1. Bosnia's Future

Abstract:
Bosnia and Herzegovina (BiH, or Bosnia) poses little risk of deadly conflict, but after billions of dollars in foreign aid and intrusive international administration and despite a supportive European neighbourhood, it is slowly spiralling toward disintegration. Its three communities' conflicting goals and interests are a permanent source of crisis, exacerbated by a constitution that meets no group's needs. The political elite enjoys mastery over all government levels and much of the economy, with no practical way for voters to dislodge it. The European Union (EU) imposes tasks BiH cannot fulfil. A countrywide popular uprising torched government buildings and demanded urgent reforms in February 2014, but possible solutions are not politically feasible; those that might be politically feasible seem unlikely to work. Bosnia's leaders, with international support, must begin an urgent search for a new constitutional foundation.

Abstract:
It is time to close international supervision of Bosnia's Brčko District. Once seen as a model of post-war reconciliation and good government, it is drowning in corruption and mismanagement that flourished despite its supervisors' best efforts. The territory is vital to Bosnia and Herzegovina (BiH)'s stability: it links the two halves of both Republika Srpska (RS) and the BiH Federation (FBiH), and belongs technically to both entities but is independently governed and multi-ethnic. Many of its former leaders are under suspicion in a corruption probe that may have only scratched the surface; several high profile development projects are collapsing in bankruptcy and litigation. RS has a strong influence on the district but is not threatening to undermine its status. Nevertheless, the international community should ensure that Serb leaders of that entity are left in no doubt that any move to take Brčko over would meet a strong reaction. Stability is now dependent on whether local politicians, law enforcement and the judiciary can take responsibility. International supervision is no longer helping, and a new strategy is needed.

3. Bosnia: Europe's Time to Act

Abstract:
After years of hesitancy, European Union (EU) member states should make 2011 the year when the lead international role in Bosnia and Herzegovina shifts from the Office of the High Representative (OHR) to a reinforced EU delegation. Bosnia has outgrown the OHR established in 1995 after the Dayton Peace Agreement and the creation of the Peace Implementation Council (PIC). Today the country needs EU technical assistance and political guidance to become a credible candidate for EU membership, not an international overseer to legislate for it or maintain security. Member states should rapidly install a comprehensive plan to reinforce the EU presence, including an embassy led by a strong ambassador, strengthen the membership perspective and build local credibility. OHR should withdraw from domestic politics and, unless a threat to peace emerges, focus on reviewing past decisions.

4. Bosnia: A Test of Political Maturity in Mostar

Abstract:
The administration of Mostar is collapsing, a warning sign for Bosnia and Herzegovina (BiH). There has been no mayor, budget or functioning city council since an October 2008 election; tension threatens to poison relations between the leading Bosniak and Croat parties, which are coalition partners throughout BiH. The crisis is rooted in ethnic demographics, recent conflict history and a city statute that replicates many of the power-sharing rules that govern the state. Mostar's Croat majority, much like the state's Bosniak majority, chafes against these rules, considering them illegitimate and foreign-imposed, and seeks to force the Office of the High Representative (OHR – the international community's peace implementation body) to impose a solution on its behalf. Yet, a fair solution is within the council's competence and, like the city's chronic grievances, can best be handled without the High Representative using his extraordinary (Bonn) powers. The international community should deliver the message that fourteen years after the end of their war, it is time for the Bosnians to take responsibility for their own futures.

5. Monitoring the Northern Ireland Ceasefires: Lessons from the Balkans

This briefing compares the mandate of the Independent Monitoring Commission for Northern Ireland (IMC) with those of two recent European examples of the monitoring and enforcement of compliance with peace agreements: the unsuccessful Kosovo Verification Mission (KVM) of 1998-1999, and the much more fruitful mission of the Office of the High Representative (OHR) in Bosnia and Herzegovina since 1995. It attempts to identify lessons from those earlier experiences that may help the IMC carry out its mission in the context of carrying forward the Good Friday peace process.

6. Building Bridges In Mostar

Abstract:
Making another attempt to unite the divided city of Mostar has become, unexpectedly but appropriately, a very high international priority in Bosnia " Herzegovina (BiH) in 2003. By late summer, it had come to be ranked by High Representative Paddy Ashdown among his four major projects for structural reform. In each case, the High Representative appointed a foreign chairman to lead commissions composed of domestic representatives and charged with finding statebuilding solutions in the symbolically or substantively important realms of defence, intelligence, indirect taxation - and Mostar. All aim to unify divided and dysfunctional institutions. The first three commissions, which have already reported and whose draft legislation is proceeding through the various parliaments, have also sought to empower the state over the entities and their respective national establishments.

7. Bosnia's Nationalist Governments: Paddy Ashdown And The Paradoxes Of State Building

The return of the nationalist parties to power after the October 2002 general elections in Bosnia Herzegovina (BiH) was widely assessed as a calamity. Some observers went so far as to claim that it signified the failure of the international peace-building mission over the previous seven years. But the new High Representative, Paddy Ashdown, refused to be downcast. Not only was the nationalists' victory narrow, but he was confident he could work with them if they proved faithful to their pre-election pledges to embrace the reform agenda he had been charting since taking office in May 2002. This agenda seeks to make up for lost time: implementing the economic, legal and governance reforms required both to make BiH a prosperous, lawful and peaceable state and to set the country on track for European integration. Lord Ashdown aims to put himself out of a job by putting BiH on the road to the EU.

Afflicted still by the physical, psychological and political wounds of war, and encumbered by the flawed structures imposed by the international community to implement peace, Bosnia and Herzegovina (hereafter: Bosnia) is not yet capable of plotting a strategy or undertaking the measures likely to win it membership in the European Union (EU). Yet the government announced on 10 April 2003 that its major policy goal is to join the EU in 2009, in the blind faith that the processes of European integration will themselves provide Bosnia with remedies for its wartime and post-war enfeeblement. The Thessaloniki summit meeting between the heads of state or government of the EU members and the Western Balkan states to be held on 21 June is likely to throw some cold water on their ambitions.

9. The Continuing Challenge Of Refugee Return In Bosnia Herzegovina

In preparing for and orchestrating the proximity talks that marked the end of the 1992-1995 war in Bosnia Herzegovina (BiH), the authors of the Dayton Peace Accords (DPA) placed a particularly high priority on the return of refugees and internally displaced persons to their pre-war homes. Annex 7 of the DPA is devoted entirely to ensuring the right of return. The peacemakers hoped that such return might one day reverse the territorial, political and national partition of the country that the DPA otherwise recognised.

Despite more than six years of increasingly intrusive reforms carried out at the behest of the UN Mission in Bosnia Herzegovina (UNMIBH), the local police cannot yet be counted upon to enforce the law. Too often – like their opposite numbers in the judiciary – nationally partial, under-qualified, underpaid, and sometimes corrupt police officers uphold the law selectively, within a dysfunctional system still controlled by politicised and nationalised interior ministries.
