- This report will first describe the present status of Kosovo, and then review relevant considerations of its future status, on the one hand focussing on international law – the de jure status, and on the other hand focussing on sustainability – the de facto stat us. This approach of de jure versus de facto is primarily an analytical tool, chosen because it sheds light on a number of considerations relevant to the negotiation process that will determine the future status of Kosovo. Second, this approach reflects the fact that while the Kosovo Albanian s want maximum self-determination, they realize that they are dependent on international assistance. In contrast, the Serbs believe that international legal considerations of a conservative or conservationist nature are essential, but they admit that they cannot take responsibility for Kosovo's security or economy. To put it briefly, the Albanians want independence de jure but not de facto, while the Serbs want independence de facto but not de jure.

53. The Role of Competitiveness for Stability in South East Europe

- The Stabilization and Association Process (SAP) was initiated by the EU for countries not covered by European agreements, i.e. Albania, Bosnia and Herzegovina, Croatia, Macedonia and Serbia and Montenegro. The process is realized through Stabilization and Association Agreements (S AA) that the EU already concluded with Croatia and Macedonia, which have important implications for international trade and investment. The SAAs focus on respect for democratic principles and strengthening links of the countries of the region with the single market. They foresee the establishment of a free trade area with the EU and set out rights and obligations in areas such as competition and state aid rules, intellectual property and rights of establishment, which will allow the economies of the region to begin to integrate with the EU. Therefore, the SAP should be regarded as a tool for integration of the countries of South-East Europe into the emerging pan-European free trade area, resulting in removals of trade barriers between all countries that are gaining associate membership status. It should be regarded as a process of transformation of small, closed national economies to countries integrated in a wide area of free movement of goods, services and investment.

54. Labour Markets and Employment Development in South East Europe

- In contrast to the Central European transition countries, the economies of South East Europe (SEE) have been facing complex and interrelated political and economic problems. The dis solution of Yugoslavia combined with market losses, war in Bosnia and Herzegovina and Croatia, sanctions finally culminating in the Kosovo conflict were the main causes of political and economic instability in the whole region. Taking into account these factors, output recovery has been much slower in SEE than in the Central European countries. Measured in purchasing power standards, Croatia is the best per former in the region, with its GDP at about 38% of the EU average. Next comes Bulgaria (32%), whereas the respective values f or Serbia and Montenegro and Albania range between 15-17%. Looking at the economic performance in the 1990-2002 period, Croatia and Romania reached almost 94% of their pre-transitional level in 2002, followed by Bulgaria and Macedonia (about 88% each). Serbia and Montenegro, the worst-affected, reached only about half of what it was in 1990. The cumulative output decline there was one of the largest among all the Central and East European countries.

- In politics and policies, Serbia increasingly resembles the Milosevic-era without Milosevic. Its reaction to the catastrophic mid-March 2004 near collapse of the UN mission in Kosovo (UNMIK), the strong showing by ultra-nationalists in the 28 December 2003 parliamentary elections and the subsequent two-months of squabbling before democratic parties could form a minority government that depends for survival on the support of Milosevic's old party all are signs that more trouble lies ahead. In 2004 Serbia can anticipate continued political instability, increasingly strained relations with the West and further economic decline. The spasm of ethnic cleansing of Serbs by Albanians in Kosovo has raised the prospect of Kosovo partition, strengthened the nationalist right wing and increased anti-Western sentiment. Instability and economic weakness could hasten moves by Montenegro towards independence, while Kosovo tensions could spill over into the Presevo valley, Sandzak and even Vojvodina.

56. Collapse In Kosovo

- On 17 March 2004, the unstable foundations of four and a half years of gradual progress in Kosovo buckled and gave way. Within hours the province was immersed in anti-Serb and anti-UN rioting and had regressed to levels of violence not seen since 1999. By 18 March the violence mutated into the ethnic cleansing of entire minority villages and neighbourhoods. The mobs of Albanian youths, extremists and criminals exposed the UN Mission in Kosovo (UNMIK) and the NATO-led peacekeeping force (KFOR) as very weak. Kosovo's provisional institutions of self-government (PISG), media and civil society afforded the rioters licence for mayhem. The international community urgently needs new policies -- on final status and socio-economic development alike -- or Kosovo instability may infect the entire region.

The document will serve as a framework for the South Eastern Europe Clearinghouse for the Control of Small Arms and Light Weapons (SEESAC) to guide the development and implementation of CBP in the region. It will also form part of a set of tools that the UNDP Bureau for Crisis Prevention and Recovery (BCPR) is producing. The second phase of this work will provide an operational framework for the UNDP Country Office in Albania for implementing CBP in Albania.

- The Small Arms and Light Weapons Control (SALWC) project was undertaken in 2002-2003 by UNDP in co-operation with the Albanian government, at a programme cost to the international community of US$ 3.47.8 million. Its objectives were to help remove illegally held weapons and explosives from the population, to make the population more aware of the dangers of the illegal possession of such items and to enhance the ability of the authorities to control the private possession of arms and ammunition.

60. Cross Border Trafficking in South Eastern Europe - Assessing Trafficking Activities in the Southern Adriatic Region

- This study was commissioned by the South Eastern Europe Clearinghouse for the Control of Small Arms and Light Weapons (SEESAC). The purpose of the Ammunition Detection Study is to determine if there is evidence to support the SEESAC hypothesis that it may be more productive to specifically target the detection of ammunition for Small Arms and Light Weapons rather than the weapons themselves. SEESAC is a developing organisation, with a responsibility to identify information on the precise level of smuggling activity and also advise on measures to reduce cross border trafficking; clearly current search methodologies used to detect weapons and ammunition within the region are an important component of this advice. Following discussions with the SEESAC Team Leader a set of assumptions, to support the Terms of Reference (TOR), were agreed.Initial desktop research examined weapons and ammunition design and manufacture to determine if and why weapons can be more easily concealed than ammunition and what constituent parts are common or exclusive to one particular commodity. Further analysis was conducted to determine if ammunition and weapons are consistently transported together and examples of occurrences are provided. The investigation has involved visits to specialist organisations and national security agencies that have undertaken to provide data on suitable search and detection methodologies.
