Abstract:
This section is intended to give readers an overview of President-elect Barack Obama's positions on the Middle East peace process as he begins his tenure. The baseline for gauging Obama's views may be his failed 2000 race for Congress. At that time he made statements viewed as pro-Palestinian because they urged the United States to take an "even-handed approach" toward Israeli-Palestinian peace-making. As an Illinois state senator, Obama had cultivated ties with Chicago's Arab American community, which was partly concentrated in his state senate district. He won a U.S. Senate seat in 2004 with significant support from Chicago's Lakeside liberals, who included leading Chicago Jewish Democrats. His position on the Arab-Israeli conflict remained an issue during the 2008 presidential race, however, and Obama made a point of laying out his positions at several points during the campaign, in contrast to his Republican challenger Sen. John McCain, who did not detail his positions.

This is the second in a series of reports about various cities' pre-paredness for terrorism and/or natural disasters. It is the outgrowth of a series of roundtable discussions in 2007 and 2008 in New York, Chicago, Houston, New Orleans, and Los Angeles among key federal, state, and local government officials in each such city, as well as private sector stakeholders, and think tank/academic experts on homeland security and counterterrorism. The series was financed by a generous lead grant by the Ford Foundation, supplemented by additional grants from the Rockefeller Foundation, the McCormick Foundation, and the Houston Endowment. The goal in each city was to identify best practices that can be replicated around the country; to identify any gaps in preparedness; and to recommend to policymakers ways and means of closing any such gaps.

One of the distinguishing features of American life is the large degree of freedom we have in making choices about our lives. When choosing our diets, we have the freedom to choose everything from subsisting exclusively on junk food to consuming meticulously planned portions of fat, protein, and carbohydrate. When choosing how to conduct ourselves financially, we have the freedom to choose everything from a highly leveraged lifestyle of debt to a modest save-for-a-rainy-day approach. In every area of life, from health care to education to personal relationships, we are free to make countless decisions that affect our long-term happiness and prosperity-or lack thereof. According to Richard Thaler and Cass Sunstein, professors at the University of Chicago and authors of Nudge: Improving Decisions About Health, Wealth, and Happiness, this freedom and range of options is problematic. The problem, they say, is that most people, when given the opportunity, make bad choices; although Americans naturally want to do what is best for themselves, human fallibility often prevents them from knowing just what that is. "Most of us are busy, our lives are complicated, and we can't spend all our time thinking and analyzing everything" (p. 22). Average Americans, say Thaler and Sunstein, tend to favor the status quo, fall victim to temptation, use mental shortcuts, lack self-control, and follow the herd; as a result, they eat too much junk food, save too little, make bad investments, and buy faddish but useless products. Many Americans, according to the authors, are more like Homer Simpson (impulsive and easily fooled) than homo economicus (cool, calculating, and rational). "One of our major goals in this book," they note, "is to see how the world might be made easier, or safer, for the Homers among us" (p. 22). The particular areas where these Homers need the most help are those in which choices "have delayed effects . . . [are] difficult, infrequent, and offer poor feedback, and those for which the relation between choice and experience is ambiguous" (pp. 77-78).The central theme of Nudge is the idea that government and the private sector can improve people's choices by manipulating the "choice architecture" they face. As Thaler and Sunstein explain, people's choices are often shaped by the way in which alternatives are presented. If a doctor explains to his patient that a proposed medical procedure results in success in 90 percent of cases, that patient will often make a different decision from the one he would have made if the doctor had told him that one in ten patients dies from the procedure. Free markets, the authors argue, too often cater to and exploit people's tendencies to make less than rational choices. Faced with choices about extended warranties or health care plans or investing in one's education, only the most exceptional and rational people will make the "correct" choices. Most people, the authors argue, cannot avoid the common foibles of bad thinking; thus we ought to adopt a better way of framing and structuring choices so that people will be more likely to make better decisions and thereby do better for themselves. Hence the title: By presenting information in a specific way, "choice architects" can "nudge" the chooser in the "right" direction, even while maintaining his "freedom of choice."

Abstract:
The case of Muhammad Salah, a Palestinian-American grocer and Chicago resident, is the longest-running terrorism case in the United States. He was brought to trial on terrorism-funding charges in October 2006 after a thirteen-year saga that began with his January 1993 arrest in Israel as the "world commander of Hamas" and that continued in the United States following his release from Israeli prison in late 1997. Though acquitted of all terrorism-related charges by a U.S. federal jury in Chicago in February 2007, Salah was convicted on a single count of obstruction of justice. In this exclusive report for JPS, Salah's lawyers recount the unfolding of this landmark and labyrinthine case, analyzing its legal underpinnings and implications. His prosecution served to advance new standards governing the admissibility of coerced confessions at trial and the use of secret evidence, while at the same time establishing new procedures for preventing the cross-examination of key witnesses and closing the courtroom to the press and public during crucial testimony. Even before his U.S. trial, his taped confession extracted under Shin Bet torture served as the linchpin of the U.S. government's investigation and prosecution of persons it suspected of providing material support for Palestinian resistance to Israeli occupation. More broadly, the years covered by the case show the erosion of the rule of law in the United States, as well as the melding of the discourses, strategies, tactics, and aims of U.S. and Israeli law enforcement and intelligence bodies long before the post-9/11 launch of the "global war on terror." Part I of this two-part account lays the ground for the 2006-7 Chicago trial, covering the period of Salah's arrest, interrogation, and imprisonment in Israel and the investigations and legal proceedings against him upon his return. Part II will focus on the crafting of the case by the Justice Department under Pres. George W. Bush and the trial itself.

On February 1, after fourteen days of deliberation, a Chicago jury acquitted Muhammad Salah and Abdulhalim Ashqar of charges that they were involved in a racketeering conspiracy by financing and supporting Hamas terrorist activities in the late 1980s and early 1990s. The two were accused of laundering funds, facilitating communications, and providing recruits for Hamas, but were convicted only on minor charges of obstruction of justice and, in Ashqar's case, criminal contempt. Like the 2005 prosecution of Sami al-Arian and several other Palestinian Islamic Jihad supporters in Tampa, Florida (where the jury acquitted the defendants of most charges and deadlocked on others), the case highlights the difficulty of prosecuting individuals for providing support to terrorist groups under the cover of humanitarian or political activity.

39. Bearing the Brunt: Manufacturing Job Loss in the Great Lakes Region, 1995-2005

Analysis of manufacturing employment and production in seven Great Lakes states and their metropolitan areas from 1995 through 2005 finds that: More than one-third of the nation's loss of manufacturing jobs between 2000 and 2005 occurred in seven Great Lakes states: Illinois, Indiana, Michigan, New York, Ohio, Pennsylvania, and Wisconsin. Between 1995 and 2005, the United States lost more than 3 million manufacturing jobs. Nearly all of this job loss occurred during the last five years, and 37.5 percent of the loss occurred in the seven Great Lakes states. Michigan lost the most manufacturing jobs between 2000 and 2005 (nearly 218,000), followed by Ohio, Illinois, and Pennsylvania. Despite these job losses, manufacturing remains a major driver of the nation's economy and the economy of the Great Lakes region. Because productivity was higher in manufacturing than in other sectors of the economy, in 2004, manufacturing accounted for a higher share of gross state product than its share of employment, both nationwide and in six of the seven states in the Great Lakes manufacturing belt. In addition, productivity in the manufacturing sector increased by 38 percent between 1997 and 2004, a much higher increase than the 24.4 percent growth in productivity for all non-farm businesses during that same time period. Manufacturing job losses were pervasive in Great Lakes metropolitan areas. All but one of the 25 largest manufacturing-dependent metropolitan areas in the Great Lakes region lost manufacturing jobs during the last decade (1995–2005), often at a faster rate than the United States as a whole. Chicago and Detroit lost the most manufacturing jobs in the last five years (over 100,000 jobs each), while Canton, OH, and Flint, MI, lost the greatest shares of manufacturing employment. The metropolitan areas in which manufacturing employment peaked between 1995 and 1997 tended to experience more severe manufacturing job losses between 1995 and 2005 than those in which manufacturing peaked later. The 13 metropolitan areas where manufacturing employment peaked between 1995 and 1997 saw an average 26.8 percent decline in manufacturing employment between 1995 and 2005. In the other 11 metropolitan areas where manufacturing employment peaked later, between 1998 and 2000, the average metropolitan area lost 18.9 percent of its manufacturing jobs during the decade. Manufacturing job losses were a major reason for slow overall job growth, and sometimes overall job losses, in Great Lakes metropolitan areas. Furthermore, employment gains in high-wage advanced service industries, which occurred in all but one of the 25 metropolitan areas studied, were not large enough to offset the loss of manufacturing jobs in most areas.

The idea of America as an ethnic “melting pot” gained currency at the turn of the 20th century, amid an unprecedented wave of European immigrants to the United States. At the turn of the 21st century, the melting pot ideal persists, but encompasses a more racially and ethnically diverse group of Americans, both native and foreign born. In particular, the higher growth rates of the nation's minority populations versus its white population animate this distinctly American concept.
