1. Towards a Post-MINUSTAH Haiti: Making an Effective Transition

Abstract:
Haiti is now marking the eighth year of the UN Stabilisation Mission in Haiti (MINUSTAH). Debate about its eventual withdrawal is intensifying under the one year-old administration of President Michel Martelly. Opposition to its presence stems from the country's nationalistic pride, anger at the cholera epidemic linked to UN peacekeepers and publicity surrounding unacceptable abuses by a small number of peacekeepers. Yet even its critics admit the country's still limited police force cannot guarantee the security needed to protect citizens, enforce the law and underpin political stability. The real debate is not whether MINUSTAH should leave but when, and what to change in Haiti and in the mission's mandate, structure and behaviour to ensure that a phased withdrawal is linked to stronger institutions and progress toward lasting stability and development.

2. Haiti: Stabilisation and Reconstruction after the Quake

Abstract:
Haiti's earthquake produced enormous devastation that threatens political and socio-economic stability and poses huge recovery and reconstruction challenges. Historical institutional and governance weaknesses and deep poverty compound a major humanitarian crisis that could become very difficult to control if the security environment deteriorates further with the approaching rainy and hurricane seasons. The disaster prompted postponement of legislative elections and casts uncertainty over whether presidential elections can be held at year's end as planned. After mid-May, the legislature will have left office, and the country will be missing critical parts of its institutional anatomy. The government must thus reach out now to civil, political and economic society to forge a robust consensus on how democracy can be upheld until elections without sacrificing the incumbent's ability to take tough and urgent decisions on reconstruction. These need to be based on a Haitian-led long-term strategy supported by all sectors of society and the international community and pay due attention to restoring security and rule of law.

3. Haiti 2009: Stability at Risk

Abstract:
A series of crises in 2008 have increased the potential for serious trouble in Haiti this year. The politically motivated, violent April riots against high living costs caused widespread disruption and suffering, toppled the government of Prime Minister Jacques-Édouard Alexis and forced postponement of a donor conference. In August and September, four tropical storms and hurricanes killed 800, affected nearly one million, exacerbated food shortages and pushed yet more Haitians into poverty. Extensive damage was caused to infrastructure and agriculture. The global financial crisis is making it difficult for donors to meet commitments and reducing diaspora remittances. President René Préval and Prime Minister Michèle Pierre-Louis, who took office in September 2008, need to secure the support of donors and parliament quickly for a wide-ranging stabilisation strategy or risk political instability and violence. These are major challenges in a year in which parliamentary elections will be held and constitutional reform is on the agenda.

4. REFORMING HAITI'S SECURITY SECTOR

Abstract:
Operations led by the UN peacekeeping mission (MINUSTAH) largely disbanded armed gangs in the slums of Haiti's cities in early 2007, but security and stability are far from consolidated. The failure to provide an immediate, visible peace dividend once the gangs' hold was broken was a lost opportunity the still fragile country could ill afford. Now new threats are appearing. Serious crime persists, especially kidnapping and drug trafficking, and in the absence of a sufficiently large and fully operational police force and functioning justice and penitentiary systems, it threatens to undermine political progress. This was evidenced by the fall of Prime Minister Jacques-Edouard Alexis's government following April 2008 protests and riots against high living costs. Security sector reform (SSR) is essential to stabilisation but has been plagued by serious institutional weaknesses.

5. Inside Gaza: The Challenge of Clans and Families

Abstract:
Throughout Gaza's history, its powerful clans and families have played a part whose importance has fluctuated with the nature of central authority but never disappeared. As the Palestinian Authority (PA) gradually collapsed under the weight of almost a decade of renewed confrontation with Israel, they, along with political movements and militias, filled the void. Today they are one of the most significant obstacles Hamas faces in trying to consolidate its authority and reinstate stability in the territory it seized control of in June 2007. Although they probably lack the unity or motivation to become a consistent and effective opposition, either on their own or in alliance with Fatah, they could become more effective should popular dissatisfaction with the situation in Gaza grow. There are some, as yet inconclusive, indications that Hamas understands this and is moderating its approach in an attempt to reach an accommodation.

6. Peacebuilding in Haiti: Including Haitians from Abroad

Abstract:
The UN mission in Haiti (MINUSTAH) will not stay forever and, in any case, cannot be made responsible for solving Haiti's manifold and deep-seated problems. The absence of adequate professional staff, sufficient financial resources and efficient management at all levels of government has delayed structural reforms and economic and social programs. The country needs institutional strengthening prior to its transition from President René Préval to his successor after the elections in 2011 – also the likely outside limit for MINUSTAH's mandate. Otherwise, political polarisation along traditional cleavages will reappear, as will the risk of conflict. Training civil servants and increasing their salaries are important but insufficient to produce the advances Haitians are demanding. A serious and sustained initiative to include three million Haitians living abroad could overcome historic nationalistic mistrust of outsiders, bring a missing middle class within reach and help Haiti escape its “fragile state” status.

Haiti's security and stability remain fragile. President René Préval has endorsed national policies for security, police, justice and prison reform, but a weak state and decades, if not centuries, of institutional abandonment, make implementation slow, difficult and uneven. His first real success has been the dismantling of the toughest gangs in Port-au-Prince, but for this to be sustainable a community-friendly Haitian National Police (HNP) needs to be built under the security umbrella provided by the UN peacekeepers (MINUSTAH), infrastructure and economic opportunity must appear in the capital's poor neighbourhoods, and comparable recovery and reconstruction have to be extended across the country.

8. Haiti: Prison Reform and the Rule of Law

Abstract:
Haiti's overcrowded, understaffed and insecure prisons are powder kegs awaiting a spark. Any explosion of violence or mass prisoner escape could undermine recent steps by the government and UN peacekeepers (MINUSTAH) to combat urban gangs and organised crime. The immediate needs are to ensure that the most dangerous prisoners, including newly arrested kidnap suspects, are held in maximum security cells; there are more guards to protect and ensure minimum care for prisoners; and a fast-track government/donor-financed plan to build more secure prisons begins. As President René Préval's government nears the end of its first year, failure to respond with greater urgency and resources to the prison crisis not only would complicate police and justice reform but could add to national insecurity.

9. Haiti: Justice Reform and the Security Crisis

Abstract:
Violent and organised crime threatens to overwhelm Haiti. The justice system is weak and dysfunctional, no match for the rising wave of kidnappings, drug and human trafficking, assaults and rapes. If the efforts of the last three years to establish the rule of law and a stable democracy are to bear fruit urgent action is needed. Above all the Haitian government must demonstrate genuine political will to master the problem. But the international community also has a major support role. The immediate need is to establish, staff and equip two special courts, one a domestic criminal chamber to handle major crimes, the other a hybrid Haitian/international tribunal to deal with cases of transnational, organised crime that the country cannot tackle on its own.

Abstract:
Security is the core challenge for new President René Préval and the UN peacekeeping mission (MINUSTAH). Violence and impunity, rooted in the state's weakness, are pervasive, especially in Port-au-Prince. Haiti's five- month-old government must confront the illegal armed gangs, break the international crime/political power at ports and borders and cope with rising drug trafficking and kidnapping. Armed gangs and criminals, including elements of the Haitian National Police (HNP), perpetrate the violence but it is also fostered by the worst poverty in the Western Hemisphere. Dismantling the gangs and pursuing serious police reform are critical to every broader goal of the new administration, from education reform, infrastructure, private sector investment, jobs and agriculture to governance.
