- R2P, like all norms, is bound to see its capacity to deliver on its intended goals tested by real experience. Ever since R2P was endorsed by member states at the United Nations General Assembly in 2005, a number of cases have helped define the boundaries of its application. Well before Libya, R2P had already made a discrete difference in a number of cases: from the most cited example of the political and diplomatic response to the outbreak of ethnic violence in Kenya in early 2008; to the patchy response to signs of ethnic cleansing in Kyrgyzstan in the summer of 2010; to the more forceful regional and international efforts in Guinea at the end of that year.

- Strong support for the Responsibility to Protect (R2P) populations from genocide, war crimes, crimes against humanity and ethnic cleansing was clearly evident at the opening of the 66th United Nations (UN) General Assembly between 21 and 27 September 2011. From the Secretary-General's reference to R2P as a priority for his second term, to the re-affirmation of government support for the norm in opening statements and the holding of a Ministerial meeting on R2P, clear consensus exists about the critical importance of R2P. At a moment when some were anticipating a backlash in the aftermath of the Security Council authorized civilian protection operation in Libya, the opening of the General Assembly reaffirmed that the imperative today is for states to work together to operationalize R2P.

- Over the course of the past forty years, waves of interethnic conflict in Burundi have killed hundreds of thousands of people and displaced over a million more. In 1993 the assassination of Melchior Ndadaye, the country's first Hutu president, by paratroopers from Burundi's Tutsi dominated armed forces, set off another round of violence with Hutu militias attacking Tutsi civilians and the armed forces retaliating by attacking Hutu communities. The situation ultimately devolved into a civil war that lasted for more than ten years.

- Starting in mid-2003, the government of Sudan responded to an armed rebellion in the western state of Darfur with a massive campaign of killing and expulsion carried out both by regular army troops and by a proxy force known as the Janjaweed. United Nations (UN) sources estimate that this orchestrated effort led to the death of at least 300,000 people, while over two million were forcibly displaced. Extensive documentation by the UN, human-rights organizations and the media leaves no doubt that the Sudanese government and the Janjaweed committed war crimes and crimes against humanity, and did so over a period of many years. Yet all attempts to stop the killing, whether by neighbors, regional organizations, Western states or the UN Security Council, proved ineffective. In 2005, states-including Sudan-unanimously agreed that they had a responsibility to protect populations from mass atrocities; but this abstract commitment has had little effect on the Sudanese government or on other UN member states who had made this pledge.

86. The Responsibility to Protect and Kenya: Past Successes and Current Challenges

- Abstract:
- The passing of the 4 August constitutional referendum in Kenya is a promising sign in the broader context of efforts to prevent atrocities and uphold the responsibility to protect (R2P). The peaceful referendum sharply contrasts with the wave of violence that erupted in the wake of the disputed December 2007 presidential election, when within hours of the announcement of the results violence broke out. Less than two months later 1,133 Kenyans had been murdered, unknown numbers raped, and over 500,000 forcibly driven from their homes. The perpetrators included individuals, militias and the police with victims often targeted on the basis of their ethnicity and corresponding perceived support for a particular presidential candidate.

- The situation in Burma/Myanmar remains grave. With elections scheduled for 7 November 2010 international attention on the country has increased. Such attention, and any policy action taken, must focus not only on the goal of democratic transition, and concerns about the regimes nuclear collaboration with North Korea, but also on the plight of Burma's ethnic minorities who continue to suffer atrocities at the hands of the government. These atrocities may rise to the level of crimes against humanity, war crimes and ethnic cleansing – crimes states committed themselves to protect populations from at the 2005 World Summit, as described in the Global Centre for the Responsibility to Protect policy brief dated 4 March 2010, “Applying the Responsibility to Protect to Burma/Myanmar.”

88. Atrocities in Nigeria's Plateau State and the Responsibility to Protect

- On 7 March 2010, between 1 and 3 am, groups of armed men launched simultaneous attacks on the villages of Dogo Nahauwa, Zot, and Ratsat, in Du District of Jos South Local Government Area, Plateau state, Nigeria. Driven from their homes by the sound of gunfire, villagers were maimed and killed by machete wielding men who also set homes on fire, displacing the survivors.

- The Burmese junta, its armed forces known as the “Tatmadaw,” and other armed groups under government control are committing gross human rights violations against ethnic and religious minorities. Extrajudicial killings, torture, and forced labor are prevalent; rape and sexual abuse by the Tatmadaw are rampant; and from August 2008 through July 2009 alone, 75,000 civilians in the east, where armed conflict is ongoing, were forcibly displaced. The Tatmadaw shows a complete disregard for the principle of distinction, intentionally targeting civilians with impunity.

90. The International Response to 28 September 2009 Massacre in Guinea and the Responsibility to Protect

- On 28 September 2009, government forces opened fire on opposition supporters peacefully protesting in a stadium in Conakry, Guinea. Demonstrators had gathered to contest junta leader Captain Dadis Camara's reported intention to run in the January 2010 elections, and break his promise to cede power to civilian rule. Over 150 civilians were killed in attacks that Human Rights Watch reports were premeditated and that the United Nations Commission of Inquiry concluded amounted to crimes against humanity. Over 1,200 people were injured, rape and sexual violence was widespread, and unknown numbers of protestors and political opponents were detained.
