it insists on the particular "hybrid" figures of "charisma" and "patrimonial bureaucracy".

Strukturell „begrenzte Staatlichkeit“ und nicht staatszentrierte Modi des Regierens sind keine Phänomene, die erst seit dem ausgehenden 20. Jahrhundert zu beobachten sind. Aus diesem Grund plädiert dieses Working Paper für die Übertragung des Governance-Begriffs auf vor- und frühmoderne Gesellschaften. Anknüpfend an die neuere Diskussion um frühneuzeitliche Staatlichkeit steht hier nicht die mehr oder weniger monolithische Sicht auf einen sich mit Macht durchsetzenden monarchisch-absolutistischen Staat im Vordergrund, als vielmehr die Vielfalt staatlicher Dynamiken und der daran beteiligten Akteure. Das Working Paper fragt daher nach den historisch kontingenten Entwicklungspfaden zentralisierter Herrschaftsausübung. Hierdurch soll insbesondere die Heterogenität dieses Entwicklungsprozesses beleuchtet werden, der durch eine Ungleichzeitigkeit von nebeneinander bestehenden traditionellen und neueren Regierungs- und Verwaltungsstrukturen sowie durch immer wiederkehrende Prozesse der Aushandlung von Autorität gekennzeichnet ist.

Abstract:
In order to be simultaneously effective and liberal, governments must normally be able to count on voluntary compliance – which, in turn, depends on the support of socially shared legitimacy beliefs. In Western constitutional democracies, such beliefs are derived from the distinct but coexistent traditions of “republican” and “liberal” political philosophy. When judged by these criteria, the European Union – if considered by itself – appears as a thoroughly liberal polity which, however, lacks all republican credentials. But this view (which seems to structure the debates about the “European democratic deficit”) ignores the multilevel nature of the European polity, where the compliance of citizens is requested, and needs to be legitimated by member states – whereas the Union appears as a “government of governments” which is entirely dependent on the voluntary compliance of its member states. What matters primarily, therefore, is the compliance-legitimacy relationship between the Union and its member states – which, however, is normatively constrained by the basic compliance-legitimacy relationship between member governments and their constituents. Given the high consensus requirements of European legislation, member governments could and should be able to assume political responsibility for European policies in which they had a voice, and to justify them in “communicative discourses” in the national public space. This is not necessarily true of “non-political” policy choices imposed by the European Court of Justice. By enforcing its “liberal” program of liberalization and deregulation, the ECJ may presently be undermining the “republican” bases of member-state legitimacy. Where this is the case, open non-compliance is a present danger, and political controls of judicial legislation may be called for.

Sociological research on the European Union provides a much needed alternative to mainstream EU-studies dominated by economics, law, IR and political science. However, until now this sociological alternative has mostly involved the adaptation of sociological terminology such as “social construction” or “identity” and the introduction of new objects of research, such as the social conventions regulating national security or the discursive constructions of Europe. It is however the claim of this paper that sociological theory also provides the tools for a more fundamental re-evaluation of some of the ontological and epistemological presuppositions of EU research and a corresponding reconstruction of the object of study of European studies.

27. Sociology of a new field of knowledge: gender studies in postcommunist Eastern Europe

Abstract:
A new research field named “gender studies” or “feminist studies” has emerged during the 1990s in East-European and post-Soviet countries. The scientific productions in that field often function as experts' studies and aim at contributing to improve women's condition. Established by agents who simultaneously act in several social spaces (scientific, associative or political), feminist studies are at the crossroads of academic and activist, national and international dynamics. Therefore, we consider them as a new discipline at the core of the social and political programmes of recomposition after the collapse of communist regimes, and as an indicator for the rebuilding of social sciences, the emergence of new academic topics, the international circulation and importation of scientific concerns, the reconstruction of intellectual elites in the Countries of Central and Eastern Europe (CCEE). The paper offers some guidelines for a sociology of this new field of knowledge production.

Abstract:
Drawing on a diverse array of opinions from Africa, Asia, Europe, and North America, the EastWest Institute's Fifth Worldwide Security Conference brought together specialists from the spheres of policy, academia, and civil society. Participants addressed a variety of issues on the contemporary global security landscape. These ranged from specific security threats (whether illicit trade, the targeting of critical infrastructure or cyber crime) to the role of interested actors (such as business, NGOs, and media), as well as a focus on potential strategies to counter terrorism and extremism (either in terms of constructing global cooperative architectures or, more controversially, the possibility of opening dialogue with the terrorists). A variety of policy recommendations emerged from each session—detailed in the main body of the report—but there were several recurring themes binding the debate together and animating the core arguments of proceedings as a whole. These policy recommendations were not necessarily consensus recommendations but reflected a wide range of debated policy prescriptions.

29. Man in his Natural State: The New World and Locke's Second Treatise

Abstract:
Over the past four decades an effort has been made to relieve John Locke's writing of its central position in the foundation of the “American Republic,” as historians of political philosophy have tended to devalue his role in the pantheon of America's founding philosophers (Huyler 1995; Pocock 1975; Bailyn 1967). Although we have a robust historiography that considers the question of Locke in America, we have surprisingly few scholarly studies on the role of America in Locke's thought, particularly of the conceptual imagery of the Americas and its peoples in Locke's Second Treatise (Bailyn 1967; Pocock 1975). The studies that do consider this connection do not situate his work into a broader historiography concerning the impact of the New World on Europe during the three centuries after its discovery. Instead, scholars have largely approached the question from the perspective of political theory and with the relatively limited goal of explicating his political thought more clearly. In this paper, I am interested in reading Locke as a crucial moment in the larger impact of the New World on Europe during the three centuries after its discovery.

Abstract:
Do network theory really offer a suitable concept for the theorization of informal processes of economic regulation and institutional change? This working paper challenges both essentialist and skeptical attitudes to networks through an examination of the positive and negative effects of network governance in contemporary societies in a range of regional contexts. The analysis focuses on three broad principles of non-state organization – culture, agency and power – and their role in shaping processes of economic and political governance. It will be shown that the effective theorization of informal regulatory processes requires attention to the specific interaction of culture, agency and power in particular social contexts. Emphasizing a grounded theory approach, this article draws on cutting-edge network research from East Asia, Eastern Europe, Africa and Western societies to develop theoretical tools for the comparative study of non-state governance and its impact on wider processes of institutional change.
