Abstract:
On 21 March, 2018, 44 African heads of state and government dignitaries signed a historic African Continental Free Trade Agreement (AfCFTA) at the 10th Ordinary Session of African Union (AU) Heads of State Summit held in Kigali, Rwanda. The AfCFTA is the largest free trade area since the World Trade Organization (WTO) was established in 1995. The Session was under the theme: “Creating One African Market,” and falls under AU’s Agenda 2063 Initiative. The AfCFTA is also one of the biggest free-trade areas with regards to the number of countries, thus, encompassing 1.2 billion people with over $4 trillion in combined consumer and business spending should the remaining 11 AU member countries join the Agreement (Signe, 2018). The AfCFTA would additionally become effective 30 days subsequent to ratification by the legislative houses of at least 22 African countries; countries that signed the Agreement have 120 days for its ratification. This paper seeks to outline the significance of the Agreement, its aims, challenges and the continuous work needed to sustain it going forward with potential impact it may have on third country agreements with AU member countries.

12. Spotlight on Africa | The South Sudan Conflict – 2018 Khartoum Peace Agreement

Abstract:
On 27 June 2018, South Sudan’s main belligerents inked a peace deal that aims to set the country on a path to normalcy from it over half decade of conflict. The deal was reached at the backdrop of a two-day talks between President Salva Kiir and ‘rebel leader’, Riek Machar, former Vice President of South Sudan. The Khartoum talks were mediated by President Omar al-Bashir of Sudan and President Yoweri Museveni of Uganda on behalf of the Inter-Governmental Authority on Development (IGAD)2 . The announcement of the deal came both as a surprise and relief – surprise because only a week prior to this deal, the warring parties had stalemated a peace pact intended to resurrect an earlier peace deal signed in 2015. In fact the leading figures, both Kiir and Machar had summarily not only rejected that deal but also the notion of even working together, the deal came as a relief in certain quarters cognizance of the 30 June deadline set by the UN Security Council after which sanctions on South Sudan would be renewed.

13. The Impact of Trade Liberalization in Africa

Abstract:
Africa is one of the most economic-integrated continents by a number of regional trade agreements in the continent. There are about 30 bilateral and multilateral trade agreements within the continents so that each African coun-try is a member of at least one regional trade agreement. Trade between Afri-can countries, however, barely exceeds 10% of the total trade of Africa, which is much lower than other continents’ intra-regional trade share. This discrepancy between many regional trade agreements and small intra-continent trade share tells that regional economic integrations in Africa are very unsuccessful trade liberalization policies to promote trade. This paper examines a reason why trade liberalization policies in Africa fail. In particular, we investigate the impact of trade agreements in Africa on trade conditional on financial market development and political instability. An empirical study finds that Africa countries’ poor financial market accessibility and political instability are key barriers to trade integration in the region. These two factors can explain most disadvantage of African countries in their intra-regional trade. In a dynamic regression, the two factors depress the long-run growth of trade due to trade liberalization in the region significantly, while African continent dummy variable that captures other unobserved trade obstacles in the region has much less effect on trade compared to the literature on African regional economic integration.

14. Zambia’s Bilateral Investment Treaties Review and Evaluation

Abstract:
Zambia attracts foreign direct investments (FDI) from many countries that vary in terms of income levels and geographical location. In the last two decades, the country witnessed a rapid increase in bilateral investment treaty (BIT) activities triggered by massive economic liberalisation of the early 1990s. From a single ratified BIT with Germany prior to 1990, there are now 31 BITs locally called Investment Promotion and Protection Agreements (IPPAs) of which two (2) are ratified, eleven (11) are signed and eighteen (18) exist in draft form. However, BIT activities in Zambia have plummeted in line with a post 2010 global slowdown, a situation linked to rising uncertainty caused by a surge in the number of investment treaty-based cases at international tribunals. Foreign investors are suing host states over disputes ranging from direct expropriation to claims of adverse business regulation especially in the energy and extractives sectors. This study reviews Zambia’s BITs and evaluates their impact on the accumulation of FDI stocks using data collected from the Private Investment and Investor Perception Surveys conducted by Bank of Zambia, Central Statistical Office and Zambia Development Agency for the period 2007-2014 were data is publicly available. The findings show that BITs significantly matter for accumulation of FDI stocks in Zambia. The group of countries with a ratified BIT (Germany and Switzerland) maintain 1.6 times more FDI stocks than the corresponding group with only signed BITs controlling for income groups and geographical location and their interactions based on the World Bank classification. The groups of countries with a draft or without a BIT maintain FDI stocks that are less than four times lower than FDI stocks maintained by the group of ratified BITs countries. This evidence is robust to several potential confounders of the relationship between BITs and FDI stocks. Therefore, ratified BITs work for Zambia’s FDI stocks, a result that challenges some pessimism against IPPAs in Zambia.

The European Union (EU) has been a fundamental actor in the economic and political relations with the African countries. EU’s foreign policy towards Africa has been particularly affected by French and British colonial past. The history of the economic relations between the European Economic Community (EEC) and the African continent has been shaped by a series of multilateral agreements – the Yaoundé Conventions, adopted under French influence, and the Lomé Conventions, starting on 1975 –, and, with the entry of the UK in the EEC (1973), the community had to renegotiate the ancient commercial agreements to incorporate the former British territories as “beneficiaries” of these agreements

16. South Sudan Keeping Faith with the IGAD Peace Process

Abstract:
For more than eighteen months, the Intergovernmental Authority on Development (IGAD), the regional body mediating peace negotiations to end South Sudan’s civil war, has struggled to secure a deal in the face of deep regional divisions and the parties’ truculence. To overcome these challenges, it announced a revised, expanded mediation – “IGAD-PLUS” – including the African Union (AU), UN, China, U.S., UK, European Union (EU), Norway and the IGAD Partners Forum (IPF). The initiative is designed to present a united international front behind IGAD to the warring sides but so far it has failed to gain necessary backing from the wider international community, much of which is disillusioned with both IGAD and the South Sudanese. Rather than distance itself from IGAD, the international community needs to support a realistic, regionally-centred strategy to end the war, underpinned by coordinated threats and inducements. Supporting IGAD-PLUS’ efforts to get the parties’ agreement on a final peace deal in the coming weeks is the best – if imperfect – chance to end the conflict and prevent further regionalisation.

Alors que le Nord du Mali connait un inquiétant regain de violence, les négociations de paix à Alger constituent une chance unique de sortie de crise. Mais après deux mois de discussions, la paix semble encore loin. Le gouvernement malien et les groupes armés engagés dans les négociations peinent à trouver un terrain d'entente. Des groupes influents et radicaux qui manquent à la table des négociations sont tentés de faire dérailler le processus par la violence. La résolution du conflit passe par l'articulation complexe d'intérêts divergents qui touchent à la sécurité du Sahara, à la nature de l'Etat malien et aux équilibres locaux entre des communautés divisées. Face aux affrontements armés, la tentation est grande d'aller vite et de signer un accord à minima garantissant la sécurité à court terme. La précipitation est mauvaise conseillère. Il faut se donner les moyens et le temps de construire les fondements d'une paix durable.

Abstract:
Violent conflict and the power of armed nonstate actors remain defining priorities in 21 st century Africa. Organized violence has killed millions and displaced many more, leaving them to run the gauntlet of violence, disease, and malnutrition. Such violence has also traumatized a generation of children and young adults, broken bonds of trust and authority structures among and across local communities, shattered education and healthcare systems, disrupted transportation routes and infrastructure, and done untold damage to the continent's ecology from its land and waterways to its flora and fauna. In financial terms, the direct and indirect cost of conflicts in Africa since 2000 has been estimated to be nearly $900 billion. The twin policy challenges are to promote conflict resolution processes and to identify who can stand up to armed nonstate actors when the host government's security forces prove inadequate.

Abstract:
Proponents tend to argue that bilateral investment treaties (BITs) encourage investment and strengthen the rule of law particularly in jurisdictions where court systems are weak or biased against foreigners. This premise is contested. First, studies on BITs and FDI suggest the relationship is, at best, ambiguous and that BITs are neither necessary nor sufficient to attract FDI. Indeed, South Africa receives FDI from investors in countries with whom it has no BIT and often little or no FDI from others where a BIT was in place.

Abstract:
The birth of the African Union (AU) a decade ago coincided with the birth of what has been termed the African Renaissance. This encompasses Africa's resolve to challenge the normative analysis, the stereotypes and the criticisms that the world has imposed on it. It involves a determination to take control of its destiny, to develop authentic solutions, and to stand up and be counted. Fortunately such a development is provided for in Chapter VIII of the United Nations (UN) Charter, and is also acknowledged in Article 12 of the treaty by which the North Atlantic Treaty Organization (NATO) was founded - both of which recognize universal as well as regional jurisdictions.
