351. Public Opinion in Ukraine Prior to the 2007 Rada Elections

Abstract:
This is the 15th public opinion poll conducted in Ukraine by IFES. This report details findings from the latest IFES survey in Ukraine and references findings from earlier surveys done in Ukraine. The fieldwork was conducted from August 28 – September 11, 2007 with 1265 respondents throughout Ukraine. This sample comprised a national sample of 1,200 respondents and an over-sample of 65 respondents in Kyiv. The data has been weighted by region, age, and gender to be nationally representative for the adult (18+) population of Ukraine. The margin of error for a sample of this size is plus/minus 2.75%. The fieldwork and data processing for the survey were conducted by GfK Ukraine, based in Kyiv. Funding for the survey was provided by the United States Agency for International Development (USAID).

The meeting of the Lebanese Parliament on Tuesday 23 October 2007 to elect a new President of the Republic has been adjourned to 21 November. After earlier attempts to hold the vote failed to take place and without any parliamentary consensus on procedures or candidates, this IFES Lebanon briefing paper outlines some of the key constitutional and procedural issues that may arise.

353. Advancing Reforms in Philippine Election Administration and Management: Toward a Comprehensive Approach

Abstract:
In response to an invitation issued by the president of the Republic of the Philippines, IFES and its CEPPS partners, composed of international development and political party specialists from the International Republican Institute and the National Democratic Institute, deployed a team of representatives in early March 2004 to the Philippines to assess the political situation leading up to the May 10 Presidential and Legislative Elections. As previous IFES projects have outlined, the electoral situation in the Philippines is particularly if not unusually complex, partly due to its long and turbulent history of democracy and its associated electoral process. The team found that the 2004 election cycle was particularly flawed. COMELEC's plans and programs for the May 10 elections were disrupted by the late release of funds by Congress and the Supreme Court's decisions to stop the automation of polling, counting, and transmission of results from taking place. Transition to a computerized central voter registry was similarly abandoned only days before the election and election officers reverted to using manual voters' lists and voter records. Voter education efforts were uncoordinated and poorly implemented. The training of polling officials was done through parallel training programs developed by the Department of Education, COMELEC, and civil society. COMELEC's training was judged to be the least effective of the three and the most poorly organized.

Abstract:
This paper presents two major arguments about electoral management bodies (EMBs). First, they are increasingly developing worldwide as commissions that are both permanent and independent of the executive. Second, electoral administration that relies on permanent and professional staff is more cost-effective than ad hoc electoral bodies that use wholly temporary personnel. Empirical evidence from 148 countries is gathered here to support both these ideas.

Abstract:
IFES believes all countries, including China, should publish an annual State of the Judiciary Report that will serve as both an internal and external tool that can be used by multiple stakeholders for multiple purposes, including promoting and systematically reporting on needed reforms and key issues. It should be disseminated to the public at large, as well as to targeted stakeholders, such as the business and human rights communities, bar associations, judges, reformers, policy-makers and donors. We believe the publication and distribution of the report will increase the quality and quantity of concrete information on the judiciary, more transparency, accountability and public awareness, qualitative comparative research and valuable cross-country lessons learned and judicial competition. 357. Corruption in China: Half-way Over the Great Wall

Abstract:
The legal-judicial transformation taking place behind China's Great Wall outpaces most other developing and transitional countries, but is reaching a critical crossroads. If the pace of judicial reform is maintained and implemented, it has the potential to impact on China and the world's future as much as the economic reforms of the last two decades, if not more so. The judicial system is emerging as a key institution in the reform process, and key decisions related to judicial independence in coming years will largely determine China's stature and place within the global community, and the government's relationship with its citizens. 1 In a relatively short period of time, new criminal, civil and administrative law codes, anti- corruption laws, as well as thousands of judicial, economic and administrative regulations have either been passed, repealed or undergone substantial reform. Property rights and institutional reforms have also been enshrined in the constitution, an important Judges Law professionalising the judiciary has been passed and a number of important treaties have now been ratified. For the first time in modern Chinese history, the courts and legal profession are slowly but surely emerging as important, professional institutions with growing power. The main question of the day is whether China's leaders will now make the structural, judicial and political reforms necessary to address corruption and create an independent judiciary – albeit with Chinese characteristics.

359. A Regional Strategy for Promoting a Free Media and Freedom of Expression in the Middle East and North Africa

Abstract:
The main objective of this paper is to encourage open debate and reform action in the Middle East and North Africa (MENA) region on the need to create the legal and political enabling environment necessary to promote good governance, the Rule of Law and citizen participation. The paper notes that many of the defamation laws in the region still contain criminal penalties, including high fines and imprisonment, and that the threat and enforcement of these laws and policies leads to government censorship, self-censorship and sometimes imprisonment. These practices are now well understood as counter to international obligations and best practices as well as to the guarantees of a free media and free speech enshrined in most MENA Constitutions. The net result of these practices is a culture of secrecy that presents high barriers to sustainable economic and political reform. Collectively, this secrecy effectively muzzles open discussion and critical reform debate and makes the promotion of basic human rights and a good governance reform agenda virtually impossible.

360. Ethiopia: Implications of the May 2005 Elections for Future Democratization Programs

Abstract:
May 15, 2005 elections presented the Ethiopian people a remarkable opportunity to express their political views by participating in a poll that offered them a meaningful choice. In contrast to earlier elections in 1995 and 2000, opposition parties did not boycott but rather competed vigorously across the country. Opposition party mistrust of the National Electoral Board of Ethiopia (NEBE), reports of intimidation and violence, and highly polarizing rhetoric raised concerns during the pre-election period but did not deter opposition parties from campaigning in nearly every constituency. Live, televised debates on matters of public policy, opposition party access to state-owned media, and huge, peaceful rallies in the final week of campaigning made it clear that these elections would represent a critical moment in Ethiopia's political development. The Ethiopian people recognized this opportunity and turned out in overwhelming numbers to vote, forcing some polling stations in Addis Ababa to stay open 24 hours to accommodate those in line.
