621. Liberia: Resurrecting the Justice System

Abstract:
Reform of the justice system needs to be a top priority for Liberia's new government and donors alike. After fourteen years of civil war, the system is in shambles. Impunity prevails, and in this atmosphere, the government cannot adequately address economic governance, transformation of the military and reconstruction of war- scarred physical infrastructure – all primary areas for reform and reconstitution in 2006. Courts that do not prosecute those who siphon resources from government coffers impede progress in all other areas. Within the next six months, stronger and impartial mechanisms are required in both the statutory and customary law systems, and community-based justice programs should be created.

622. Sudan's Comprehensive Peace Agreement: The Long Road Ahead

Abstract:
More than a year after it was signed, Sudan's Comprehensive Peace Agreement (CPA) is showing signs of strain. While the agreement ended one of Africa's longest and bloodiest civil wars, it was an agreement between only two parties, the Sudan People's Liberation Movement/Army (SPLM/A) and the ruling National Congress Party (NCP), and continues to lack broader support throughout the country, particularly in the North. The current equation for peace in Sudan is a worrying one: the NCP has the capacity to implement but lacks the political will, whereas the SPLM has the commitment but is weak and disorganised. There is a real risk of renewed conflict down the road unless the NCP begins to implement the CPA in good faith, and the SPLM becomes a stronger and more effective implementing partner. The international community, which has largely abandoned the political engagement and commitment that was so crucial to achieving the peace agreement in the first place, must forcefully reengage with the process to ensure the agreement's successful implementation.

623. Aceh: Now for the Hard Part

Just past the half-year mark of the agreement to end the conflict in Aceh, several long-anticipated problems are surfacing. None by itself is grave enough to derail the 15 August 2005 accord between the Indonesian government and the Free Aceh Movement (Gerakan Aceh Merdeka, GAM); the peace process remain s very much on track. But their convergence means that more than ever, President Susilo Bambang Yudhoyono and Vice President Jusuf Kalla will have to exert leadership, and international donors will have to constantly assess the political impact of their assistance to prevent any backsliding.

624. Papua: The Dangers of Shutting Down Dialogue

There is serious risk the long-awaited Papuan People's Council (Majelis Rakyat Papua, MRP) is about to collapse, only five months after it was established, ending hopes that it could ease tensions between Papuans and the central government. The MRP was designed as the centrepiece of the autonomy package granted the country's easternmost province in 2001. Almost as soon as it came into being, however, it was faced with two major crises – stalled talks over the legal status of West Irian Jaya, the province carved out of Papua in 2003, and violence sparked by protests over the giant Freeport mine – while Jakarta marginalised its mediation attempts. To revive genuine dialogue and salvage the institution before autonomy is perhaps fatally damaged, President Yudhoyono should meet the MRP in Papua, thus acknowledging its importance, while the MRP should move beyond non-negotiable demands and offer realistic policy options to make autonomy work.

625. Conflict Resolution in the South Caucasus: The EU's Role

Abstract:
Instability in the South Caucasus is a threat to European Union (EU) security. Geographic proximity, energy resources, pipelines and the challenges of international crime and trafficking make stability in the region a clear EU interest. Yet, the unresolved Nagorno-Karabakh, Abkhazian and South Ossetian conflicts have the potential to ignite into full-fledged wars in Europe's neighbourhood. To guarantee its own security, the EU should become more engaged in efforts to resolve the three disputes. It can do so by strengthening the conflict resolution dimension of the instruments it applies. As the EU is unlikely to offer membership to Georgia, Armenia and Azerbaijan even in the medium term, it must identify innovative means to impose conditionality on its aid and demonstrate influence. This is a challenge that Brussels has only begun to address.

626. To Save Darfur

Abstract:
The international strategy for dealing with the Darfur crisis primarily through the small (7,000 troops) African Union Mission in Sudan (AMIS) is at a dead end. AMIS credibility is at an all-time low, with the ceasefire it could never monitor properly in tatters. In the face of this, the international community is backing away from meaningful action. The African Union (AU) yielded to Khartoum's pressure on 10 March 2006 and did not ask the UN to put into Darfur the stronger international force that is needed. If the tragedy of the past three years is not to be compounded, the AU and its partners must address the growing regional crisis by getting more troops with greater mobility and firepower on the ground at once and rapidly transforming AMIS into a larger, stronger UN peacekeeping mission with a robust mandate focused on civilian protection.

627. Pakistan: Political Impact of the Earthquake

Abstract:
The Pakistan government's ill-planned and poorly executed emergency response to the October 2005 earthquake highlighted the inadequacies of authoritarian rule. As the government now embarks on three to four years of reconstruction and rehabilitation, the absence of civilian oversight and inadequate accountability and transparency could seriously undermine the process. Should jihadi groups that have been active in relief work remain as involved in reconstruction, threats to domestic and regional security will increase.

628. Colombia: Towards Peace and Justice?

Abstract:
How Colombia implements its controversial new legal framework for demobilising the far-right paramilitaries and returning them to society is critically important. It can either take a decisive step towards ending its 40-year armed conflict or see prolongation of violence and the rise of an ever more serious threat to its democracy. Most paramilitaries have turned themselves in but the Justice and Peace Law (JPL) – criticised by human rights groups when enacted in July 2005 – has still not been applied. There is concern the Uribe administration prioritises quick fix removal of the paramilitaries from the conflict at the cost of justice for victims and the risk of leaving paramilitary economic and political power structures largely untouched. International support for JPL implementation should be conditioned on a serious government strategy to apply the new framework, as well as steps by President Uribe to contest paramilitary efforts to keep their crime (including drug) fiefdoms and build their political power.

La France a un problème avec ses musulmans, mais ce n'est pas celui qu'elle croit. L'embrasement des banlieues d'octobre-novembre 2005 ainsi que la vague d'arrestations dans les milieux jihadistes ont ramené l'Islam au centre des préoccupations françaises et ont donné du souffle à ceux qui brandissent la me nace d'un monde musulman s'organisant à partir de l'islamisme politique. Pourtant, c'est tout le contraire: paradoxalement, c'est l'essoufflement de l'islamisme politique plus que sa radicalisation qui explique les violences à prédominance musulmane et c'est la dépolitisation des jeunes musulmans bien plus que leur prétendue re-communautarisation sur des bases radicales qui de vrait inquiéter. Afin de minimiser les risques de l'émeute et du militantisme jihadiste, il faudrait à la fois s'attaquer aux problèmes socio-économiques dont souffren t les cités, réduire les violences qui s'exercent contre elles, et favoriser la participation politique de ceux qui y résident.

630. The Cyprus Stalemate: What Next?

Abstract:
The last round of Cyprus's drawn-out peace process ended in April 2004 when the Greek Cypriot community, which had long advocated reunification of the divided island on a bicommunal and bizonal basis, overwhelmingly rejected the UN-sponsored “Annan Plan”, which provided for just that. At the same time on the northern side of the Green Line, the Turkish Cypriot community, in a major reversal of its traditional preference for secession, backed reunification. The failure of the referendum did not stop a still-divided Cyprus being admitted to membership of the EU a week later. Notwithstanding clear continuing support for the Annan Plan, or some variation of it, among all other members of the EU and the wider international community, the present situation remains stalemated.
