11. Stuck in Crisis: The Humanitarian Response to Sudan’s Health Emergency

Abstract:
Following decades of war, economic decline, and underinvestment, Sudan’s healthcare system entered a new phase of crisis in 2019 as peaceful protests led to the ouster of President Omar al-Bashir. Among those leading these protests were doctors and other medical personnel fed up with poor working conditions and medicine shortages. This speaks to the degraded state of healthcare in the country, particularly in the conflict-affected regions of Darfur, South Kordofan, and Blue Nile. This paper looks at the humanitarian response to health-related needs in these conflict-affected parts of Sudan. After providing an overview of the state of Sudan’s healthcare system, it explores the main trends and challenges in the humanitarian health response, including the difficult partnerships between international and Sudanese health actors, restricted humanitarian access, and the effort to shift toward more sustainable approaches. It concludes that the humanitarian health response in Sudan is stuck: most agree on the need to move beyond short-term approaches, but the national capacity and development funding needed to make this transition are missing. At the same time, with newly accessible areas exposing unmet needs and conflict and displacement ongoing, a robust humanitarian response is still desperately needed. This situation calls for the UN, donors, and health NGOs to continue their efforts to respond to needs while strengthening the healthcare system, to coordinate humanitarian and development funding, and to advocate for maintaining and extending humanitarian access.

12. Basis and Implications of the ICC's Ruling Against Myanmar

n a major decision, the International Criminal Court ruled on September 6, 2018 that the Court may exercise jurisdiction over the crime of alleged deportation of the Rohingyas from Myanmar to Bangladesh. The Pre-Trial Chamber accepted the OTP’s argument that the Court may exercise jurisdiction over the crime of cross border deportation of Rohingyas even though the alleged crime had been committed in Myanmar which is not a State Party. The Pre-Trial Chamber stated that this could be done as some “elements of the crime” had taken place in the territory of Bangladesh, which is a State Party. This judgment makes a towering statement that ICC’s jurisdiction is objective rather than subjective in nature. In this post, I discuss the basis and implications of the Chamber’s findings.

Crises In 2016, global policymakers came together to confront a critical policy dilemma: what is, or should be, the role of humanitarian action in a world beset by “permanent emergencies” that do not end, in which the root causes are overwhelmingly structural and political? One major outcome of the summit was the commitment to a “new way of working” based on linking the “triple nexus” of humanitarian, development, and peacebuilding (HDP) efforts. Our new report shares the results of a major independent review of the implementation of this process.

Abstract:
Nigeria is, arguably, a country under distress. The country’s woes are most evident in the torrential spate of armed violence and criminality in various parts of the country. Nothing explains this awry situation better than the apocalyptically volatile security ambience in the wider northern Nigeria. The northeastern Nigeria is still patently under the Boko Haram scourge, amidst the precarious counter-insurgency endeavors of the government (Okoli 2017a; Zenn 2018). The north-central area has been afflicted by herdsmen militancy, which has plunged the region into dire humanitarian crisis (Okoli and Ogayi 2018). The northwestern region has recently been enmeshed in the rapid upsurge of rural banditry along its international frontiers as well as the forested interior.

Abstract:
The five-year-old civil war in South Sudan is an unparalleled humanitarian and security crisis, causing the largest exodus of refugees on the African continent since the Rwandan genocide and leaving over a third of the population displaced and two-thirds severely food insecure. Beyond the human toll on South Sudan’s long-suffering citizens, the country’s unraveling underscores the shifting political and security fault lines in the Horn of Africa. This Special Report surveys the region’s various interstate hostilities and intrastate conflicts and suggests ways the United States can reassert its influence to begin contributing meaningfully to the resolution of South Sudan’s civil war and conflicts in the greater Red Sea region.

Since the outbreak of civil war in December 2013, South Sudan has endured one of the worst humanitarian crises in modern times. Still, amid the constant threat of war-related violence and economic hardship, South Sudanese activists are managing to launch and sustain nonviolent movements to address the social, political, and economic grievances that have fueled the country’s ongoing conflicts. Based on extensive interviews with South Sudanese civil society leaders, religious leaders, activists, and members of the diaspora, this report focuses on South Sudanese experience using nonviolent tactics and the formidable challenges they face to build large-scale nonviolent civic campaigns and movements to achieve a just and lasting peace.

Abstract:
In some contexts, the global community has resorted to international tribunals to prosecute the most serious past crimes, such as war crimes, crimes against of humanity, and genocide. While these international efforts contributed significantly to international justice, they were resource draining and located outside the countries in which the crimes took place. To overcome these issues, the so-called hybrid court was developed that combines domestic and international law and personnel. Tunisia has adopted a purely domestic hybrid court.

This article considers the relationship between two human rights discourses (and two specific legal regimes): refugee and asylum protection and the evolving body of international law that regulates expulsions and deportations. Legal protections for refugees and asylum seekers are, of course, venerable, well-known, and in many respects still cherished, if challenged and perhaps a bit frail. Anti-deportation discourse is much newer, multifaceted, and evolving. It is in many respects a young work in progress. It has arisen in response to a rising tide of deportations, and the worrisome development of massive, harsh deportation machinery in the United States, Germany, the United Kingdom, France, Mexico, Australia, and South Africa, among others. This article’s main goal is to consider how these two discourses do and might relate to each other. More specifically, it suggests that the development of procedural and substantive rights against removal — as well as rights during and after removal — aids our understanding of the current state and possible future of the refugee protection regime. The article’s basic thesis is this: The global refugee regime, though challenged both theoretically and in practice, must be maintained and strengthened. Its historical focus on developing criteria for admission into safe states, on protections against expulsion (i.e., non-refoulement), and on regimes of temporary protection all remain critically important. However, a focus on other protections for all noncitizens facing deportation is equally important. Deportation has become a major international system that transcends the power of any single nation-state. Its methods have migrated from one regime to another; its size and scope are substantial and expanding; its costs are enormous; and its effects frequently constitute major human rights violations against millions who do not qualify as refugees. In recent years there has been increasing reliance by states on generally applicable deportation systems, led in large measure by the United States’ radical 25 year-plus experiment with large-scale deportation. Europe has also witnessed a rising tide of deportation, some of which has developed in reaction to European asylum practices. Deportation has been facilitated globally (e.g., in Australia) by well-funded, efficient (but relatively little known) intergovernmental idea sharing, training, and cooperation. This global expansion, standardization, and increasing intergovernmental cooperation on deportation has been met by powerful — if in some respects still nascent — human rights responses by activists, courts, some political actors, and scholars. It might seem counterintuitive to think that emerging ideas about deportation protections could help refugees and asylum seekers, as those people by definition often have greater rights protections both in admission and expulsion. However, the emerging anti-deportation discourses should be systematically studied by those interested in the global refugee regime for three basic reasons. First, what Matthew Gibney has described as “the deportation turn” has historically been deeply connected to anxiety about asylum seekers. Although we lack exact figures of the number of asylum seekers who have been subsequently expelled worldwide, there seems little doubt that it has been a significant phenomenon and will be an increasingly important challenge in the future. The two phenomena of refugee/asylum protections and deportation, in short, are now and have long been linked. What has sometimes been gained through the front door, so to speak, may be lost through the back door. Second, current deportation human rights discourses embody creative framing models that might aid constructive critique and reform of the existing refugee protection regime. They tend to be more functionally oriented, less definitional in terms of who warrants protection, and more fluid and transnational. Third, these discourses offer important specific rights protections that could strengthen the refugee and asylum regime, even as we continue to see weakening state support for the basic 1951/1967 protection regime. This is especially true in regard to the extraterritorial scope of the (deporting) state’s obligations post-deportation. This article particularly examines two initiatives in this emerging field: The International Law Commission’s Draft Articles on the Expulsion of Aliens and the draft Declaration on the Rights of Expelled and Deported Persons developed through the Boston College Post-Deportation Human Rights Project (of which the author is a co-director). It compares their provisions to the existing corpus of substantive and procedural protections for refugees relating to expulsion and removal. It concludes with consideration of how these discourses may strengthen protections for refugees while also helping to develop more capacious and protective systems in the future.

The report addresses the micro-level as a key dimension of post-conflict peacebuilding interventions, with a particular focus on the relationships and interactions of international and local actors. What changes do occur with regard to their perceptions, expectations, attitudes and activities in the course of interactions? Can we identify experiences and mechanisms that lead to a re-articulation of relationships and interactions and, consequently, a recalibration of the overall peacebuilding exercise, e.g. with regard to more (or less) cooperation, more (or less) mutual trust, more (or less) animosities and misunderstandings, and more (or less) legitimacy? These questions are addressed through an in-depth case study, at the core of which are narrative, problem-centred interviews with international and local actors who were and/or are engaged in the peacebuilding process on Bougainville. Bougainville is regarded as a kind of ‘laboratory’ in which international/local relations and interactions are rather direct, because national institutions play a relatively small role, and external actors are present upon invitation not only by national, but also local actors. The exploration of the Bougainville case is complemented by a plausibility probe in a case with contrasting conditions, Sierra Leone.

20. Peacebuilding Engagement Activities by Resettled African Refugees: Policy Options

Resettlement of refugees in third countries of asylum is considered both a protection practice and a durable solution to refugee crises, particularly in protracted refugee situations. Unlike most migrants and particularly irregular migrants, refugees receive protection from their host country, and the road towards citizenship is chartered prior to their arrival. Additionally, policies are in place to facilitate their integration into host societies. For host states located in the global North, resettlement is not just a humanitarian policy, but also includes strategic access to direct and indirect benefits other than those accruing to the resettled refugees. Such benefits may apply to other refugees, the host state, other states, or the international protection regime. Many analysts tend to overlook the strategic use of resettlement as a peacebuilding tool. Recent research findings from Africa and Central America demonstrate refugees’ capacity to contribute to peacebuilding in diverse ways including enhancement of safety and security; participation in political processes; and revitalization of economic, justice, and reconciliation systems.1 The findings also show that the ability of refugees to engage in peacebuilding is often determined by asylum policies of host states and the willingness of peacebuilding actors to engage non-state actors outside of the country where the peace is being built. This policy brief draws attention to some of the peacebuilding engagement activities of African resettled refugees in the global North. It notes that the resettlement of refugees provides host states with the opportunity to fulfill their mandates of the shared responsibility of protection and peacebuilding, without falling into the traps of imposition and interference.
