11. The Cornerstone and the Linchpin: Securing America’s Northeast Asian Alliances

Abstract:
During an era in which strategic gravity is shifting to Asia, the United States cannot be careless in tending to its alliances with Japan and South Korea (the Republic of Korea, or ROK). The three countries face persistent threats from North Korea and from China’s semi-transparent bid for regional hegemony. Meanwhile, rocky relations between Tokyo and Seoul are jeopardizing vital U.S. interests in the Indo-Pacific. The latest disagreement between America’s premier allies raises new questions about alliance strategy, commitment, and burden-sharing. These fissures have become exacerbated as the U.S. pressures allies to increase their contributions to regional security and reciprocal trade. [...] This report seeks to explain why the U.S.-Japan and U.S.-ROK alliance are still a vital means of achieving overlapping strategic interests. At the same time, it also argues that keeping these alliances fit for purpose requires radical change rather than business as usual. Both a rapidly changing security environment and growing intra-alliance squabbling pose dangers that require U.S. leadership. This report concludes with specific ideas for advancing bilateral and trilateral cooperation in the coming months and years, without trying to achieve too much too quickly.

12. Driving Growth and Innovation in the Food Industry: Lessons from the Automobile Industry’s CAFE Standards

Abstract:
Poor dietary patterns are the leading cause of noncommunicable disease in the U.S., and they are creating a significant burden on the economy and on quality of life. Diet-related disease is having a large impact on health outcomes among children and adults, leading to increasing healthcare costs, which has led to a focus on regulatory measures to curb the rising tide. Regulation has largely focused on the U.S. food system, as it provides low-cost, calorie-dense foods, which have been linked to a substantial increase in calories in the food supply and excessive calorie consumption. Substandard eating habits are linked to a number of health conditions, such as diabetes and obesity. Diabetes rates in the U.S. have more than tripled since 1970, and nearly 40 percent of adults are categorized as having obesity. The cost to the healthcare system is significant, and a myriad of health issues are linked to its pervasive spread in the country. Particularly concerning are increasing obesity rates among children, amidst continued public health interventions at the local, state, and national levels. Public health officials continue to advocate for additional regulation to shift dietary patterns. Policy efforts have ranged from voluntary commitments by the food industry to government-driven regulations such as taxes on sugar-sweetened beverages and package-labeling provisions. Most of the government regulatory approaches to date have been piecemeal, typically led by local government bodies and focusing on a specific type of food or beverage for taxation, or tending to address a particular component, such as food package labeling. For example, Berkeley, CA passed a sugar-sweetened beverage tax in 2014, and the FDA has mandated changes to food labels to increase transparency about calories and added sugars. This paper seeks to open the discussion on a broader policy approach to reduce excessive consumption of calories, sugars, saturated fats, and sodium, which are linked to conditions such as diabetes, obesity, cardiovascular disease, and certain cancers. It will do this by exploring Corporate Average Fuel Economy (CAFE) standards, an automobile industry “cap and trade” regulatory model.

Abstract:
U.S. administrations and officials are consistently caught flat-footed by the increasing assertiveness of the People's Republic of China (PRC) over disputed territories in the East China and South China Seas. This assertiveness is strident, yet controlled. Beijing's objectives in the region, with respect to maritime issues in particular, have been apparent for several decades. While the United States is well aware of the PRC's "talk and take" approach—speaking the language of negotiation while extending de facto control over disputed areas—U.S. policy has been tactical and responsive rather than strategic and preemptive, thus allowing China to control the pace and nature of escalation in executing talk and take.

Over the past 20 years, the Federal Communications Commission (“FCC” or “Commission”), often in coordination with the Department of Justice (“DoJ”), has reviewed dozens of mergers and acquisitions involving companies offering various forms of communications services, and many offering various forms of wireless services. To approve license transfers and other regulatory authorizations associated with each of these mergers and acquisitions, the FCC issues an order in which it often discusses antitrust issues including a definition of a “relevant product market” to assess the likely competitive effect of the merger.

This paper proposes that the Federal Communications Commission adopt rules to allow practically all of the electromagnetic spectrum to be allocated flexibly in response to market conditions and to allow licensees to use their spectrum flexibly. This approach is consistent with the direction of FCC decisions to allow greater spectrum flexibility and would be economically far superior to recent FCC proposals for broadcast spectrum auctions. Spectrum flexibility—or “Open Spectrum”—would eliminate the much-lamented wireless broadband “shortage” without delay and would foster greater innovation in American spectrum markets and transactions and in wireless services and products. The econo mic value of Open Spectrum is probably orders of magnitude greater than the projected $15 billion in receipts from the FCC's broadcast spectrum auctions.

Abstract:
Member States of the United Nations unanimously endorsed the Millennium Declaration on September 8, 2000. One of its provisions resolved "to encourage the pharmaceutical industry to make essential drugs more widely available and affordable to those who need them in developing countries." Then, in late September, the UN established the Millennium Development Goals (MDGs), drawing its authorization from the original Declaration. There are eight goals that address a variety of global issues, including education, poverty, environment, and health. The Goals were set to be achieved by 2015, with indicators applied to measure progress. For example, to measure poverty reduction, the number of people living under $1.25 per day is tracked. To measure progress in reaching universal education, primary school enrollment is tracked.

Hydraulic fracturing (HF) is one of the technologies that have enabled large increases both in the current production of natural gas and in estimates of recoverable reserves. However, as new technology has triggered a boom in onshore U.S. gas exploration and production (E), environmental concerns have multiplied. Much of the concern centers on use of HF. As public concern has risen, so have calls for federal regulatory control. The Interior Department has adopted tighter controls on the use of HF on public lands. Also, two former Obama White House aides, Carol Browner and Jody Freeman, have argued for more EPA regulation of all use of HF in oil and gas drilling. To achieve this control, they propose to repeal the partial oil and gas exemption under the Safe Drinking Water Act (SDWA). Bills to this effect, dubbed the FRAC Act, were proposed in the last two Congresses, but they were not adopted.

Slow, slower, and may be even stop. That's a quick summary of how Federal Reserve Board chairman Ben Bernanke sees the US economy. The economy grew at an annual rate of 2.5% last year, 1.9% in the first quarter of this year, "and available indicators point to a still-smaller gain in the second quarter" he advised congress last week. Household spending is slowing down because "confidence remains relatively low" (at its lowest level since December); numerous factors (a supply overhang, unavailability of credit) "impede growth" in the housing sector; manufacturing production has slowed; business investment has "decelerated"; there is "further weakness ahead" for investment demand; and "reduction in the unemployment rate seems likely to be frustratingly slow."
