41. Evaluating Middle East Reform: How Do We Know When It Is Significant?

Abstract:
This short paper launches the second set of studies in the Carnegie Papers Middle East Series. The first set, now also published as a book under the title Uncharted Journey: Promoting Democracy in the Middle East, examined the most important issues concerning democracy promotion and democratic change in the Middle East. One of the conclusions that emerged from those studies is that the Middle East still offers a rather discouraging political picture. There are some liberalized autocracies but no democratic countries in the region. The link between economic and political reform remains weak. Democratic reformers have failed to build strong constituencies, and the organizations with strong constituencies are Islamist rather than democratic. The integration of Islamists in the reform process remains poor. And the United States, now championing democracy in the region, has little credibility in Arab eyes, and still has not consistently integrated democracy promotion in its policy toward the area. Yet, despite all these problems, it is becoming increasingly clear that there is a ferment of reform in the Middle East. But how significant is it?

Abstract:
THE PROBLEM OF KNOWLEDGE IN RULE-OF-LAW PROMOTION, above all the basic question of whether Western rule-of-law aid programs are on the right track to help build the rule of law in recipient countries, is especially acute in the Arab world. Arab states generally share two features that render external rule-of-law aid particularly difficult—long-standing nondemocratic governments, and legal systems that graft Ottoman, European, and contemporary sources onto Islamic norms. We cannot presume that U.S. common-law practitioners can build the rule of law by transporting or transplanting their technocratic techniques into such different legal soil. Indeed, the very idea that people in Arab societies would be receptive to American guidance in legal reform is dubious in the current climate of broad, popular mistrust of the United States.

MIXED RESULTS FROM THE PROLIFERATION OF WESTERN RULE OF LAW assistance over the past twenty years has taught us much about what efforts do not work. Criminal justice reform in Russia offers a different type of lesson; it is a rare success story of rule of law promotion. In the 1990s, the U.S. government sought to promote the rule of law in many parts of the former Soviet Union and beyond, but few of these efforts outside Russia produced concrete results. Instead, lawlessness became a primary symptom of the apparent failure of many attempted rule of law reforms in the former Soviet Union.

Bush administration in September 2002 laid out in the “National Security Strategy of the United States” its strategy toward China: “We welcome the emergence of a strong, peaceful, and prosperous China.” During a trip to Asia in March 2005, Secretary of State Condoleezza Rice adopted a similar phrase to welcome “the rise of a confident, peaceful, and prosperous China.”

BETWEEN 2002 AND 2004, THE UNITED STATES ACCORDED new prominence to political and economic reform and democratization as policy goals in the Middle East. Continuing that trend and translating rhetoric into effective strategies both depend on whether reform and democratization become fully integrated into the U.S. policy agenda in the region. Can the United States promote change at the risk of instability in the region while it remains dependent on petroleum from Arab countries? Can it pursue Arab–Israeli peace and democratization at the same time? Can the United States still secure needed military and counterterrorism cooperation if it antagonizes friendly regimes by promoting democratization as well? Is it feasible for the United States to promote democratization effectively amid widespread grievances against the war in Iraq and serious questions about U.S. human rights practices there and in Afghanistan?

Abstract:
Although the current rule-of-law promotion field is still expanding as it approaches the end of its second decade, it still faces a lack of knowledge at many levels of conception, operation, and evaluation. There is a surprising amount of uncertainty, for example, about the twin rationales of rule-of-law promotion—that promoting the rule of law will contribute to economic development and democratization. There is also uncertainty about what the essence of the rule of law actually is—whether it primarily resides in certain institutional configurations or in more diffuse normative structures. Rule-of-law promoters are also short of knowledge about how the rule of law develops in societies and how such development can be stimulated beyond simplistic efforts to copy institutional forms. And the question of what kinds of larger societal effects will result from specific changes in rule-of-law institutions is also still open. Although aid institutions engaged in rule-of-law assistance do attempt some—lessons learned—exercises, many of the lessons produced are superficial and even those are often not really learned. Several substantial obstacles to greater knowledge accumulation in this field persist, including the complexity of the task of promoting the rule of law, the particularity of legal systems, the unwillingness of aid organizations to invest sufficient resources in evaluations, and the tendency of both academics and lawyers not to pursue systematic empirical research on rule-of-law aid programs. Whether rule-of-law aid is on the path to becoming a well-grounded field of international assistance remains uncertain.

His stop in China will be especially significant. We at Carnegie believe that it is beyond question that we are living in a world of very fundamental change in the meaning and the relevance of national borders; in the relationship of governments, not so much to each other, but to other entities that are capable of governance, particularly internationally and especially private business and non–governmental organizations; and even to the meaning of national sovereignty. All that is the premise that underlies a major thrust of our work here in the Global Policy Program. It is also pretty clear to us that a principal, if not the principal, driving force of this change is the information and communication revolution and the accompanying mass of information, in its new form, that we are coming to call transparency as a political phenomenon. We also think that there are pretty good reasons to believe that the advent of high resolution commercial imagery is going to be another quantum leap in this revolution. And so it was natural for us to think that it would be useful to try to organize a meeting where we could examine the possibilities and the consequence of this emerging technology in some detail, both with respect to the implications for particular sectors? national security, environment, human rights, et cetera? but equally with respect to the effects on governance on political relationships, on difficulties or advantages that will be posed on the relationships between governments and media as well as other non–governmental actors. All of these issues, as you can see from the program, are on the agenda today.
