341. The Myanmar Elections

Abstract:
Myanmar will shortly hold its first elections in twenty years. Given the restrictive provisions of the 2010 Political Parties Registration Law that bar anyone serving a prison term from membership in a political party, many imprisoned dissidents will be excluded from the process, unless they are released in the near future. Aung San Suu Kyi – whose suspended sentence and house arrest possibly exclude her also – has condemned the legislation, and her National League for Democracy (NLD) has decided not to participate and has, therefore, lost its status as a legally-registered party. There has rightly been much international criticism of the new constitution and of the fact that the elections will not be inclusive, but the political and generational shift that they will bring about may represent the best opportunity in a generation to influence the future direction of the country.

343. The Rule of Law in Independent Kosovo

More than two years after declaring independence, Kosovo struggles with uneven rule of law and a weak justice system that is failing its citizens. The police, public prosecutors and courts are erratic performers, prone to political interference and abuse of office. Organised crime and corruption are widespread and growing. Realising that prosperity, relations with the European Union (EU) and affirmation as an independent state depend on the rule of law, the government has taken important steps, replacing key officials and passing long-delayed reforms. But critical weaknesses remain, notably in the courts, and the government, supported by the international community, must act swiftly to curtail them.

344. Somalia's Divided Islamists

Abstract:
The growing internal schisms and factionalism within Somalia's Islamist movement risk plunging the country even deeper into violence and bloodshed, with dangerous implications for the wider region and beyond. These divisions are also aggravating the political crisis by polarising groups further along ideological, theological and clan lines. However, a limited opportunity may now exist for Somalia's political actors and the international community to capitalise on these divisions and re-alignments to reach out to the increasing numbers of domestic militants disenchanted with the growing influence of foreign jihadis and extremist elements bent on pursuing a global agenda.

345. Sudan: Regional Perspectives on the Prospect of Southern Independence

South Sudan is just eight months away from a self-determination referendum that will likely result in its secession from the North. Much remains to be done to implement the outstanding elements of Sudan's Comprehensive Peace Agreement (CPA), and time is running out. The agreement's underlying aim of “making unity attractive” has failed, and most Southerners thus appear determined to choose independence. Neighbouring states are increasingly focused on the fragile circumstances in Sudan and the likelihood of a newly independent state in the region. Support from Sudan's neighbours for the referendum process and respect for its result will be crucial to ensuring peace and stability in the country and the region.

346. Timor-Leste: Oecusse and the Indonesian Border

Abstract:
Indonesia and Timor-Leste have done much to normalise relations ten years after the end to Indonesian rule in the former province, but the goodwill between capitals is not yet matched by full cooperation on the border. The costs are greatest in Oecusse, Timor-Leste's isolated enclave inside Indonesian West Timor. Negotiators have so far failed to agree on two segments of Oecusse's border, leaving open the risk that minor local disputes could be politicised and escalate into larger conflicts. Without a final demarcation, steps to improve management of the porous border have stalled. Initiatives that would promote exchanges and lessen the enclave's isolation remain unimplemented. As the bonds between the two nations grow, they should prioritise this unfinished business. Leaving it unresolved can only promote crime, corruption and the possibility of conflict.

347. War Crimes in Sri Lanka

Abstract:
The Sri Lankan security forces and the Liberation Tigers of Tamil Eelam (LTTE) repeatedly violated international humanitarian law during the last five months of their 30-year civil war. Although both sides committed atrocities throughout the many years of conflict, the scale and nature of violations particularly worsened from January 2009 to the government's declaration of victory in May. Evidence gathered by the International Crisis Group suggests that these months saw tens of thousands of Tamil civilian men, women, children and the elderly killed, countless more wounded, and hundreds of thousands deprived of adequate food and medical care, resulting in more deaths.

348. Indonesia: The Dark Side of Jama'ah Ansharut Tauhid (JAT)

Jama'ah Ansharut Tauhid (JAT), led by Indonesia's bestknown radical cleric Abu Bakar Ba'asyir, has been an enigma since its founding in 2008. An ostensibly aboveground organisation, it has embraced individuals with known ties to fugitive extremists. It has welcomed many members of the militant Jema'ah Islamiyah (JI) but clashed with the JI leadership over strategy and tactics. It preaches jihad against Islam's enemies but insists it stays within the law – though it rejects man-made laws as illegitimate. It is a mass membership organisation but wholly dependent on Ba'asyir, without whom it would quickly disintegrate. It has become an important element in the network of Indonesian jihadi groups but has been the target of harsh criticism from some erstwhile allies. Understanding JAT's nature, its many faces and the ideological rifts it has generated helps illuminate the weakness and divisions within the Indonesian jihadi movement today. It also highlights the ongoing but probably diminishing influence of Ba'asyir.

349. Bridging Thailand's Deep Divide

Abstract:
The protracted struggle between the royalist establishment and those allied with ousted Prime Minister Thaksin Shinawatra has left Thailand deeply polarised. It sparked the most violent political confrontations in recent times, killing people, injuring nearly 2,000 and inflicting deep wounds on the national psyche. The government of Abhisit Vejjajiva's unilateral offer of a “road map” to national reconciliation will lead nowhere without the participation of its opposition, including his deposed predecessor. A credible investigation of the violence, enduring legal reforms, and properly addressing societal inequities cannot succeed without the Thaksin-aligned Red Shirt movement. This cannot happen if its leaders are detained, marginalised, or on the run. Fresh elections that are peace­ful, fair and accepted by all sides will be the first test to see if the country is back on track or has lost its way. Thailand should lift the emergency decree imposed over large swathes of the country or risk further damaging its democracy, hindering much needed reconciliation, and sowing the seeds of future deadly conflict.

350. Improving Security Policy in Colombia

Abstract:
President Álvaro Uribe's eight-year military campaign against the Revolutionary Armed Forces of Colombia (FARC) has taken a heavy toll on Colombia's largest insurgent organisation. The government is now working to consolidate security gains by expanding state presence in several of the formerly most conflict-ridden regions. This strategy faces numerous challenges, not least because FARC's command and control structure has not collapsed. The insurgents are adapting to military pressure through guerrilla warfare tactics, aggressive recruitment among rural populations, broadened involvement in drug trafficking and alliances with other armed groups and drug trafficking organisations. Colombia's next president, Juan Manuel Santos, will take office on 7 August. As part of an integrated conflict resolution strategy, his government must increase the country's law enforcement and military capability against all illegal armed groups, including FARC. It also has to strengthen institutions, expand the rule of law, rigorously protect human rights, reduce poverty and design the political/negotiations component of a successful conflict resolution strategy. Security consolidation can only take root if Colombia tackles its pervasive problems of organised violence, criminality and illegality in an integrated manner.
