Abstract:
If the EU and its member states are to manage migration successfully, they need to start treating countries of origin and transit, especially in Africa, as equal partners. The Union must make a conscious effort to negotiate comprehensive agreements on mobility that reflect both sides’ interests, concerns, and political realities. The European Commission is currently finalising its proposed New Pact on Migration and Asylum to re-start the debate on how to reform the Common European Asylum System and manage migration from outside the EU. One prominent aspect is the ‘external dimension’: jointly managing migration with countries of origin and transit. In this 2020 MEDAM Assessment Report, the authors explore how European and African governments can reach common ground on policies related to migration and mobility.

Abstract:
EU leaders should rise to the challenge posed by the COVID-19 pandemic and set the Union on the course of not only economic, but fully-fledged strategic recovery. This means strengthening Europe’s cohesion and resilience; leveraging Europe’s untapped potential to carry its full weight on the global stage; and engaging in upholding rules-based cooperation. If Europe fails to measure up to the task, the EU will drift towards more political fragmentation and strategic dependence. The health crisis has not only heightened but also highlighted Europe’s vulnerability to global challenges and disorder. The pandemic risks amplifying geopolitical competition, which is undermining multilateral cooperation at a time when sound management of our interdependence is crucial. Under such conditions, the dysfunction of the global order may lead to irretrievable system failure, with dire consequences for all. Europeans should not only craft a decisive response to the pandemic but also use it as a springboard to reinforce the EU and its domestic power base on the global stage. The EU and its member states must prepare to cope with power politics without endorsing its logic. They should become more strategic and, where need be, more autonomous. Discussion on a recovery fund should not be limited to the financial dimension, but instead thought of in terms of ‘grand strategy’. Socioeconomic recovery is the fuel of political cohesion, which in turn is the engine of a stronger Europe in the world. A more powerful Europe is the only vehicle geared to protect EU citizens from the many external challenges and project Europe’s interests on the global stage.

Abstract:
A courageous and ambitious New Pact on Migration and Asylum is one that strengthens the right to asylum; sets the conditions for more equal relationships with third countries when it comes to managing migration; and puts forward a mechanism that can foster genuine solidarity between member states. When the new Commission entered into office in December 2019, it promised a fresh start on migration, breaking the deadlock between member states on long-awaited reforms. Unfortunately, based on a range of leaked papers and official (draft) documents that have been circulating since late 2019, it seems that the Commission may opt to reduce the New Pact to a collection of watered-down compromises on responsibility-sharing. It also appears to be doubling down on control-oriented measures. This Discussion Paper argues that a different approach is needed to set up an EU asylum and migration policy that is efficient, respects asylum seekers’ fundamental rights and can prevent and meaningfully address future humanitarian emergencies.

Reforms to corporate governance and EU company law could support the Union’s recovery efforts and promote a sustainable economy at the same time. This Policy Brief assesses two instruments in the EU corporate governance toolbox: the Non-Financial Reporting Directive (NFRD), which requires large companies to disclose information about how they are run and how their activities impact the environment and human rights, and the Shareholder Rights Directive II (SRDII), which aims to strengthen the position of shareholders and reduce short-termism and excessive risk-taking by companies. It also covers the principle of shareholder primacy – the idea that shareholder interests should take precedence over all else – and executive remuneration.

26. Minimum wage and the EU: Happily ever after?

Once deemed a pipe dream, a concrete plan for a European framework on minimum wages might finally be in the cards. The framework will have to be ambitious enough to deliver progress for low-wage workers, but also flexible enough to accommodate the very diverse wage-setting regimes present across the EU. On top of that, the Commission must deal with the opposition to EU interventions in determining wages, and convince sceptics of the economic, social and political benefits of having a European framework. The Commission should, therefore, strive for (i) the creation of an egalitarian wage structure that supports decent living standards; and (ii) building broad political consensus.

27. Countering shrinking spaces: Recommendations to support EU civil society

Civil society is a crucial ally in safeguarding and upholding the European Union's (EU) values. And although the EU, and in particular the European Commission, has made a conscious effort to support civil society organisations (CSOs) across Europe, it has not been enough to counter the phenomenon of 'shrinking spaces' effectively. As the COVID-19 crisis is likely to harm civil society across Europe, through the growing restrictions on civil liberties and the subsequent economic recession, the need for better and more comprehensive support has never been more urgent. Within the realm of the Treaties, the EU institutions could take a range of measures to improve its civil society support. It could come up with a more comprehensive strategy outlining its approach towards civil society; provide adequate and flexible financial resources to respond to the needs of CSOs; and improve its dialogue processes, to 'CSO-proof' its legislation but also to benefit from the bridge-building function of civil society, thereby linking the EU's support for civil society to its attempts to improve democratic participation. While the newly presented recovery instrument and the revised proposal for the next Multiannual Financial Framework (MFF) are important steps to provide the necessary help for European societies and economies to recover, civil society support does not seem to be a priority. This is a dangerous omission. The EU must recognise the value of civil society in safeguarding democratic principles and upholding the Union's core principles. If it fails to better support CSOs through this challenging time, the EU will be able to do little else but stand and watch as democratic backsliding intensifies across member states and, in some cases, will eventually tip over into a downward spiral towards authoritarianism.

Abstract:
EU leaders stress the importance of the green transition and digital transformation and consider it crucial to the EU's recovery from the coronavirus crisis. Rightly so. Aligning the EU's green and digital transition policies carries enormous potential and should become central to the Union's efforts to create a competitive and sustainable climate-neutral economy. The European Commission's Green Deal proposal – supported by, for example, the Industrial Strategy, the Circular Economy Action Plan and Digital Strategy – already recognises that the two transitions are closely linked. But the EU should go a step further. It should lead the way and ensure that digitalisation enhances environmental protection and climate action and that the digital sector becomes greener. The findings in this paper are the result of a year-long EPC research project commissioned by the German Federal Ministry for the Environment, Nature Conservation and Nuclear Safety (BMU).

he COVID-19 pandemic has exposed the unpreparedness of European health systems to absorb a health crisis of this magnitude. In order to fix these existing structural weaknesses and effectively deal with the health challenges brought on by the current pandemic, we need to build a ‘Europe of Health’; an EU public health policy that works across borders and lives up to its citizens’ expectations. Following on from the Franco-German initiative for European recovery from the ongoing COVID-19 crisis, Claire Dhéret and Simona Guagliardo outline a twofold strategy to foster ‘EU health sovereignty’ and reinforce the EU’s international leadership in health at a time when multilateralism is seriously jeopardised: Foster EU health crisis management capabilities by empowering existing structures, prepare a European stockpile of strategic medical products and equipment, and make better use of the Single Market in the area of health. Strengthen the resilience of national health systems by promoting modern, innovative and patient-centred care, and encourage the creation and use of a common, EU-wide evaluation framework for health care.

30. Brexit: Time regained

Abstract:
The UK has wasted precious time in the Brexit process. A no deal outcome has become the legal and political default. The new prime minister cannot avoid returning to Mrs May’s deal if he is to avoid no deal. Andrew Duff argues for changes to be made not only to the Political Declaration but also to the Withdrawal Agreement itself. One amendment is needed to buy time: the transition period should be made extendable until the final association agreement enters into force. Such a revision will not breach anyone’s red lines, will obviate the need for the Irish backstop, reassure businesses and citizens, and enable an orderly exit. Duff also argues that the British should pay far more attention to the joint governance of the Withdrawal Agreement. The idea that the UK will become a vassal of the EU is nonsense: in fact, the British will be able to wield influence after Brexit if the new prime minister adopts a positive attitude.
