11. The Transformative Power of Europe Reloaded: The Limits of External Europeanization

Abstract:
With the borders of the European Union (EU) moved eastwards, students of Europeanization have been awarded yet another real-world experiment. This paper explores to what extent existing Europeanization approaches travel beyond the EU's border to its South Eastern and Eastern neighbours, which are marked by “bad governance” with regard to both the effectiveness and democratic legitimacy of their domestic institutions. The first part outlines key insights of the literature on “Europeanization West” regarding the outcomes and the mechanism of the domestic impact of the EU. Then, I summarize the main findings of research on “Europeanization East” focusing on factors that have limited or at least qualified the domestic impact of the EU in the ten Central and Eastern Europe (CEE) countries in comparison to the EU 15 (those that were members before the 2004 enlargement). This paper discusses to what extent the concepts and causal mechanisms need even further qualification when applied to countries, such as the European Neighbourhood Countries (ENC), that are neither willing nor necessarily capable of adapting to Europe and that do not even have the incentive of EU membership to cope with the costs. I will argue that the EU is unlikely to deploy any transformative power in its neighbourhood as long as it does not adjust its “accession tool box” to countries the EU does not want to take on as members. The paper concludes with some considerations on the policy implications of the EU's approach of “move closer but don't touch” which has started to creep into its relations with the Western Balkans and Turkey.

Bosnia-Herzegovina's democratization is in slow motion. On the outside it appears that the framework for democracy is in place. A closer look reveals that it lacks the civil society to under gird its political institutions. As Piotr Sztompka points out, "building a house is not the same as establishing a home. The former is only the shell, the empty framework ... it is a concern for architects. The latter is the living arena of social actions and interactions ... it is the concern for sociology. The more or less explicit recognition of that distinction between the institutional and the cultural-civilizational spheres is also indicated by other terms, i.e. public sphere versus civil society" (Sztompka, 1996 in Chandler, 2000). Bosnia-Herzegovina-from here forward Bosnia-lacks the inner workings that distinguish a home from a house.

The May 2008 elections in Serbia showed that the majority of the voters opted for European integration. However, difficulties in forming the government in the period after the elections proved that Serbian society is still highly divided. The polarization between pro-Europeans and traditionalists became so intense that it provided a coalition potential to Milosevic's Socialist Party of Serbia that even they did not expect. After an exhausting period of negotiations the Socialists decided to join the pro-European bloc, for the time-being.

This paper examines the EU's external power through the prism of perceptions by non-EU countries of the aims of EU foreign policies, as shown in the Western Balkans. The paper argues that the EU's policy in the Western Balkans lacks a strong normative justification, which affects the degree of compliance with the EU's demands in areas related to state sovereignty. The perceived lack of legitimacy opens up political space for domestic actors to contest the positions taken by the EU on normative grounds. The Western Balkan countries have responded by giving preference to internal sources of legitimacy and asserting domestic reasons for fake compliance, partial compliance or non-compliance with the EU's conditions, with the latter provoking imposed compliance. The EU's transformative leverage in the region has been much weaker to date in comparison with that in Central and Eastern Europe prior to EU accession.

Abstract:
In this article, I examine the prospects and challenges for co-operative security in the Balkans in the wake of recommendations for Kosovo's final status offered recently to the UN Security Council by former Finnish President Martti Ahtisaari. On the assumption that Ahtisaari's proposals represent a zero-sum gain for the Kosovar Albanians and corresponding loss for the Serbs, I recommend a reframing of his plan that may be more likely to lead to sustainable peace, security, and stability in the Balkans, with implications for similar conflicts elsewhere.
