Abstract:
In spite of the Haitian government's stated priority of improving rule of law, a Haitian court's decision not to prosecute former dictator Jean-Claude Duvalier for crimes against humanity has cast doubt on the sincerity of that commitment. The failings of Haiti's judicial system are well-known, but historically reform efforts have been ineffective. Improved provision of justice is critical for the creation of conditions for stability and the eventual withdrawal of the United Nations Stabilization Mission in Haiti (MINUSTAH). Modernizing Haiti's antiquated legal and penal codes are an essential component of rule of law reform. Some progress is being made toward this end. A greater emphasis is needed on coordinating efforts among international donors and improving interaction with Haitian counterparts to achieve progress on judicial reform.

13. Political Trends in the African Great Lakes Region

Abstract:
Despite recent elections in Burundi, Rwanda, and Uganda and upcoming elections in the Democratic Republic of Congo (DRC), the Great Lakes region shows worrying trends toward electoral authoritarianism and political fragmentation, with new divisions that intensify the potential for confrontation. A shrinking political space and a tight grip on the state by the ruling elites and their parties are signs of authoritarianism in the region—a cause of concern since armed conflict in all four countries has been strongly linked to a history of exclusion under autocratic regimes. New divisions beyond previous alignments in armed conflicts also have occurred and already led to serious confrontations, flight, and at times violence. An increasing political fragmentation has become visible, and splits embroil intraparty conflicts in the political landscape instead of resolving them. The two trends—electoral authoritarianism and political fragmentation—are mutually reinforcing within and across the countries of the region and risk jeopardizing economic and social progress in Uganda and Rwanda as well as an emerging vibrant civil society in Burundi and the DRC. In light of the history of conflict and autocratic regimes in the region, these trends have to be a serious concern for local and international actors. The preference for stable leadership, economic performance, and security considerations regardless of political conduct has been a fatal miscalculation before in the Great Lakes region. Rather, acting early and using pressure constructively, the international community should do what it can to support a more open and less fragmented political sphere in the Great Lakes countries.

14. International Engagement with Somalia

Abstract:
The Ethiopian invasion of Somalia in 2006, supported by the U.S, had the unintentional consequence of fueling splinter insurgent groups including Al-Shabab and Hizbul Islam. Currently Somalia faces a humanitarian crisis with 3.6 million people displaced. Countering the insurgency and alleviating the humanitarian crisis in Somalia demands a creative rethinking of international policy. While the 2008 Dijbouti Accord created a more inclusive Transitional Federal Government (TFG), the international community must weigh whether continued support for the TFG will bring real progress in governance or if it will strengthen popular support for the insurgency. If the international community sees support for the TFG as beneficial, they could consider policies including: Flooding Somalia with development aid and investing in civil society; Expanding the African Union (AU) peacekeeping mission to include representation from other Muslim countries; Finding creative solutions for inter-Somali governance and reconciliation. If the international community calculates that support for the TFG is not beneficial because it will only fuel the insurgency, they should consider a policy of "constructive disengagement," withdrawing support from the TFG and the AU peacekeeping mission, while simultaneously investing in local and regional development projects.

Abstract:
Zimbabwe's coalition government is increasingly dysfunctional, mainly due to a defeated incumbent ruler's unwillingness to surrender real executive authority to a popular opposition. The latest dispute over the president's unilateral exercise of appointment powers threatens to escalate into a constitutional crisis that seems likely to be resolved only through fresh elections. International actors can help to bring Zimbabwe's transition to a peaceful and democratic conclusion by guaranteeing power sharing, supervising elections, and maintaining targeted sanctions.

Post-conflict, post-totalitarian societies like Iraq possess many economic, political, social, and cultural characteristics that are not conducive to democratic governance. A central pillar of democracy promotion is that judicious institutional engineering—crafting new institutions and other elements outlining the democratic rules of the game—can overcome these obstacles and engender stable democracies.
