1501. Data Is Different: Why the World Needs a New Approach to Governing Cross-border Data Flows

Abstract:
Companies, governments and individuals are using data to create new services such as apps, artificial intelligence and the Internet of Things. These data-driven services rely on large pools of data and a relatively unhindered flow of data across borders (few market access or governance barriers). The current approach to governing cross-border data flows through trade agreements has not led to binding, universal or interoperable rules governing the use of data. Most countries with significant data-driven firms are in the process of debating how to regulate these services and the data that underpins them. But many developing countries are not able to participate in that debate. Policy makers must devise a more effective approach to regulating trade in data for four reasons: the unique nature of data as an item exchanged across borders; the sheer volume of data exchanged; the fact that much of the data exchanged across borders is personal data; and the fact that although data could be a significant source of growth, many developing countries are unprepared to participate in this new data-driven economy and to build new data-driven services. This paper begins with an overview and then describes how trade in data is different from trade in goods or services. It then examines analogies used to describe data as an input, which can help us understand how data could be regulated. Next, the paper discusses how trade policy makers are regulating trade in data and how these efforts have created a patchwork. Finally, it suggests an alternative approach.

Abstract:
As the domain of civil society burgeoned in the 1990s and early 2000s—a crucial component of the global spread of democracy in the developing and postcommunist worlds—many transnational and domestic actors involved in building and supporting this expanding civil society assumed that the sector was naturally animated by organizations mobilizing for progressive causes. Some organizations focused on the needs of underrepresented groups, such as women’s empowerment, inclusion of minorities, and LGBT (lesbian, gay, bisexual, and transgender) rights; others addressed broader societal issues such as economic justice, social welfare, and antipoverty concerns. In many countries, the term “civil society” came to be associated with a relatively bounded set of organizations associated with a common agenda, one separate from or even actively opposed by conservative political forces. However, in the past ten years, this assumption and outlook are proving increasingly incorrect. In many countries in the developing and postcommunist worlds, as well as in long-established Western democracies, conservative forms of civic activism have been multiplying and gaining traction. In some cases, new conservative civic movements and groups are closely associated with illiberal political actors and appear to be an integral part of the well-chronicled global pushback against Western liberal democratic norms. In other cases, the political alliances and implications of conservative civil society are less clear. In almost all cases—other than perhaps that of the United States, where the rise of conservative activism has been the subject of considerable study—this rising world of conservative civil society has been little studied and often overlooked. This report seeks to correct this oversight and to probe more deeply into the rise of conservative civil society around the world. It does so under the rubric of Carnegie’s Civic Research Network project, an initiative that aims to explore new types of civic activism and examine the extent to which these activists and associations are redrawing the contours of global civil society. The emerging role and prominence of conservative activism is one such change to civil society that merits comparative examination. Taken as a whole, the report asks what conservative civic activism portends for global civil society. Its aim is not primarily to pass judgment on whether conservative civil society is a good or bad thing—although the contributing authors obviously have criticisms to make. Rather, it seeks mainly to understand more fully what this trend entails. Much has been written and said about anticapitalist, human rights, and global justice civil society campaigns and protests. Similar analytical depth is required in the study of conservative civil society. The report redresses the lack of analytical attention paid to the current rise of conservative civil society by offering examples of such movements and the issues that drive them. The authors examine the common traits that conservative groups share and the issues that divide them. They look at the kind of members that these groups attract and the tactics and tools they employ. And they ask how effective the emerging conservative civil society has been in reshaping the political agenda.

1503. Euro-area Governance Reform: The Unfinished Agenda

Abstract:
Since the debt crisis of 2010-2012, sustained efforts toward deeper integration, supported by accommodative monetary policy, helped promote the recovery of the euro-area economy and dispelled fears of a breakup of the single currency. Fiscal rules were tightened and macro surveillance tools were set up for crisis prevention. Yet significant challenges remain to be tackled. Gaps remain in the euro-area architecture; limited progress has been made in establishing the Capital Markets Union and the banking union remains incomplete. Today’s environment of solid growth remains an ideal time to advance the reform agenda. There is wide agreement that building a well-functioning and resilient monetary union in Europe requires further steps to break the bank-sovereign doom loop and to increase risk sharing among members of the union. Many competing proposals have been tabled to make the governance of the euro area more robust. Views differ on the shape and sequencing of reforms, and on the degree of integration that is ultimately desirable, with some observers arguing for a full fiscal union with shared risk, and others going all the way to full political union through the creation of a federal state. This paper assesses and prioritizes key proposals that are economically sound and politically feasible.

1504. Canada Needs Standards to Support Big Data Analytics

Abstract:
Standards can bring clarity on definitions, systems architecture, data ownership, grading, pooling, storage, disposal and set the bar regarding privacy and aggregation requirements. They are a necessary precondition for interoperability and commoditization to occur throughout value chains and across sectors. Canada has virtually no institutional capacity to develop standards in the information and communication technology sector. This policy brief proposes the creation of a standards collaborative that would be entrusted with the development of a standards road map to support big data analytics.

1505. The Content of a WTO Climate Waiver

Abstract:
Neither the trade regime nor the climate regime has so far displayed any willingness to confront the coming clash between climate ambitions and trade rules. To minimize the economic and political risks of such a collision, the members of the World Trade Organization (WTO) should adopt a WTO climate waiver. To further carbon pricing and to facilitate the necessary green transition in the global economy, the core of a WTO climate waiver should be a waiver from the applicable trade rules for national measures that: discriminate on the basis of carbon and other greenhouse gases used or emitted in making a product; fit the definition of a climate response measure as defined by the United Nations Framework Convention on Climate Change; and do not discriminate in a manner that constitutes a means of arbitrary or unjustifiable discrimination or a disguised restriction on international trade. A WTO climate waiver should also include support for trade restrictions by carbon markets and climate clubs, trade disciplines on fossil fuel subsidies, and green subsidies that support innovative outcomes rather than particular technologies. Along with a climate waiver, WTO members should also confirm that carbon taxes qualify as border tax adjustments under trade rules. The adoption of a WTO climate waiver is a central and critical part of the overall reimagining of international trade law that is needed to fulfill the stated WTO goal of engaging in trade and other economic endeavours consistently with the objectives of sustainable development.

Abstract:
South Africa has a rich tradition of Indigenous knowledge covering uses of the country’s abundant natural resources. South Africa’s development of a multi-faceted framework for cultural and genetic resource protection in relation to Indigenous knowledge is a promising source of fruitful insights on the challenges and benefits of implementing such protections. As the first in a series of case studies featuring various models of traditional knowledge implementation in domestic legislation, this paper provides an overview of how South Africa is approaching the protection of traditional or Indigenous knowledge. A central aim of this series is to provide objective evidence and insight into national experiences that could serve to inform and support effective policy development in the field, without endorsing any particular national approach.

1508. Simultaneous Disasters in Southeast Asia: Is Risk Outpacing Resilience?

Abstract:
Since Southeast Asian leaders signed the ASEAN Agreement on Disaster Management and Emergency Response (AADMER) in 2005, the region has prioritised developing national and regional disaster management capabilities to respond to disasters. However, the recent back-to-back disasters that occurred between July and August 2018 tested the response capacities of national governments and the humanitarian community. Parts of Myanmar, Vietnam, Laos, Cambodia and the Philippines battled floods of varying severity induced by seasonal monsoon rains, tropical storms and a dam collapse on a tributary of the Mekong River. Meanwhile, Indonesia’s Lombok Island, West Nusa Tenggara was hit by multiple earthquakes and aftershocks between 29 July and 19 August. The ASEAN Coordinating Centre for Humanitarian Assistance on disaster management (AHA Centre) reported that at the peak of these disasters, over 588,000 people were displaced and more than 5.2 million people in Southeast Asia were affected. Against the backdrop recent disasters generating simultaneous responses, this NTS Insight makes key observations on Southeast Asia’s ability to meet the immediate needs of disaster-affected communities while building greater disaster resilience for the future. It assesses the (i) institutionalisation of disaster management in ASEAN; (ii) localisation of disaster response; and (iii) opportunities for financial risk management for building disaster-resilient communities.

Abstract:
Almost two decades since the adoption of the UN Convention against Transnational Organised Crime, and specifically the Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children, the debates on addressing human trafficking have not veered far beyond questions of law enforcement efficacy. What makes law enforcement against human trafficking so challenging in the East Asia region? This NTS Insight examines the nature of international legal frameworks that address human trafficking and the way they influence regional and domestic anti-trafficking legislation in East Asia. It argues that human trafficking as a crime is often “hidden” from the one-size-fits-all anti-trafficking legal regime adopted in domestic or national settings. The report argues that drawing the crime of human trafficking out of the shadows is made difficult by (i) the ambiguous definition of human trafficking in international law; (ii) the disjuncture between human trafficking contexts in East Asia and what international anti-trafficking legal regimes seek to address.

1510. Combatting Human Trafficking in East Asia: Mind the Gaps

Abstract:
Despite the ratification of global and regional anti-trafficking frameworks and enactment of relevant national laws, human trafficking remains an endemic security problem in East Asia, threatening states and societies. Two-thirds or 25 million of global trafficking victims were identified to be in the region. This NTS Insight briefly reviews the current regional trends and patterns of human trafficking in East Asia. It demonstrates that robust legal frameworks, while absolutely important, are not sufficient to eradicate and prevent human trafficking. It primarily analyses three fundamental issues that impede effective law enforcement and the eradication of human trafficking in East Asia: (1) weak law enforcement capacity of states; (2) the persistent corruption-trafficking nexus; and (3) limited support services and protection assistance for victims. It highlights the importance of developing and adopting a victim-centered approach in order to make anti-trafficking efforts more holistic and effective.
