131. Much Ado about Nothing? On the European Union's fight against corruption in developing countries under Aticles 9(3) and 97 of the Cotonou Agreement

Abstract:
The Cotonou Agreement is the European Union's most important legal measure in the field of development assistance covering 79 developing countries in Africa, the Caribbean and the Pacific (ACP countries). It empowers the European Union to sanction 'serious cases of corruption' where this corruption is related to economic and sectoral policies and programmes to which the European Union is a significant financial partner. During the negotiations leading to the adoption of the Cotonou Agreement the ACP countries strongly objected to the inclusion of the possibility of sanctioning corruption. In practice the European Union has only sanctioned one single case of corruption under the provision, however. Whereas this does not necessarily mean that the sanctioning clause is without an impact, the fact that sanctions have been imposed in only one situation is a strong indication that its impact is rather limited. It is suggested that more effective means of preventing corruption are considered.

Abstract:
Efforts to build a better Haiti following the catastrophic earthquake of January 2010 are complicated by the challenges of addressing urgent needs, including elections and the cholera outbreak, that run parallel to the rebuilding process and that present an enormous challenge to Haiti\'s under-resourced and weakened government. Enactment of the Haitian government\'s internationally-endorsed and ambitious action recovery plan is hindered by the apparent lack of an over-riding operational framework that will help to ensure not only implementation, but also coherence. Donors and other international actors would be wise to embrace Haiti as a country that has highly propitious fundamentals for successful economic growth, and to build on them. Without important shifts in political, economic and social paradigms, the prospect for Haiti\'s future as a better country that can sustain and expand progress and can improve prospects for all its citizens is clouded.

Abstract:
On 28 November 2010, ten months after an earthquake devastated the capital and surrounding areas, presidential and legislative elections are due to be held. Apart from the logistical and technical challenges posed by the elections, the findings of a study carried out by the authors in July 2010 indicate that the real challenge is the legitimacy of politics per se among the Haitian population, particularly the youth. A series of focus groups were held with young people from differing educational and socioeconomic backgrounds in three cities, as well as surrounding rural areas.

Abstract:
An overview of the region up to 30 January 2009 by the UN Economic Commission for Latin America and the Caribbean (cepal) argues that the larger economies have been more directly affected by the global economic crisis (because in general they are more integrated with the global markets, especially finance), but are also better equipped to respond to it. In particular, Cepal sees South America as diverging from Central America and the Caribbean, which seem to be both less resilient in terms of their economies, and more exposed to the slump in the USA. They are being driven back to aid as the last/only resort. Mexico is in a category of its own, the most exposed to the US downturn, but as a large economy and an oil exporter, better placed to withstand the downturn than its Caribbean basin neighbours.

In 2009, Haiti has been the subject of an unprecedented diplomatic initiative led by the United Nations. In rapid succession, Haiti received visits from the UN Secretary General Ban Ki-moon, the UN Security Council, former President Bill Clinton and Secretary of State Hillary Clinton and numerous senior delegations from Caribbean and South American countries. In April, Haiti was the subject of an international donors' conference hosted by the Inter-American Development Bank that reaffirmed previous commitments and pledged $324 million in new economic assistance. The visits and the donors' conference were preceded by a UN sponsored report by Oxford economist and bestselling author Paul Collier on specific steps that could help Haiti achieve economic security.

137. Institutions Versus Policies: A Tale of Two Islands

Recent work emphasizes the primacy of differences in countries' colonially-bequeathed property rights and legal systems for explaining differences in their subsequent economic development. Barbados and Jamaica provide a striking counter example to this long-run view of income determination. Both countries inherited property rights and legal institutions from their English colonial masters yet experienced starkly different growth trajectories in the aftermath of independence. From 1960 to 2002, Barbados' Gross Domestic Product (GDP) per capita grew roughly three times as fast as Jamaica's. Consequently, the income gap between Barbados and Jamaica is now almost five times larger than at the time of independence. Since their property rights and legal systems are virtually identical, recent theories of development cannot explain the divergence between Barbados and Jamaica. Differences in macroeconomic policy choices, not differences in institutions, account for the heterogeneous growth experiences of these two Caribbean nations.

138. Haiti 2009: Stability at Risk

A series of crises in 2008 have increased the potential for serious trouble in Haiti this year. The politically motivated, violent April riots against high living costs caused widespread disruption and suffering, toppled the government of Prime Minister Jacques-Édouard Alexis and forced postponement of a donor conference. In August and September, four tropical storms and hurricanes killed 800, affected nearly one million, exacerbated food shortages and pushed yet more Haitians into poverty. Extensive damage was caused to infrastructure and agriculture. The global financial crisis is making it difficult for donors to meet commitments and reducing diaspora remittances. President René Préval and Prime Minister Michèle Pierre-Louis, who took office in September 2008, need to secure the support of donors and parliament quickly for a wide-ranging stabilisation strategy or risk political instability and violence. These are major challenges in a year in which parliamentary elections will be held and constitutional reform is on the agenda.

USIP has been working with lawmakers and other reform constituencies in Haiti as they strive to reform Haiti's criminal laws that date back to the early 19th century. In March 2009, USIP commissioned two reports that were written by Louis Aucoin, a professor at the Fletcher School at Tufts University, and Hans Joerg Albrecht, the director of the Max Planck Institute of Foreign and International Criminal Law. At the request of Haitian lawmakers, USIP has also provided copies of the Model Codes for Post-Conflict Criminal Justice, a law reform tool developed by USIP's Rule of Law Program to assist in the drafting of new laws. From June 9 to June 11, 2009, USIP co-hosted a “Technical Workshop on the Modernization of the Criminal Code and Criminal Procedure Code” in Port-au-Prince, Haiti with the Haitian government and a number of international donors. The workshop brought together representatives from the Presidential Commission on Law Reform, the legal community and civil society, along with international organizations and donors, to discuss the problems with Haiti's criminal laws and how to improve them.
