191. Kosovo in Limbo: State-Building and "Substantial Autonomy"

Abstract:
Complex peace operations that involve state-building functions are difficult even when the political outcome is clear, as it is in East Timor. In situations such as Kosovo, where the final status of the territory under administration remains unclear, every aspect of state-building is more politically sensitive and more operationally complex. When this occurs in a highly militarized environment and in an unstable region, any departure from a supposedly “interim” solution becomes more difficult still. The Dayton Accords in Bosnia show the dangers of a difficult peace agreement evolving into a constitutional framework that is both unworkable and impossible to change. The conclusion of hostilities may provide the best incentive for belligerents to compromise, but it may subsequently become impossible to reopen such questions without the threat of renewed violence. Future peace agreements are therefore likely to contain state-building provisions that international institutions will assume the task of overseeing, in some situations without a clear political endpoint and exit strategy. In Kosovo, the elections slated for November 17, 2001, reflect a desire for measurable progress and an indication of when the mission will end. An April 2001 report by the UN Secretary-General on this topic was entitled “No exit without strategy”, warning that the UN has too often withdrawn or dramatically altered a peacekeeping operation, only to see the situation remain unstable or sink into renewed violence. Unfortunately, the attitude of lead actors within the Security Council is too often “no strategy without an exit”. State-building after a war will always take years, perhaps decades, and it is disingenuous to suggest otherwise to domestic publics. Elections and limited devolution notwithstanding, the international community will remain in Kosovo and Bosnia for the foreseeable future, certainly with a strong military presence and with at least a supervisory civilian authority. This is an undesirable outcome of what NATO styles as humanitarian interventions, but it is better than all the alternatives. The fact that UNMIK will remain in control of Kosovo for the foreseeable future raises the question of how it should govern. Within UNMIK, there is an increasing tension between those who regard respect for human rights and the rule of law as central to the institution-building aspect of UNMIK's mandate, and those who see this as secondary to the over-riding concerns of peace and security.

While a functioning security sector provides the cornerstone for stable and democratic post-conflict societies, the record of the international community in establishing this critical function is mixed. Despite repeatedly having to manage the immediate post-conflict situation in various peace operations in Europe, Africa, Asia and Latin America, the international community still fails to take the state of the local security sector adequately into account when planning its own intervention.

The Belgian Presidency aims to continue the work on EU conflict prevention undertaken during the Swedish Presidency by focusing on how the EU can effectively address conflicts in Africa. This conference sought to identify some of the challenges facing the Belgian Presidency and suggest concrete steps that the EU could take to ensure coherence in its development co - operation, trade, and common foreign and security policies. The conference specifically aimed to explore how the conflict prevention potential of the new EU - ACP 'Cotonou' Agreement could be realised by developing its provisions for political dialogue and the modalities for engaging civil society in conflict prevention and peacebuilding.

Abstract:
This review employs a multidisciplinary approach to consider the effects of conflict and conflict processes on children in the case of Northern Ireland. Conflict process is likely to effect children at multiple and different levels of societal functioning, with each level capturing a unique element of the effects of conflict processes on children. Thus, understanding each part of the process is likely to contribute towards a more complete understanding than is possible by focusing only on any one level of analysis. Various levels of analysis (e.g., economic, political, institutional, educational) of the effects of communal conflict on adults and children in Northern Ireland have been considered elsewhere (INCORE, 1995). The specific gap addressed in this paper is to further the conceptualization of the psychological, sociological, and familial processes in children that may be affected by communal conflict in Northern Ireland. A related goal is to place these conceptualizations in terms of a broader framework for understanding the complexity of the processes underlying the impact of the conflict.

In a recent article, Michael Mandelbaum depicted Middle Eastern states as the most combative members of the international community. He painted the picture of a region in which “traditional motives for war – gold and God – are still alive” (Mandelbaum 1999). In line with this rather stereotypical perspective, the Middle East is often viewed as a zone of conflict, in which competition for scarce resources (“gold”) inevitably leads to violent encounters between actors that are guided by irrational ideas (“God”). The long and bloody history of the Palestine conflict has contributed a lot to coroberating this image of a region in which violence seems to be endemic. In terminating the so-called Middle East Peace Process, the current “Al-Aqsa Intifada” marks another violent step in this conflict that has frequently escalated to warlike proportions in the form of popular unrest, communal riots, anti-colonial insurgencies, guerilla and terror attacks, as well as civil and inter-state wars. Yet behind these waves of violence and counter-violence, we can easily discern patterns of a kind of nationalist conflict with which European history is far more familiar than the stereotype of Middle Eastern irrationality admits. Despite the academic obsession with proclaiming the “end of territoriality” and the “decline of the nation-state”, the Palestine conflict represents a painful but vivid remnant of those national conflicts that politically characterized the nineteenth and twentieth centuries in Europe.

197. Macedonia: War on Hold

Abstract:
Macedonian and Albanian political leaders signed a political agreement – hailed by its Western midwives as a peace agreement – on 13 August 2001. NATO Secretary General Lord Robertson and the European Union's High Representative for Common Foreign and Security Policy, Javier Solana, flew to Skopje to attend the signing ceremony. But the strange context of the signing showed just how implausible it is that, without further extraordinary efforts, the agreement will actually provide a workable way to keep multiethnic Macedonia out of civil war. Details of the agreement had been hammered out by 8 August in Ohrid, a resort town chosen for the negotiations because it was some distance away from the latest fighting. Signature was delayed five days, however, while Macedonian government troops and ethnic Albanian rebels engaged in the deadliest series yet of tit-for-tat retaliations. Terms of the agreement were withheld from the public lest they provoke violent responses from hardliners on both sides. The ceremony, when it finally occurred, was carried out almost furtively, in a small room of the President's residence, without live television.

Abstract:
The "new pension orthodoxy," a new way of thinking about pension reform in Russia, according to Orenstein, is a reflection of global changes. Systems that were set up in the early 1900s are now being partially replaced by fully funded, privately managed, individual savings accounts. The policy of private accounts was first developed in Chile in the early 1970s, at first generating considerable pessimism, but in the decade that followed, inducing a number of other Latin American countries and some Western European nations to begin full or partial privatization of their pension systems.

Quoting the words of Alva Myrdal in her 1982 Nobel Peace Prize acceptance speech, Mrs Theorin noted that we are living in an age of “instrumentalised, de - personalized violence.” In the post - cold war era the battlefield has moved to the village, the street and the home. Most recent and ongoing wars occur within a state rather than between states, with civilians being the prime targets and victims of violent conflict. The international community too often avoids its responsibilities, failing to commit peacekeepers, while others sidestep the United Nations (UN) in pursuit of their own interests. Faced with such inconsistencies in the international community's willingness to intervene, non - violent methods must be given priority. The most important part of the EU's new Rapid Reaction Force is not the missiles, tanks and soldiers, but rather the advantage in civilian crisis management that it presents. The central part must be a civilian peace service based on voluntary civilian organisations trained and competent to serve in crisis management scenarios. We need to incorporate civil society unless we want it to become a shadow of NATO. Two thousand years ago Cicero remarked that there are two ways of resolving conflict: through negotiation or through violence. The first is for human beings, the other for wild beasts. We should have a clear vision of conflict prevention that recognises that there are two ways of solving conflicts: through negotiations and through violence. We are not beasts, but humans. And we must seek to solve conflicts through negotiation, not killing.

The political outlook in Northern Ireland has, at least in the short term, been transformed by the political document released by the British and Irish governments and the subsequent statement issued by the IRA. This involves the exchange of a detailed timetable towards the implementation of the Good Friday agreement — including reform of police and security arrangements in the province — for a commitment from the IRA that at least part of their weaponry can be subject to external inspection. This bargain is likely to be enough to permit devolution to be restored shortly. The Northern Ireland peace process has been at an impasse since the British government suspended the operation of devolved institutions on February 11. It did so because the IRA had offered no clear indication as to how it might initiate the process of arms decommissioning — a situation that left Ulster Unionist leader and First Minister David Trimble extremely exposed in his own party. The narrow margin by which Trimble was re-elected leader by the Ulster Unionist Council in March, and that body's further insistence that the proposed reform of Northern Ireland's police force — the Royal Ulster Constabulary — be diluted before devaluation was restored, appeared to plunge the peace process into a state of permafrost.
