211. Informal Interference in the Judiciary in New Democracies: A Comparison of Six African and Latin American Cases

Abstract:
This paper assesses the extent to which elected power holders informally intervene in the judiciaries of new democracies, an acknowledged but under-researched topic in studies of judicial politics. The paper first develops an empirical strategy for the study of informal interference based on perceptions recorded in interviews, then applies the strategy to six third-wave democracies, three in Africa (Benin, Madagascar and Senegal) and three in Latin America (Argentina, Chile and Paraguay). It also examines how three conditioning factors affect the level of informal judicial interference: formal rules, previous democratic experience, and socioeconomic development. Our results show that countries with better performance in all these conditioning factors exhibit less informal interference than countries with poorer or mixed performance. The results stress the importance of systematically including informal politics in the study of judicial politics.

The familiar world of international organizations principally devoted to development has been upended by two phenomena. First is the emergence of sustained economic success in the developing world (mostly in Asia, but increasingly also in Africa and, in a less spectacular way, Latin America) amid compelling, continuing need among the world's poor. Second, the slow-moving, serious financial and economic crisis of the industrialized world since 2008 has reordered priorities in many of their capitals toward domestic spending and away from costly international projects.

You asked me, as an independent expert, to contribute to the General Assembly Thematic Debate on 'Ensuring Stable and Peaceful Societies.' Since receiving your request, I have completed a review of the deliberations of the Open Working Group on this issue and of other relevant contributions to the post-2015 development agenda. I have also consulted informally with representatives of member states, UN agencies, and other stakeholders. While I have found widespread support for the need to foster peaceful, non-violent, and inclusive societies, there is some disagreement as to how this objective can be achieved within the context of the post-2015 development agenda. Rather than repeat material contained in existing reports on stable and peaceful societies, I thought it would be more useful to offer some reflections on the sources of agreement between member states, and the potential to move towards consensus in areas where they disagree. This will, I hope, help all those participating in the thematic debate respond to your challenge to identify concrete ways in which peace and stability can underpin an economically, socially and environmentally sustainable future.

214. Women's economic opportunity: A new pilot index and global ranking

Abstract:
Women's political and economic empowerment has been a defining feature of the last century. Millions of women in the early 1900s rejected convention and ignorance to fi ght for the right to vote. Thirty years later the daughters and granddaughters of those suffragettes, defying stereotypes, flocked to factories to help build the machines that won the second world war. The next generation of women secured their rights in law, then entered the workforce in droves, fuelling economic growth in the 1980s and 1990s. At the start of the 21st century women are not just enfranchised and fully engaged in the workplace, but leading global corporations and countries of every size. Germany's Angela Merkel, Liberia's Ellen Johnson-Sirleaf, and Pepsico's Indra Nooyi are three among many. Yet after a century of impressive progress, overall economic opportunities for women still lag those of men. Women, on average, earn 75% of their male co-workers' wages, and the difference cannot be explained solely by schooling or experience. In many countries, women have fewer educational and employment opportunities than men, are more often denied credit, and endure social restrictions that limit their chances for advancement. In some developing countries women still cannot vote, own property or venture outside the home without a male family member.

Abstract:
Writing in the 1990's, William Easterly and Ross Levine famously labeled Africa a "growth tragedy." Less than twenty years later, Alwyn Young noted Africa's "growth miracle," while Steven Radelet less effusively pointed to an Africa that was"emerging" and noted its rising rate of economic growth, improving levels of education and health care, and increasing levels of investment in basic infrastructure: roads, ports, and transport. In this paper, we address Africa's economic revival. In doing so, we also stress the political changes that have taken place on the continent. Once notorious for its tyrants – Jean – Bedel Bokassa, Idi Amin, and Mobutu Sese Seko, to name but three – in the 1990s, Africa joined the last wave of democratization; self-appointed heads of state were replaced by rulers chosen in competitive elections. In this paper, we assert that the two sets of changes – the one economic and the other political – go together, and that, indeed, changes in Africa political institutions lent significant impetus to its economic revival.

217. The Politics of Polarization: Governance and Party System Change in Latin America, 1990–2010

What are the causes and implications of polarization in new democracies? During Latin America’s “Left Turn” period, highly polarized party systems emerged in some countries–Venezuela, Bolivia, Ecuador, Nicaragua, and El Salvador–but not the rest of the region. This paper proposes a theory to explain variation, centered on the presence of electorally relevant parties of the left in the pre-Left Turn period and, most critically, the quality of governance in that period. Poor governance created opportunities for partisan actors on the left to politicize a second dimension of political contestation, anti-systemic versus systemic positions on the design and operation of the state, and thus chart alternative paths to electoral viability that required little left-right programmatic moderation. This dynamic empowered radical party factions and drove polarizing dynamics in party systems. High quality governance, in contrast, gave left parties little choice but to moderate their programs in search of electoral viability. This dynamic empowered moderate party factions and drove centripetal dynamics in party systems. Empirically, the paper tests these arguments through a broad overview of the case universe and in-depth case studies of Venezuela and Brazil.

Abstract:
Development organisations face numerous challenges in the context of violent conflict. Development cooperation has to be sensitive to conflict in order to be effective and do no harm. PCIA as developed by Kenneth Bush is one approach among others to ensure conflict sensitivity for development and peacebuilding efforts. This working paper applies Bush’s concept of PCIA to the Palestinian case in order to analyse benefits, limitations and potential improvements of his approach. His specific method will be discussed critically based on a literature review and expert interviews conducted with practitioners from the most relevant state and multilateral development agencies. Considering the specific challenges in the Palestinian context this study aims to contribute to the debate on conflict sensitive development cooperation. The analysis of the Palestinian case eventually should help to identify gaps and potential fields for future research.

219. The Return of Religion? The Paradox of Faith-Based Welfare Provision in a Secular Age

Abstract:
For centuries, churches were the main institutional providers of welfare in Europe before the state took over this role in the late 19th century. The influence of modernization theory meant that modern welfare state theorists increasingly regarded religion and its impact on welfare as a relic from the distant past. It was anticipated that modern, differentiated, and industrialized societies would see the decline and inevitable disappearance of religious welfare provision along with religiosity. Surprisingly, however, at the beginning of the 21st century in many modern industrialized societies, religious institutions are increasingly becoming involved in welfare provision again. The religion blind classic welfare state literature offers no explanation for this phenomenon. This present paper argues that the resurgence of faith-based welfare providers is the reversal of a phenomenon that occurred in the late 19th century when modern states started to strip religious providers of their prerogatives in welfare provision. The result was the ascendance of the modern state and the demise of religion in the late 19th century. The return of welfare to religious providers can therefore be interpreted as the beginning of the demise of the modern state.

220. Pathways of Transnational Activism: A Conceptual Framework

This paper presents a novel analytical framework to study transnational activism in the context of today’s international governance architecture. While there is a considerable amount of literature on the emergence, development, and effects of transnational activism in specific transnational governance arrangements or within a specific local context, an integrated framework that analyzes the dynamic interplay between activism, transnational institutions, and domestic contexts is still lacking. The framework of transnational pathways of influence intends to help close this gap. It integrates insights from social movement research on transnational collective action and insights from institutional theorists on institutional interactions. The framework consists of three major concepts: the concept of intra-pathway dynamics captures the relationship of mobilization and institutional chance within one path; the concept of inter-pathway dynamics encompasses institutional interactions and interdependencies between activism across paths; and the concept of the global–local link characterizes the relationship of activism within each path to local actors, the domestic context, and the political regime. The paper outlines this framework and exemplifies it by taking the case of transnational labor-rights activism targeting labor-rights violations in a strong and nondemocratic state: the People’s Republic of China. It shows that the study of activism across different transnational pathways over time is necessary to understand the combined effects of activist interventions, institutional co-evolution and interaction as an explanation of the process of selective convergence between global norms and local practices.
