261. Merging Security from the Two Level Game: Inserting the Treaty of Prüm into EU law?

Abstract:
On 27 May 2005, seven EU member states signed the Prüm Treaty to promote cross-border cooperation, aimed particularly at combating terrorism, cross-border crime and illegal migration. In response, we published a critical analysis of the measure, in which we expressed reservations on three grounds: The treaty format in a field of EU activity produces negative externalities for the EU's area of freedom, security and justice by circumventing the EU framework; Reverting to an intergovernmental arena excludes the European Parliament at a time when its role in democratic scrutiny of the area of freedom, security and justice is critical; The effect of the Prüm Treaty is to weaken the EU rather than to strengthen it, as it postpones an important debate among all the member states about cross-border cooperation in policing and creates the impression that a small group of member states seek to impose their view on the rest.

Abstract:
For the first time since the collapse of communism, the EU is facing a strategic challenge in its external policies. The rise of Russia and China as international actors – with India close behind – and the growing confidence of some leading regional powers, such as Iran, are creating a serious threat to the EU's ambition to apply external policies that reflect European values. Against this background, the employment of the democracy – promotion agenda developed during the 1990s is unlikely to be effective and may even serve to weaken the position of the EU in key regions. This situation demands an urgent and far-reaching rethink of the approach the Union takes to external relations. If the EU is to remain a serious global actor, it will have to find ways to reconcile the imperative of engaging in difficult regions beyond the immediate European neighbourhood while also remaining true to the values of the Union.

In its Communication on Enlargement Strategy and Main Challenges 2006-2007, released 8 November 2006, the European Commission concluded: “Overall, the fifth enlargement has been a considerable success” and “(t)he EU's institutions have continued to function effectively” (p. 4). In his speaking points to the press, Enlargement Commissioner Olli Rehn (2006) stressed two important criteria for evaluating the integration process: With respect to institutional matters, the EU's decision-making processes must remain effective and accountable, for the sake of current member states as well as in view of further enlargement. With respect to policy-making, the EU needs to be in a position, as it enlarges, to continue developing and implementing common policies in all areas. Accordingly, assessment of the impact of enlargement on EU policies is planned to take place at all key stages of the enlargement process.

266. Profiling Normative Foreign Policy: The European Union and its Global Partners

This paper is the first in a series that will investigate “Who is a normative foreign policy actor?” It forms part of a new project intended to explore fundamental aspects of foreign policy at the global level, against the backdrop of a proliferation of global actors in the 21st century, following half a century with only one undisputed global hegemon: the US. The European Union is itself a new or emerging foreign policy actor, driven by self-declared normative principles. But Russia, China and India are also increasingly assertive actors on the global stage and similarly claim to be driven by a normative agenda. The question is how will these various global actors define their foreign policy priorities, and how they will interact, especially if their ideas of normative behaviour differ? This first paper sets out a conceptual framework for exploring these issues and defines 'normative' as being strongly based on international law and institutions, and thus the most 'universalisable' basis upon which to assess foreign policy. The foreign policy actor nevertheless has to be assessed not only on its declared goals, but also on the means it employs and the results it obtains. The truly normative foreign policy actor should score consistently on all three counts and in many different contexts, which will condition the extent to which normative policies are chosen, viable and effective. Subsequent papers in the series will apply this conceptual framework to five case studies on China, the EU, India, Russia and the US.

Abstract:
While energy security has gradually been incorporated into the EU's foreign policy calculus, the declared approach of extending a nexus of 'market-governance' energy norms has been realised only to a limited extent. The EU has eschewed a comprehensively political approach to energy security, with its energy security policy currently hovering ineffectively between market and geopolitical approaches. The EU needs to address more effectively the way in which governance structures in producer states impact upon European energy interests.

268. The Intersection between Justice and Home Affairs and the European Neighbourhood Policy: Taking Stock of the Logic, Objectives and Practices

Abstract:
This paper claims that the European Neighbourhood Policy (ENP) of the EU, and in particular the elements related to justice and home affairs (JHA), is a complex, multilayered initiative that incorporates different logics and instruments. To unravel the various layers of the policy, the paper proceeds in three steps: firstly, it lays out some facts pertaining to the origins of the ENP, as its 'origins' arguably account for a number of the core tensions. It then presents the underlying logic and objectives attributed to JHA cooperation, which can be derived from the viewpoints voiced during policy formulation. The paper goes on to argue that despite the existence of different logics, there is a unifying objective, which is to 'extra-territorialise' the management of 'threats' to the neighbouring countries. The core of the paper presents the various policy measures that have been put in place to achieve external 'threat management'. In this context it is argued that the 'conditionality-inspired policy instruments', namely monitoring and benchmarking of progress, transfer of legal and institutional models to non-member states and inter-governmental negotiations, contain socialisation elements that rely on the common values approach. This mix of conditionality and socialisation instruments is illustrated in two case studies, one on the fight against terrorism and one on irregular migration. Finally, the paper recommends that the EU draft an Action-Oriented Paper (AOP) on JHA cooperation with the ENP countries that indicates how the EU intends to balance the conflicting objectives and instruments that are currently present in the JHA provisions of the ENP.

The EU has increasingly committed itself to fusing security and development. Developmental approaches to security are routinely seen as integral to the EU's distinctive foreign policy identity. This paper finds, however, that much work remains to be done to implement this commitment. Few in the EU would doubt that development and security go hand in hand, but differences abound over what this implies for the allocation of finite resources and the nature of diplomatic engagements.

270. Bubbles in real estate? A Longer-Term Comparative Analysis of Housing Prices in Europe and the US

Abstract:
The downturn in the US housing market has attracted a lot of attention as it has sparked a global financial crisis. It is generally assumed that the eurozone does not face a similar problem. This paper shows that this assumption is wrong. The euro area average index of real housing prices has risen almost as much as that of the US and is now (as that of the US) about 40% above its 30-year average. This is similar to the overvaluation of Japanese real estate at the height of the Japanese bubble, which was then followed by over a decade of continuous decline. Over the last 30 years, the euro area index for real housing prices has tended to follow that of the US quite closely. The lag is now much shorter than in the 1970s or 1980s. The euro area market is thus likely to turn soon as well. One feature of housing price cycles that tends to be forgotten is their extraordinary length: many last for more than ten years. This persistence means that the downswing, which now seems to have started, is likely to last at least until the next decade. Within the euro area, there are large divergences: cases of 'froth' (Spain, for example) co-exist alongside cases of declining prices (Germany). These divergences have persisted for over a decade and have led to important macroeconomic disequilibria. The paper also develops an indicator of 'housing overhang', which shows by how much demand for new construction has to decline to bring the supply of housing back to normal levels. This indicator suggests that there is virtually no housing overhang in the eurozone on average and that it is of a manageable magnitude in the US. Spain and Ireland, however, face a massive housing overhang and thus probably a sharp deceleration of construction demand.
