22. Much Ado about Nothing? On the European Union's fight against corruption in developing countries under Aticles 9(3) and 97 of the Cotonou Agreement

- The Cotonou Agreement is the European Union's most important legal measure in the field of development assistance covering 79 developing countries in Africa, the Caribbean and the Pacific (ACP countries). It empowers the European Union to sanction 'serious cases of corruption' where this corruption is related to economic and sectoral policies and programmes to which the European Union is a significant financial partner. During the negotiations leading to the adoption of the Cotonou Agreement the ACP countries strongly objected to the inclusion of the possibility of sanctioning corruption. In practice the European Union has only sanctioned one single case of corruption under the provision, however. Whereas this does not necessarily mean that the sanctioning clause is without an impact, the fact that sanctions have been imposed in only one situation is a strong indication that its impact is rather limited. It is suggested that more effective means of preventing corruption are considered.

- Abstract:
- Colombia has been the recipient of the European Union Official Development Aid (ODA) and US foreign aid (military aid and ODA) since the late 1990s. Both international actors have their own particular understanding of the armed conflict, the possible solutions and the role of foreign aid. From one side, the US emphasises military aid and uses ODA in function with security objectives by working closely with the central government and President Uribe. On the other side the EU cautiously develops a common foreign policy to Colombia and insists on civil society participation and local programs in a rather bottom up peace building approach. Considering their different approaches to the Colombian conflict, the war on drugs, the war against terrorism and human rights in the Andean region this paper will asses the possibility of collaboration between both international actors.

- The crisis that started with Hamas winning the Palestinian Authority (PA) elections in January of 2006 seems to have entered a new stage with the start of 2009. Israel, which provides the occupied PA with the bulk of its economic resources, the US and the EU classifying Hamas as a terrorist organization and the resulting 3 year long economic siege and blockade, and the Israeli operation that started on the 27th of December and lasted for 22 days have all made the humanitarian situation in this region unbearable.

- The European Union has developed its security competence since 1992, thus putting pressure on its Member States to provide troops for the increasing number of EU peace operations being deployed to different areas of the globe. But with national militaries being rationalized and contracted the EU will inevitably follow the lead of the US, the UK, and the UN and start to use Private Military Contractors to undertake some of the functions of peace operations. This article explores the consequences of this trend from the perspective of the accountability and responsibility of both the corporation and the institution when the employees of PMCs commit violations of human rights law and, if applicable, international humanitarian law.

- Climatic disasters are on the increase as the Earth warms up – in line with scientific observations and computer simulations that model future climate. 2007 has been a year of climatic crises, especially floods, often of an unprecedented nature. They included Africa's worst floods in three decades, unprecedented flooding in Mexico, massive floods in South Asia and heat waves and forest fires in Europe, Australia, and California. By mid November the United Nations had launched 15 'flash appeals', the greatest ever number in one year. All but one were in response to climatic disasters.

29. A Policymakers' Guide to Dutch Disease

- It is sometimes claimed that an increase in aid might cause Dutch Disease—that is, an appreciation of the real exchange rate which can slow the growth of a country's exports— and that aid increases might thereby harm a country's long-term growth prospects. This essay argues that it is unlikely that a long-term, sustained and predictable increase in aid would, through the impact on the real exchange rate, do more harm than good, for three reasons. First, there is not necessarily an adverse impact on exports from Dutch Disease, and any impact on economic growth may be small. Second, aid spent in part on improving the supply side—investments in infrastructure, education, government institutions and health—result in productivity benefits for the whole economy, which can offset any loss of competitiveness from the Dutch Disease effect. Third, the welfare of a nation's citizens depends on their consumption and investment, not just output. Even on pessimistic assumptions, the additional consumption and investment which the aid finances is larger than any likely adverse impact on output. However, the macroeconomic effects of aid can cause substantial harm if the aid is not sustained until its benefits are realized. The costs of a temporary loss of competitiveness might well exceed the benefits of the short-term increase in aid. To avoid doing harm, aid should be sustained and predictable, and used in part to promote economic growth. This maximizes the chances that the long-term productivity and growth benefits will offset the adverse effects—which may be small if they exist at all—that big aid surges may pose as a result of Dutch Disease.
