Abstract:
Mohammad Darawshe's article analyzes the factors behind the historic low in the participation rate of Arab citizens, who stood at only 49.2% in the last elections. For the Arab voter, there weren’t compelling reasons to vote in the 2019 Knesset elections. In fact, a number of reasons motivated them not to. Quarrels around the issue of seat rotation plagued the Joint List and clarified for the Arab voter that the hope for unity had been lost. The Arab public therefore decided to punish the parties, taking from them the privilege it had given, returning them to their natural size in order to school them in the laws of modesty. Arab voters perceived the Nation-State Law as the antithesis of the integration to which they aspire. The law conveyed a clear message to Arab citizens that a border had been placed before them, and that they should not cultivate aspirations for class equality. Arab leaders must open the ranks of leadership and accept into it pragmatic social and economic figures. The mechanism of political parties are outdated and no longer reflect the new moods of the Arab public. There is no doubt that it is time to open a new chapter in Center-Left relations with Arab society. Without Arab cooperation, the Center-Left bloc will never come to power. Conversely, without the partnership of the Center-Left, the Arab public will not be able to influence decision-making in the state of Israel.

Abstract:
Dr. Salim Brake, in the current issue of Bayan, analyzes the considerations and voting patterns of the Druze in the Knesset elections. The Druze generally vote on utilitarian considerations, such as voting for parties expected to be included in the coalition and to influence government policy. Few of them vote for ideological motives. Social networks voiced fierce criticism following two legislative acts that have hurt Druze over the past year: Kaminitz Law and Nation State Law. Despite this, the Druze artificially separated their stance on these laws and voted for parties that supported those laws. The Blue-White party spoke against the Nation State Law in its current form, and as a result, drew significant support from the Druze community. However, Blue-White is only committed to amending the law and including a clause referencing equality within it, and not eliminating it as Druze hoped. The increase in support for the "Israel Beitenu" party is due to the fact that the Druze representatives in the Likud are not seen as representing the real interests of the Druze community. In addition, the Druze candidate in the "Israel Beitenu" party expressed opposition to the Nation State Law.

925. International Criminal Liability in the Age of Social Media: Facebook's Role in Myanmar

Abstract:
Criminal liability in international law is unique from that of most national legal systems in that it extends to those physically distant from the crime. International law’s expanded notions of criminal liability and commission are what have made it possible for justice institutions – first the Nuremberg International Military Tribunal (IMT) in 1945 and now the International Criminal Court (ICC) – to hold high-level perpetrators who order, plan, coordinate, or facilitate mass atrocities from afar accountable for their actions. A question that international legal authorities have largely left unanswered is how this expanded notion of criminal liability might be applied in the age of global online networks and in particular, social media. There is mounting evidence that in addition to helping us stay connected and “bring the world closer together,” social media platforms are being used to proliferate ideas that result in real-world violence.

926. Domestic Prosecution of International Crimes

Abstract:
In October 2018, the Bosnian state court indicted a former soldier of crimes against humanity for his involvement in the murder and enforced disappearance of civilians in the Kljuc area. In September of that year, a German court convicted Ibrahim Al F. for war crimes committed in Syria and in the same month a military tribunal in the Democratic Republic of the Congo found two military commanders guilty of crimes against humanity committed in the villages of Kamananga and Lumenje (South Kivu). These are just three recent examples of domestic efforts in the prosecution of those responsible for international crimes. Based on the complementarity principle of the International Criminal Court (ICC), where states are “unwilling or unable” to prosecute international crimes, the ICC may step in to prosecute those most responsible for the commission of the crimes under its jurisdiction, namely genocide, crimes against humanity, war crimes, and the crime of aggression. However, out of 28 cases before the Court since its inception in 2001 only three resulted in successful convictions. Several suspects were acquitted after lengthy proceedings, of which Gbagbo and Blé Goudé are the latest examples. Therefore, the ICC should be regarded as a last resort while domestic courts carry the main responsibility to prosecute those responsible for international crimes.

927. To Be Genocide or Not to Be Genocide, That Is the Question

Abstract:
Between the 7th and 10th February 2019, Human Rights Watch organized, in cooperation with De Balie, the seventh edition of the Human Rights Weekend. This year’s topic was “Where do I stand” and invited the attendees to think about how they are (in)directly involved in human rights violations and how they can contribute in ending these violations. The program consisted of masterclasses, lectures, and documentaries. One of these documentaries showed the incredible story of Nadia Murad. Nadia is a Yazidi girl, who witnessed her community being murdered by ISIS. She was later captured herself and forced to become a sex slave. Today she is known as the most recent Nobel peace Prize winner for her global advocacy campaign to fight for the rights of the Yazidi. This campaign consists of addressing heads of states and governments, asking for help for the survivors and for the attack on her people to be considered as genocide. Whereas some states have indeed passed legislation that recognizes the events as genocide, others refuse to do so until the United Nations (UN) itself officially uses the word genocide to describe the atrocities.

Abstract:
The October 2018 Warsaw Security Forum (WSF) gathered government, military, and think tank personnel from Central and Eastern Europe (CEE) and beyond (including a delegation from Japan) in one of Europe’s most prominent Track 1.5 dialogues to focus upon the deteriorating regional and global security environment. Just as the emphasis of their Asian counterparts has been on revisionist challenges to the regional security order in the Indo-Pacific, the WSF focused upon the aggressive behavior of the Russian Federation (Russia) toward its neighbours in CEE and its so-called “near abroad”. As the host country celebrating 100 years of independence, Poland, along with its CEE counterparts in NATO/EU, are countries that are acutely aware of the dangers presented by Russian actions and know that, as history has taught them, their sovereignty cannot be taken for granted. A disintegration of the liberal world order, international law, and the Transatlantic relationship, would leave small, and even medium-sized, states at the potential mercy of more powerful and aggressive neighbours

930. A Comparative Study of the Kashmir Conflict Coverage in Pakistani and Indian Press

Abstract:
The paper compares the coverage of J&K conflict in the Pakistani and Indian English press. The objective of the study is to figure out the differences in the coverage of Kashmir conflict by the Indian and Pakistani press along with determining the prominence of war or peace frames in the coverage. Content Analysis was carried out of the news stories published on the international and national pages of English daily The Nation and Dawn from Pakistani press and English daily The Hindu and Times of India from the Indian press. The results revealed that war framing was recorded as the most dominant coverage pattern with respect to Kashmir conflict. War frames were more dominant in the Indian press coverage as compared to the Pakistani press and the differences in the coverage of the press of the two countries are significant.
