11. Not Enough Maritime Capability: The Challenge of Reinforcing Europe

Abstract:
Russia’s actions in Ukraine in 2014 marked a clear shift in Russian foreign policy, with the Kremlin pursuing a more assertive and aggressive approach to Europe and the West. Russia’s resurgence has meant that the United States again must seriously consider a possible conflict in Europe in its military plans. Central to the defense of NATO allies is a requirement for U.S. reinforcement of Europe, and U.S. reinforcement in turn depends on U.S. maritime shipping, which faces a number of critical challenges. This paper examines the current capability and availability of U.S. shipping to meet U.S. strategic sealift needs. It describes efforts by the United States to modernize and sustain the capacity required for strategic goals, including the reinforcement of Europe, and examines how the United States could leverage allied commercial and sealift capacity to address potential gaps. Finally, the paper identifies recommendations for addressing these challenges. U.S. logistical capabilities that are required to reinforce Europe, including sealift capabilities, have atrophied since 1989. Competing naval requirements make addressing future sealift shortages unlikely to be a top funding priority, while complicated laws hamper quick solutions to filling maritime shortfalls. Until U.S. shipbuilding can fill the gaps, workarounds such as using allied maritime assets to ship U.S. reinforcements must be considered. The requirement to reinforce Europe is too urgent not to consider all alternatives to addressing future shortfalls.

12. Contested Seas Maritime Domain Awareness in Northern Europe

Abstract:
Northern Europe, and specifically the Baltic and Norwegian Seas, has been the site of increasingly provocative and destabilizing Russian actions. The country’s use of a range of military, diplomatic, and economic tools to undermine the North Atlantic Treaty Organization (NATO) and its allies highlights the need to monitor and understand Russian activity. The region is characterized by complex factors like unique geographic features, considerable civilian maritime traffic, the presence of advanced Russian and Western military capabilities, and strategic proximity to Russia and the Kola peninsula, home to the Russian Northern Fleet. While the Norwegian and Baltic Seas do differ in key ways, they are linked by the emerging risk posed by Russia’s long-range strike capabilities. Responding to Russian challenges across the competitive space requires a deep understanding of the Northern European maritime environment. Maritime Domain Awareness (MDA), defined by the United States as the effective understanding of anything associated with the maritime domain that could impact the security, safety, economy, or environment of a nation or region, is an exceptionally broad concept. At its core, MDA has three functions: the collection of raw data, the analysis of that data, and the action of disseminating information to and coordinating among the different components of the framework. In order to provide security in Northern Europe, NATO and its allies must use MDA frameworks to understand and respond to the challenges above, on, and underneath the sea, as well as the surrounding land environment. While some constructive work has been done to address the evolving Russian threat, NATO and its partners must make changes to their current MDA capabilities to evolve alongside with it. Russia presents three challenges of particular concern to the MDA efforts in Northern Europe: maritime hybrid warfare, electronic and cyber warfare capabilities, and long-range strike systems. Maritime Hybrid Warfare—The Russian military is experienced and effective in its use of hybrid warfare, seen in Syria, Crimea, and Northern Europe. The ambiguity possible in the maritime domain lends itself well to this strategy. Russia uses three specific approaches in this realm: deception through different types of vessels including civilian ships, deniable forces like the amphibious and light infantry that easily navigate the complex Baltic and Norwegian Seas, and the country’s well-developed and diverse force for seabed warfare. Cyber and Electronic Warfare—Russia’s advanced EW capabilities have the potential to hinder information gathering and dissemination methods, which are both vital functions of MDA. These capabilities are challenging for military personnel but potentially devastating in civilian contexts, especially as civilian networks and technology (like GPS) are far less secure. Long-Range Strike Capabilities—New challenges for NATO and Northern European partners have emerged with Russia’s development of a long-range precision strike complex. The weapons, now being mounted on new and existing Russian naval vessels, give these vessels the option to stay in the Barents or White Seas and strike targets across Northern Europe. This, combined with air force capabilities based on the Kola Peninsula and in Kaliningrad, presents threats unlike any seen by NATO before. These capabilities require NATO and its partners to use MDA frameworks to monitor launch platforms across the domain. The modern history of MDA begins in the United States, with Homeland Security Presidential Directive – 13 (HSPD-13) / National Security Presidential Directive – 41 (NSPD-41) issued in 2004 by President George W. Bush. The document lays out core interests for the United States to enhance security in the maritime domain and creates a cooperative framework to support MDA operations across different spheres. At the same time, the European concept of maritime security awareness was built upon the U.S. definition of the challenge, placed within the context of rising illicit traffic in the Mediterranean. A weakness of the original MDA and Maritime Situational Awareness (MSA) concepts is that many of the associated capabilities and frameworks are focused on civil maritime issues. Given the global proliferation of advanced military capabilities, like antiship cruise missiles, NATO and its partners require a holistic understanding of the maritime environment that focuses on everything from civil maritime actions to high-end military operations and even issues associated with the maritime environment. A key implication of the heightened maritime threat environment is the need to improve the integration of and attention to undersea aspects of MDA. Antisubmarine warfare (ASW), a traditional strength of Western naval intelligence and operations, has atrophied since the end of the Cold War. Today, Russian submarines with conventional long-range missiles pose a threat to NATO. ASW must be integrated with MDA to address these concerns. Comprehensive understanding of the undersea realm should extend beyond ASW. Russia’s amphibious special forces and combat swimmers threaten more than just military targets, including civilian vessels and undersea cables, which are an integral part of MDA. ASW technology can be useful in countering these and other threats. In the Norwegian Sea, the biggest challenge for NATO is detecting advanced ultra-quiet submarines. This issue is sharpened by dramatically depleted stockpiles of sonobuoys, a constant need for increasingly advanced sonobuoy technology, and an American unwillingness to share highly classified information about the undersea domain. NATO would benefit from an apparatus like the ASW Operations Centers (ASWOC), used most prominently during the Cold War to streamline ASW operations. Integration of platforms is a challenge in the Baltic Sea as well, largely because Sweden and Finland are not NATO states, making data sharing challenging. Frameworks like Sea Surveillance Co-Operation Baltic Sea (SUCBAS) and the Maritime Surveillance (MARSUR) project facilitate the work of regional states to address these issues but more must be done. Additionally, NATO monitoring of the Baltic region is largely domain specific and suffers from not examining the maritime domain holistically. The alliance and its partners should also act to focus on resiliency to continue to operate in the face of jamming and nonkinetic attacks from Russia. The key to enhancing MDA capabilities in Northern Europe is the integration of frameworks across the maritime domain. Cooperation between NATO states and allies is vital to understanding the complex environment. The CSIS study team has identified seven recommendations of particular importance: Create a Baltic Sea MDA analytic center at the Baltic Maritime Component Command (BMCC) at Rostock, Germany; Empower a small analytic team at the BMCC to focus on maritime hybrid issues; Develop a training course for military intelligence officers on best practices for Baltic Sea MDA analysis; Create a classified Baltic Sea data environment that can incorporate both NATO and partner states; Develop a multinational operational framework for the Baltic Sea; Integrate subsurface sensors and antisubmarine warfare into a comprehensive MDA framework; and Acquire significant stockpiles of advanced sonobuoys and associated acoustic processing systems. These priority recommendations are presented in detail in Chapter 4 of the report, along with others. Collectively, their implication would markedly enhance security in Northern Europe by closing identified gaps and ensuring capabilities for collection, analysis, and action in MDA.

13. Opportunities for Defense-Industrial Collaboration after Brexit

Abstract:
The United Kingdom should seek to continue to support defence-technology cooperation with the European Union and partner states across all military domains. Avoiding, or at least minimising, the second-order effects of Brexit on wider defence cooperation with European partners will be easier if the UK is directly involved in the EU’s defence-technology initiatives. Specific opportunities present themselves across the military domains: Pursue cooperation in the air domain with regard to future combat- aircraft technology. While collaboration at the platform level is unlikely in the near term, exploring common R&D in key systems, such as radar, propulsion, avionics, sensors and weapons, is achievable. In the land domain, explore partnership with France and Germany on participating in the development of a next-generation main battle tank. Collaboration on applicable technologies at the component and sub- system levels should also be encouraged. This could include armour and armament R&D, and laser weapons. In the maritime domain, support cooperation in the air-defence arena, including the use of laser weapons for ship self-defence, and the use of naval vessels for ballistic-missile defence. In the space domain, examine potential cooperation on next-generation communication satellite requirements, and wider collaboration on geospatial intelligence.

14. NATO-EU maritime cooperation: for what strategic effect?

EU-NATO maritime cooperation is essential to a co- ordinated response to a variety of Mediterranean is- sues, including terrorist threats, the protracted conflicts in the Middle East and North Africa (MENA), and the refugee emergency. The EU’s Operation EUNAV- FOR Med Sophia is deployed in the Southern-Central Mediterranean, whilst NATO’s Operation Sea Guard- ian operates in the whole Mediterranean basin. NATO also launched a new activity in the Aegean in 2016. Although each operation has its own mandate, their coordination was defined as crucial in the 2016 Joint Declaration on EU-NATO cooperation. At a tactical level, these operations have by and large been successful in enhancing situational awareness in the Mediterranean; monitoring migration networks; constraining the activity of human and arms smug- glers on the high seas; and to a degree in providing as- sistance to migrants. However, they also face strategic challenges, including the failure to dismantle the smug- glers’ networks, their relatively low deterrent effect, and a limited degree of inter-institutional cooperation.

15. Maritime Legal Black Holes: Migration and Rightlessness in International Law

This article explores the trope of the ‘legal black hole’ to reveal questions of legal theory arising from contemporary migrant drownings. The theme was popularized during what was then called the ‘war on terror’, but its trajectory is longer and more complex. Its material history, as well as its intellectual history within legal scholarship, suggest three distinct ‘legacies’ of legal black holes: the counterterrorism legacy; the migrant-detention legacy; and the legacy of the maritime legal black hole. The tripartite division provides a conceptual typology of instances where persons are rendered rightless. While the two former types are characterized by de facto rightlessness due to a violation of international law, the latter exposes a seldom acknowledged, yet crucial, characteristic of international law; the age-old doctrine on the division of responsibilities between states and individuals at land and at sea is now creating the conditions in which some people are rendered de jure rightless. Moreover, the typology sheds light on the specifically legal reasons for the seeming failure to end mass drowning of migrants and refugees in the Mediterranean Sea. Tracing the ways in which people become de jure rightless is ultimately suggested as a broader research agenda for scholars of international law.

16. The Right to Leave by Sea: Legal Limits on EU Migration Control by Third Countries

Abstract:
The EU and its member states are progressively involving third countries in their border control measures at sea. Relevant instruments of cooperative migration control range from capacity building measures to joint patrols in third-country territorial waters and shared surveillance intelligence on ship movements. So far, the discussion on migration control at sea has mainly focused on the illegality of ‘push-backs’ of migrant boats by EU member states to their point of departure. By contrast, the increasing incidence of departure prevention or ‘pull-backs’ by third countries in the service of EU member states has been largely neglected. In particular, such measures raise grave concerns with respect to the right to leave any country, including one’s own. Of central importance during the Cold War, this human right is of no lesser relevance at Europe’s outer borders. This paper explores to what extent departure prevention and pull-back measures are compatible with the right to leave and the law of the sea and discusses the responsibility of EU member states for internationally wrongful acts committed by third countries in such cooperative migration control scenarios.

The Cold War ended rather suddenly in 1991. With it went the model on which the United States’ maritime strategy of the 1980s had rested. Driven by individuals like John Lehman, President Ronald Reagan’s long-time Secretary of the Navy, that series of strategic documents promulgated a forward, offensive, counter-force approach and the famous ‘600-ship Navy’ force structure. With the formal dissolution of the Soviet Union on December 25, 1991, the sole challenger to U.S. naval power vanished practically overnight. Red Fleet warships were rusting away in port or dismantled altogether. In the United States, the military lost significant human capital through a number of force reduction rounds, which reflected how the U.S. Navy could and would take on the post-Cold War world intellectually. In the wake of this strategic recalibration, allied militaries and their navies—such as the Federal German Navy, soon to be renamed German Navy—also underwent substantial transformations. These were often guided by the shifting geopolitical landscape as well as the popular desire to reduce the inflated defense budgets of Cold War days in order to obtain a peace dividend. This analysis will focus on the Eurasian theater—very broadly speaking, the waters that surround the European and Southwest Asian landmasses[1]—in U.S. and German naval strategy between 1991 and 2014. The maritime sphere has become increasingly important as a domain of emerging security since the end of the Cold War, yet comparatively little time and resources are being devoted to research on naval strategy and relationships between allies at sea. As a result, the use of naval force for political and diplomatic ends and the dynamics of maritime geopolitics have suffered. This essay seeks to underline the challenges that have confronted the U.S. Navy in the past generation and analyze their long-term effects. While the U.S. Navy’s geographic focus and operational interests have increasingly shifted from Europe to the Middle East and Asia, and from control of the “blue water” high seas to the littorals, these key interests should not be overlooked. In the view of the author, the fall of the Soviet Union and the implication that allies like Germany would do more to patrol their own maritime neighborhood provided the U.S. Navy with a convenient reason to de-emphasize their previously highly valued naval hub in the Mediterranean Sea. In rebalancing from the Sixth Fleet area of responsibility (AOR) to other regions of the world, the U.S. Navy accepted the consequences for fleet design and ship numbers, perhaps willingly using it as a bargaining chip for force reduction rounds in Washington, D.C. Implicitly, European allies and the U.S. Air Force[2] were expected to fill the gap left behind in terms of naval presence and crisis response, in particular after the successful campaigns in the Adriatic Sea in responding to unrest and war in the Balkans. European allies, however, were largely uninterested in stepping up to the plate; they considered their near abroad safe enough. Most importantly, they were somewhat wary of delivering a combined ‘pocket Sixth Fleet’ of their own. Finally, they were preoccupied with managing German unification, enlargement of the European Union, and establishing a common market and currency, among other things. Accordingly, this paper sheds a light on some key German strategic documents for a time when the reunited country sought its new place in the security environment of the post-Cold War world. By taking a unique view from Germany, one of the U.S. Navy’s premier NATO allies, this analysis also considers the transformation of the Bundesmarine from an escort navy to an expeditionary navy.[3] It seeks to conceptually explain how Germany’s security policy addressed the maritime challenges of the new era. The German Navy was principally drawn south- and eastward geographically after 1991, usually in close cooperation with other allied and friendly navies (and mandated by NATO, the EU, or the UN).[4] It was increasingly asked to address maritime security challenges to which the U.S. Navy no longer, or only in a supporting role, responded. The German Navy went into the breach with what were essentially Cold War assets and a mindset fundamentally dominated by the inability to think strategically. This paper is split into two sections. The first section discusses the 1991-2001 timeframe and the second section covers the period from 2001-2014. 2001 marked the inauguration of President George W. Bush in January and the terrorist attacks on September 11 eight months later.
