The December 1, 2018, arrest of Huawei chief financial officer Meng Wanzhou, and the arrest of another Huawei employee in Poland, come on the heels of a series of escalating measures—or measures under consideration—by governments in North America and the Pacific Region to restrict the use of Chinese-manufactured telecommunications equipment. Such measures are now increasingly under consideration in Europe, as well, with major implications not only for the international profile of companies such as Huawei, but also for the construction of advanced communications infrastructure throughout much of the world.

Abstract:
North Korea’s commercial information technology (IT) industry has operated overseas, largely unnoticed, for decades. It sells a range of products and services including website and app development, administrative and business management software, IT security software, and biometric identification software for law enforcement applications. Its global network includes a myriad of front companies, intermediaries, and foreign partnerships. Yet despite the attention currently paid to North Korea’s overseas revenue streams and its offensive activities in cyberspace, the spotlight has yet to illuminate the money-spinning North Korean IT firms whose offerings seem to have found their way into corporate supply chains and potentially even Western-allied law enforcement agencies. Drawing upon extensive open-source investigations by the authors, this paper examines several nodes in North Korea-linked IT networks and considers the implications for current and future policy efforts to stem North Korean revenue and mitigate the cyber-security threats the country poses.

This paper examines China’s cybersecurity industrial development over the past two decades since the arrival of the internet in that country. This analysis takes place from a primarily security and technology perspective because the national security apparatus occupies a powerful presence in China’s cyber affairs. Moreover, the development of the cybersecurity industry is significantly driven by the development of technological capabilities. Key issues explored include: 1) Chinese decision-making and thinking on cybersecurity development within the context of the Chinese leadership’s general approach to development, national security, and technology advancement; 2) the nature and characteristics of recent Chinese cybersecurityrelated development strategies and plans; 3) the drivers behind the development of China’s cybersecurity industry, looking especially at market failures, national security rationales, and government intervention; 4) the proliferation of principal actors and coalitions in the Chinese cybersecurity industry and how this influences its development; and 5) the nature of the relationship between the state and cybersecurity firms, in particular examining four types of interactions: the state as a customer; state hiring of talent; the state’s direct regulatory power, and the state as an investor. The paper concludes by considering the international implications of China’s rise as an increasingly capable and confident cybersecurity power.

This paper explores Japan’s industrial policy toward cyber security. I begin by describing the perceived market failures with regard to cyber security, and the Japanese government’s rationales for intervention. Next, I briefly describe the institutions involved in Japan’s cyber security policy-making. I follow by discussing three models of Japanese intervention: government as provider, government as facilitator, and government as promoter. Then, I examine the factors that have led to this particular constellation of measures. Finally, I look at the effectiveness of these measures as well as make some concluding remarks about likely future trends.

Viewing cyber security as a matter of national security, the Taiwanese government established the National Information and Communication Security Taskforce (the Taskforce) in 2001 to actively implement ICT security infrastructure policies and strengthen national capacity against threats to the country’s increasing cyber security issues. A series of national strategy programs and action plans followed the founding of the Taskforce and were carried out over the last fifteen years. Authorities in Taiwan are deliberating over the draft of “Information and Communication Management Act (ICM Act)” in response to the increasing awareness of potential malicious cyberattacks targeting the public and private sector. Under this Act, both government and nongovernment bodies will have to comply with the new legislation with the hope that the coded regulations and new management scheme will have a positive impact on enhancing national security and increasing the domestic market. This article aims to provide a thorough review of the proposed national information security policies in Taiwan between 2001 and 2017, as well as deliver a case for the comparative study of industrial policies employed to bolster domestic cyber security markets.1 By summarizing the government’s industrial policy in developing a cyber security market and identifying key stakeholders involved in the policy-making process, we describe the major rationale and drivers behind the government’s plan of action and aim to push for a more comprehensive understanding of the proposed policy tools used by the authorities to boost the development of the cyber security industry in Taiwan.

56. Cyber Deterrence in Singapore: Framework & Recommendations

Abstract:
As a small state, Singapore’s ability to create deterrence against cyberattacks is very limited. There is limited value in pursuing classic deterrence through denial and punishment because: (i) technology is relatively cheap and widely available; (ii) there is difficulty in accurately attributing blame; and (iii) there is difficulty in identifying and punishing attackers. If there is no detection or ability to punish, Singapore’s credibility suffers. The report suggests six ways that Singapore can improve its cyberattack deterrence: 1. Develop a response mechanism to guide deterrence 2. Create resilient systems 3. Share collective responsibility in cybersecurity 4. Increase capabilities through the improvement of penetration detection 5. Create norms with enforcement capabilities 6. Strengthen international law enforcement, cooperation, and legislation It is also not feasible to measure deterrence in cyberspace the same way as nuclear deterrence, where a no-attack scenario denotes that deterrence is successful. Rather, deterrence should be seen as a mitigating effort that leads potential attackers to believe it is not in their best interest to attack. These efforts at deterrence can be further enhanced by improving the accuracy of attribution, the detection of cyber incidents regardless of size, and ensuring that timely action is taken against cyberattackers.

57. How the Next U.S. President Can Contain China in Cyberspace

When transition planning gets underway in earnest this fall, one of the hardest memos to write will be the outbrief from the current National Security Council (NSC) team on what to do about China’s ongoing campaign of cyber espionage targeting the intellectual property of U.S. companies. While long a focus of both the president’s cyber and China teams, there is little chance that in the coming months the issue is going to be brought to any type of resolution. Instead, the next president will inherit a partially implemented plan that has produced positive results in the short term, but its long-term sustainability remains uncertain. He or she would be wise to follow the playbook left by the Obama administration, with a redoubled focus on the investigation and prosecution of cybercrime. Critics of the administration on this topic generally fall into two camps. One, summed up nicely by the title of a book by Peter Kiernan, is the Becoming China’s Bitch camp.[1] In this view, the United States is so dependent on China that the Chinese can do what they want and there is little Americans can do to stop them. They hold U.S. debt, Americans can’t manufacture anything without them, Chinese students are leaps and bounds smarter than American students, and there are millions more of them studying science and math. The Chinese are strategic, looking around the corner of history and shaping it in their interests. They are playing three-dimensional chess and President Obama has been playing checkers. They put the blame on what they would characterize as Obama’s willingness to “lead from behind.” They then quote Sun Tzu, reference Unrestricted Warfare, and drop the mic.[2] The second view is the Coming Collapse of China camp.[3] In this view, despite an aggressive anti-corruption campaign and a more assertive foreign policy, China is weak, wounded, and dangerous. The Communist Party made a deal with the devil, offering economic growth in exchange for loyalty to the regime. Now, the leadership can’t keep up with their end of the bargain. Growth is slowing, and at a faster pace than the official figures acknowledge. Over investment continues and economic reforms have stalled. Air and water pollution are a drag on the economy and a threat to citizen health. Paranoid about any dissent, the party has tightened restrictions on the Internet and the media and arrested feminists, civil rights activists, and lawyers. One spark could start protests that lead to widespread instability and perhaps the end of Communist Party rule. What’s interesting is that these divergent views of China’s place in the world similarly predict there is little chance that China will cease stealing intellectual property. In the first view, China holds all the cards, and there is simply nothing the United States can do to impose costs and stop the hacking of companies. If China is desperate and dangerous, then it can’t stop stealing technology and business secrets because they are needed to fuel the economy.

At the workshop entitled “Chinese Investment in Critical U.S. Technology: Risks to U.S. Security Interests,” held in San Francisco, on July 18, 2017, CFR convened nearly thirty current and former government officials, academics, bankers, investors, and corporate executives to explore whether the large and growing early-stage Chinese investment in critical U.S. technology poses a threat to U.S. national security, and, if so, to outline policies that mitigate the risks of unbridled Chinese investment and to bolster U.S. competitiveness.

In May 2014, the United States Department of Justice (DOJ) announced indictments against five Chinese People’s Liberation Army (PLA) officers on charges of cyber espionage directed against U.S. firms. According to the indictments, the five officers were assigned to the Third Office of the PLA General Staff Department (GSD) Technical Reconnaissance Department (alternatively known as the Third Department) Second Bureau. While assigned personnel may well engage in cyber espionage, a survey of Second Bureau infrastructure indicates a much broader communications intelligence mission.
