Abstract:
After years of conflict and instability, Somalia is entering a period where transitional justice is possible. Three decades of experience in Africa shows that transitional justice processes are more likely to be effective if they are rooted in popular participation, particularly of victims/survivors and communities affected by violence. While the Somali government has not yet launched a truth commission, prosecutions, reparations or other formal mechanisms usually associated with dealing with the past, different types of measures have emerged in the country that are precursors to – or even themselves forms of – transitional justice. Drawing lessons from formal, state-led measures like the National Reconciliation Framework and non-formal, civil society-led measures like the Peace and Development Forum, this policy brief provides actionable guidance for the Ministry of Interior, Federal Affairs and Reconciliation and the Interior Ministries of federal member states on how to enable popular participation for a locally relevant and sustainable national transitional justice process.

Abstract:
The government of Gambia has committed to implementing the recommendations of the Truth, Reconciliation, and Reparations Commission (TRRC) through further transitional justice measures. Three decades of experience in Africa show that a transitional justice process as a whole is more likely to be effective if it is rooted in popular participation, particularly of victims/survivors and communities affected by violence. This policy brief is written for the Steering Committee leading the implementation process and for the Ministry of Justice and other government ministries and agencies supporting implementation efforts. The brief provides actionable guidance on how to ensure post-TRRC transitional justice measures – including reparations, justice and accountability, and institutional reforms – are inclusive and participatory. In line with the African Union Transitional Justice Policy, the brief emphasizes the value of both formal, state-run measures and non-formal, civil society-led measures, especially in combination. It is based on lessons from the TRRC's efforts to promote participation, as well as those of non-formal measures like the Listening Circles created by Women in Liberation and Leadership.

Abstract:
This research report examines the level of popular participation in The Gambia's transitional justice process to date and provides recommendations for ensuring more meaningful participation going forward. It begins with an overview of both formal and non-formal measures in The Gambia, before analyzing in detail the dynamics of participation in the formal measure of the Truth, Reconciliation, and Reparations Commission (TRRC) and in non-formal measures, particularly Listening Circles established by Women in Liberation and Leadership. The study finds that while the TRRC sought to ensure broad-based participation and to gather evidence from a range of victims/survivors and perpetrators, it fell short in areas like sexual and gender-based violence. The sensitive nature of such crimes in the context of existing socio-cultural norms and practices hindered victims/survivors from approaching the commission. Additionally, the TRRC struggled to reach communities where Jammeh has strong support, with the commission being construed as part of a political agenda. Non-formal measures, run by civil society, filled some of the TRRC's gaps and contributed to wider participation of citizens in the process. To promote more meaningful participation in and across both formal and non-formal measures, we provide actionable recommendations for state actors, particularly state representatives on the Steering Committee leading the TRRC recommendations implementation process and the Ministry of Justice and other government ministries and agencies supporting implementation efforts. We also provide recommendations for multilateral actors supporting transitional justice in The Gambia, including international and regional organizations such as the African Union and the United Nations, state donor bodies, private foundations, and international nongovernmental organizations.

Abstract:
How do we repair and reconcile a society broken multiple times by years of political violence and cyclic mass atrocity events? Reconciliation processes in post-conflict societies tend to favour state-led peace processes to aid individuals and communities alike to heal, make sense of the past while also imagining and forging an interdependent future together. The Burundi Truth and Reconciliation Commission (TRC), established in 2014, has the mandate to investigate past crimes and mass violence events dating from 1885 to the 4 December 2008 ceasefire with the aim of aiding truth-telling, reconciliation and transitional justice. The paper comments on how the TRC shapes ongoing healing, reconciliation and transitional justice efforts in post-conflict Burundi. This paper uses desk-based research to draw insights from documented works and reports of the TRC between 2018 and 2022. The TRC’s findings sparked multiple narratives and public discourse in the Senate which further led to the re-examination of the 1972‒1973 massacre, the legacy of colonisation and its impact in cementing ethnic divisions that led to cyclic mass violence in Burundi.

Abstract:
This paper analyses the historical role of traditional healers (n’anga/chiremba) in conflict resolution in Zimbabwe. Historically, traditional healers occupied a powerful position in Zimbabwean society. Not only were they healers but they also handled social problems and contributed to peace and reconciliation. However, colonial rule in Zimbabwe (1890‒1980) ushered in a spirited challenge to the authority of traditional healers. They were ridiculed as fraudsters who perpetuated unfounded superstitions. Colonial legal and justice systems replaced traditional conflict resolution institutions that had been manned by traditional healers. Nonetheless, traditional healers continued to exist underground. Notwithstanding that, their role and contribution to peacebuilding remains on the fringe of academic inquiry. The key question that this paper addresses is how and under what conditions traditional healers contributed to conflict resolution at the grassroots level. The paper focuses mostly on records of conflict and violence in court cases, underscoring how witnesses’ evidence brought attention to the role of traditional healers in reconciliation. It demonstrates the various contexts in which traditional healers’ interventions were alluded to but ignored in the state’s attempts to administer justice. By digging up obscured and misrepresented evidence of traditional healers’ practices in conflict resolution in the colonial archive and in-depth interviews, we unravel this understated but most crucial element in the process of conflict resolution in Zimbabwe since 1890.

6. Nation building in post-conflict settings: Evidence from South Africa

How do states rebuild nations after a major conflict? Truth and Reconciliation Commissions (TRCs) have emerged as one of the most common interventions to achieve this objective. Despite their popularity, little is known about their efficacy to foster reconciliation and nation building. We fill this gap by studying the seminal TRC established in South Africa after the end of the Apartheid. To measure exposure to TRC across South African municipalities, we leverage quasi-random variation in media coverage of the TRC message. South African municipalities with higher historical exposure to TRC on media have lower levels of violence today. This effect is driven by improved nation building and higher trust towards post-Apartheid institutions. Exploiting daily variation in TRC hearings and mediatic exposure in the short run, we bolster our interpretation that our long-run results are forged in the years of TRC activity. The same evidence suggests that our results are driven by the coverage of TRC on media as opposed to generic media exposure.

Abstract:
In recent memory, no single year has catapulted Burundi into the spotlight more than the 20151 events when demonstrators and mass protesters took to the streets to protest the third term of then-President Pierre Nkurunziza. In the heat of the violent protests, some senior military officials, along with the police attempted a coup on 13 May 2015. Many in the international community and peacebuilding world feared a full-out civil war and a resurgence in sustained acts of violence that would plunge the country into chaos. They raised concerns that these events would seriously affect the peace gains obtained through the use of hard security approaches, such as the involvement of successive African Union (AU) and United Nations (UN) peacekeeping forces, and soft security approaches, such as reforming the security sector and pursuing lasting peace and reconciliation. Despite a political malaise in the aftermath of 2015, the dire predictions for Burundi did not come to pass. Fast forward to 2023, Burundi is charting a new path for lasting peace through truth-telling, reconciliation and transitional justice following cyclic violent conflicts that have victimised thousands of Burundians. The ongoing peace and reconciliation processes in Burundi have garnered little attention from researchers. Modelled after the South African Truth and Reconciliation Commission (TRC), the Burundi Government instituted a National Truth and Reconciliation Commission (NTRC) in 2014 by presidential decree. Since 2021, the NTRC has carried out investigations into human rights violations committed between 1972 and 1973 and other events surrounding arbitrary arrests, extrajudicial killings, assassinations, and unlawful trials from the 1960s up to 1971.2 In addition to the investigations on the 1960s and early 1970s, the NTRC has the general mandate to investigate all gross human rights violations and war crimes perpetrated between 26 February 1985 and 4 December 2008. The Commission is further tasked with establishing both individual and collective responsibility by ordinary citizens and state actors in mass atrocity events. The creation of the NTRC was met with reservation and mixed views from some in the media and political circles in Burundi who feared the Commission would serve the interests of the ruling political elite and not necessarily lead to truth that unites and reconciles. Due to the political crisis in 2015, the programme of the NTRC was temporarily put to a halt and resumed with sustained momentum in 2018. Ever since, the NTRC has been conducting numerous field trips across the country to uncover the truth and aid individuals and communities alike in healing from the deep wounds of the past. The NTRC was tasked with shedding light on pre-colonial and post-colonial events of political violence and how the successive events have contributed to contemporary socio-political dynamics in Burundi.

Abstract:
This report focuses on the process of corporate redress in response to the Marikana Massacre, which occurred on 16 August 2012. The study sought to examine the various forms of reparations that have been provided to victims by the mining company and to understand this process in the context of other processes of justice and repair to address the consequences of conflict and violence. As such, this report forms part of a broader international study on the role of corporate actors in transitional justice processes.1 The report provides a brief description of the events in Marikana against the backdrop of the history of mining in apartheid South Africa and the subsequent transition to democracy. It frames the causes of the massacre as embedded in the unresolved transition and South Africa’s failure to confront the legacy of exploitation and repression in the mining sector. It also seeks to unpack the various initiatives undertaken in response to the massacre, focusing particularly on the measures to address the needs of injured and arrested mineworkers as well as the families of those who were killed.
