The European University Institute, the Istituto Affari Internazionali, and the Institute for Human Rights at Åbo Akademi University organized a workshop "The New Human Rights Council: The First Two Years" on 7-8 November 2007 in Florence. The purpose of the workshop was to evaluate and assess the potentials of the newly established United Nations Human Rights Council in promoting universal respect for the protection of all human rights and fundamental freedoms.

182. Theories and core principles of Dutch democracy

Abstract:
Democracies in Europe differ in what they see as being at the core of the democratic system. In some countries, citizen participation constitutes the fundamental tenet of democracy; in others, democracy is closely linked to pluralism and the protection of minorities. This paper tries to identify certain core principles of the Dutch democratic system that are reflected in the institutions and political culture that have to come to define the democratic system and are derived from the intellectual context in which the system emerged. It does so by asking two questions. The first is: what are the core principles of Dutch democracy that are reflected in the democratic system? Five core principles are distinguished, each of which has been institutionalised in various ways. The second question is: which ideas on democracy of key political thinkers of the 19th and early 20th century are relevant to understanding the core principles of Dutch democracy? This paper explores the normative theories on democracy of a number of political thinkers in the Netherlands. Traces of different theories appear to be present in the core principles of the Dutch democratic system.

Uzbekistan remains a serious risk to itself and its region. While 69-year-old President Islom Karimov shows no signs of relinquishing power, despite the end of his legal term of office more than half a year ago, his eventual departure may lead to a violent power struggle. The economy remains tightly controlled, with regime stalwarts, including the security services and Karimov's daughter Gulnora, exerting excessive influence, which drives away investors and exacerbates poverty. The human rights situation is grave, and those who seek to flee abroad live in constant danger of attempts to return them forcibly. While the government cites the "war on terror" to justify many policies, its repression may in fact be creating greater future danger. Efforts at international engagement have been stymied by its refusal to reform and to allow an independent investigation of the May 2005 Andijon uprising. Little can be done presently to influence Tashkent but it is important to help ordinary Uzbeks as much as possible and to assist the country's neighbours build their capacity to cope with the instability that is likely to develop when Karimov goes.

Abstract:
The purposeful efforts to explain and define the changes of the Cold War system of international relations continue for a second decade. Certain referent studies stimulate the thinking on these topics, including in the post-9/11 period. Understanding better the transformation of the international system would provide us with a better view on the changes in its regulative sub-system, including the international legal component of the latter.

During the past decade, human trafficking and smuggling grew to a diverse multibillion dollar business across South East Europe and the entire globe. The concern about human smuggling and trafficking extends far beyond matters of security and law enforcement. The cost in human suffering and exploitation that often accompanies smuggling and trafficking cause human rights violations and deplete human capital in origin countries.

The European intergovernmental organisations such as the Council of Europe, OSCE and the EU have taken up the task to promote actively human rights in Russia. The organisations differ in methods, instrument s and over-all strategies but the goal of socialising Russia to common European human rights norms is the same for all these organisations. Socialisation means a process through which norms are transmitted from one party to another and they become firmly established domestic practices.

In addition, easy access to SALW has further destabilized this part of Europe by contributing to organized crime activities such as trafficking and has the potential to support terrorism.

Abstract:
The European integration process has provided both challenges and opportunities to domestic women's movements. One such ambivalent success is the European Union anti-discrimination directive of 2002 that is the outcome of the lobbying efforts of an emerging European transnational advocacy network on gender. The 2002 Directive prohibits sex discrimination, including sexual and gender harassment. It calls on member states to better protect the rights of victims of sexual harassment and to ensure the integrity, dignity, and equality of women and men at work. This paper examines the 2002 Directive and its potential to effect significant changes in EU member states, in particular, to improve victims' rights in member states laws. It addresses the main question: “Is the EU Directive an opportunity to progress in the direction of protecting victims' rights?” The argument advanced here is that the 2002 Directive is the outcome of a political compromise among the member states, on which feminist discourses did have some bearing. On the one hand, the 2002 Directive can be interpreted as a success of feminist activism around sexual harassment, in particular, in the very definition, linking the problem to sex discrimination. On the other hand, it has limitations and does not go as far as feminists had hoped; for example, the EU has left it up to member states to deal with the most difficult aspects of the problem, prevention, implementation, and enforcement of the laws.

Abstract:
On January 25, the Parliamentary Assembly of the Council of Europe (PACE) passed a resolution on the human rights situation in Chechnya. According to PACE's website (assembly.coe.int), the resolution, which passed by a vote of 117 to 24, stated that the Strasbourg-based assembly "is deeply concerned that a fair number of governments, member states and the Committee of Ministers of the Council of Europe have failed to address the ongoing serious human rights violations in a regular, serious and intensive manner, despite the fact that such violations still occur on a massive scale in the Chechen Republic and, in some cases, neighboring regions in a climate of impunity." The assembly also reiterated its "unambiguous condemnation of all acts of terrorism" and expressed "its understanding of the difficulties the Russian Federation faces in combating terrorism."
