311. A normative case for pluralism: reassessing Vincent's views on humanitarian intervention

While R. J. Vincent's overall goal in Human rights and International Relations was to demonstrate how human rights might be promoted in international society, there was one area in which he was sceptical about allowing human rights to serve as the basis for international conduct: military intervention. This article begins by demonstrating that Vincent's greatest fear—that legitimizing humanitarian intervention would lead to countless wars—has proved largely unfounded. Nonintervention in the face of gross violations of human rights has marked the postCold War period more than rampant interventionism. Moreover, while the use of force for humanitarian purposes has become acceptable in very exceptional circumstances, the manner in which it has been legitimized and the depth of the consensus around its appropriateness illustrate lingering scepticism among states about infringements of sovereignty. The article concludes by showing how Vincent's writings on humanitarian intervention, in particular his caution about an imperialist advance of cosmopolitanism, might provide a basis for a more robust normative defence of pluralism in contemporary international society

How should we understand the cultural politics that has surrounded the development of international human rights? Two perspectives frame contemporary debate. For 'cultural particularists', human rights are western artefacts; alien to other societies, and an inappropriate basis for international institutional development. For 'negotiated universalists', a widespread global consensus undergirds international human rights norms, with few states openly contesting their status as Abstracts fundamental standards of political legitimacy. This article advances an alternative understanding, pursuing John Vincent's provocative, yet undeveloped, suggestion that while the notion of human rights has its origins in European culture, its spread internationally is best understood as the product of a 'universal social process'. The international politics of individual/human rights is located within an evolving global ecumene, a field of dynamic cultural engagement, characterized over time by the development of multiple modernities. Within this field, individual/human rights have been at the heart of diverse forms of historically transformative contentious politics, not the least being the struggles for imperial reform and change waged by subject peoples of diverse cultural backgrounds; struggles that not only played a key role in the construction of the contemporary global system of sovereign states, but also transformed the idea of 'human' rights itself. In developing this alternative understanding, the article advances a different understanding of the relation between power and human rights, one in which rights are seen as neither simple expressions of, or vehicles for, western domination, nor robbed of all power-political content by simple notions of negotiation or consensus. The article concludes by considering, in a very preliminary fashion, the implications of this new account for normative theorizing about human rights. If a prima facie case exists for the normative justifiability of such rights, it lies first in their radical nature—in their role in historically transformative contentious politics—and second in their universalizability, in the fact that one cannot plausibly claim them for oneself while denying them to others.

In recent years, International Relations theorists have turned to philosophy in search of new ontological and epistemological foundations or to clarify their existing commitments. Scientific Realism and International Relations, edited by Jonathan Joseph and Colin Wight, is a good example of the former: editors and contributors make the case for Scientific Realism—a leading philosophy of science—in International Relations. Patrick Thaddeus Jackson, author of The conduct of inquiry in International Relations, is motivated by the latter concern, and devises a typology based on two key fissures among social scientists: the relationships between the knower and the known, and between knowledge and observation. The Joseph and Wight volume, while containing some thoughtful essays, does not convince the reviewer that assumptions that might apply in the physical world are relevant to its social counterpart. The Jackson book is an intellectual tour de force and a compelling plea for pluralism.

Japan's economy has suffered exceptional damage because of its high level of exposure to the massive downturn in world trade and investment, notably impacting on demand for cars, consumer electronics and investment equipment. The depth of Japan's recession looks set to be far worse than that of the US and the EU. However, the recession has also radically reshaped the global financial environment in ways that suggest unexpected opportunities for Japanese financial institutions and markets. This report reviews the outlook for Tokyo as a financial centre and the role of Japan's financial sector in the light of domestic targets as well as international trends and competition.

315. Transit Troubles: Pipelines as a Source of Conflict

Recent events between Russia and Ukraine at the start of 2009 and Russia and Georgia in 2008 have brought transit pipelines back into the media spotlight. Any reading of the history of transit oil and gas pipelines suggests a tendency to produce conflict and disagreement, often resulting in the cessation of throughput, sometimes for a short period and sometimes for longer. It is tempting to attribute this to bad political relations between neighbours. This is certainly part of the story, but also important is the nature of the 'transit terms' – tariffs and offtake terms – whereby transit countries are rewarded for allowing transit. Put simply, the trouble with transit pipelines has a significant economic basis.

Cyberspace and the National Security of the United Kingdom provides a general overview of the problem of cybersecurity. The aim of the report is to inform debate and to make the case for a more coherent, comprehensive and anticipatory policy response, both nationally and internationally. In every area, society is becoming increasingly dependent upon information and communications technology (ICT). With dependency come exposure and vulnerability to misuse, criminality and even attack. Criminals and extremists are able to take advantage of the same 'global technological commons' upon which society is becoming so dependent. Cybersecurity has become a fast-moving and complex security challenge, one which requires a coordinated, agile and mutually reinforcing response from all those who benefit from the global ICT infrastructure.

Over the last two decades, as Mainland China has been developing and liberalizing its economy, Taiwan has been undergoing an equally remarkable but very different political transformation, from martial law in 1987 to its current status as one of the most vibrant, stable democracies in Asia. Despite its eventful experience of the democratization process, the parliamentary and presidential elections in 2008 proved that Taiwan is now a mature, and stable, democracy. It has passed the ultimate test, seeing the successful transition of rule from one party to another and back again, without social turmoil. Economic performance over the same period has been less striking. Once among the fastestgrowing economies, Taiwan is now afflicted by a relatively low growth rate, and problems over the outflow of capital and investment to the Mainland. The potential for conflict over cross-straits relations remains but it has been significantly reduced under President Ma and by the Mainland Chinese government's greater accommodation with a democratic Taiwan in the last decade. The risk of a military conflict between the two sides, which could drag in the US, and therefore the rest of the world, cannot be entirely discounted, however. Taiwan's greatest challenges in the next decade remain the same as in the last – to maintain its identity, to develop its democratic system, and to handle relations with the Mainland in a way that preserves its interests while avoiding conflict. Taiwan's system, which has so far proved itself robust and effective, faces a new challenge too: how to benefit from the increase in Mainland investment abroad.

319. Africa's New Human Rights Court: Whistling in the Wind?

Human rights abuses on a massive scale continue to afflict the lives of millions of people across the continent of Africa. As in other parts of the world, the obstacles in pursuing justice are currently insurmountable for most victims. Against this troubling backdrop, the African Union (AU) has decided to add a human rights section to its new court which has been agreed upon but not yet set up. This court is called the African Court of Justice and Human Rights. In the meantime, another pan-African human rights court, the African Court on Human and Peoples' Rights, has recently opened in Arusha, Tanzania. This court will be wound down to make way for the African Court of Justice and Human Rights but is expected to operate for the next few years at least. These two courts represent the third instalment in efforts since the Second World War to create regional human rights courts. Because they have broad powers to enforce socio-economic rights and the collective rights of peoples, they may be setting an example for new developments around the world. This briefing paper focuses on the African Court of Justice and Human Rights, but it also explains key features of the interim African Court on Human and Peoples' Rights. It addresses questions including: Can victims of human rights abuses bring cases? Will the Court be able to try African heads of state? Will governments comply with judgments?

In the United States, European Union and Asia, fears about dependence on oil and gas imports from unstable regions have become a major theme of political debate. This paper provides a high-level and historical perspective on this complex issue. Dependence on oil and gas imports raises real economic- and political-security issues for many countries. Neither the global economic crisis nor climate change policies - both of which look set to restrain oil and gas demand - will solve the problem entirely. In fact, over the next few decades it is likely to become worse.
