851. Japan’s new assertiveness: institutional change and Japan’s securitization of China

Abstract:
In recent years, Japan's foreign policy elite has started to increasingly securitize China in their security discourse. The harsher tone from Tokyo is widely evaluated as a direct reaction to China’s own assertive behavior since 2009/2010. Yet, the change in the Japanese government’s rhetoric had started changing before 2010. In order to close this gap, the present article sheds light on an alternative causal variable that has been overlooked in the literature: a change in Japan’s security institutions, more specifically, the upgrade of the Defense Agency to the Ministry of Defense, in 2007. While utilizing discursive institutionalism and securitization-approaches, the present article demonstrates that a strong correlation indeed exists between the institutional shift and the change in Japan’s defense whitepapers in the 2007–10 period. It thus opens up a research avenue for the further scrutiny of the hitherto understudied but significant causal linkage in the study of contemporary Japanese security policy toward China

852. Detecting patterns in North Korean military provocations: what machine-learning tells us

Abstract:
For the past two decades, North Korea has made a series of military provocations, destabilizing the regional security of East Asia. In particular, Pyongyang has launched several conventional attacks on South Korea. Although these attacks seem unpredictable and random, we attempt in this article to find some patterns in North Korean provocations. To this end, we employ a machine-learning technique to analyze news articles of the Korean Central News Agency (KCNA) from 1997 to 2013. Based on five key words (‘years,’ ‘signed,’ ‘assembly,’ ‘June,’ and ‘Japanese’), our model identifies North Korean provocations with 82% accuracy. Further investigation into these attack words and the contexts in which they appear produces significant insights into the ways in which we can detect North Korean provocations.

Abstract:
This chapter looks at English School (ES) theory as a way of understanding China and its rise. It focuses both on where ES theory fits well enough with China to provide an interesting perspective, and on where ‘Chinese characteristics’ put China outside the standard ES framing and raise theoretical challenges to it. The first section briefly reviews the ES literature on China. The second section places China within the normative structure of contemporary global international society by looking at how China relates to the primary institutions that define that society. The third section explores two challenges that ‘Chinese characteristics’ pose for how the ES thinks about international society: hierarchy and ‘face’. The Conclusions assess the strengths and weaknesses of ES theory in relation to understanding the rise of China.

Abstract:
Chinese government representatives and scholars have attempted to ameliorate fears about China’s rise by portraying China as a new and friendlier kind of great power. It is claimed that this represents a new way of relating which transcends problematic Western understandings of Self–Other relations and their tendency to slip into domination and enmity. This article takes such claims as a point of departure, and analyses them with focus on the explicit discussions of friendship in international relations theory. Paying attention to current Chinese thinking which emphasizes guanxi relationships, friendship can contribute to the development of genuinely relational international relations thinking and move beyond a focus on ossified forms of friendship and enmity centred on the anxious self. The vantage point of friendship suggests a way out of the dangers of theorizing Self in contrast to Other, and reopens the possibility to conceptualize Self with Other.

855. Toward a new relational ontology in global politics: China’s rise as holographic transition

Abstract:
The theoretical challenges for international relations (IR) posed by China’s rise cannot be adequately addressed at a mere theoretical level. Predicated on a Cartesian/Newtonian ontology that assumes a mechanistic world made up of discrete, self-contained parts (e.g., sovereign nation-states), mainstream IR theories offer limited understanding of China’s rise. In this article, I propose an alternative, holographic relational ontology. Drawing upon recent IR scholarship on relational ontology and holographic ideas in quantum physics as well as traditional Asian thoughts, this ‘new’ ontology posits that the world exists fundamentally as holographic relations, in which a part is a microcosmic reflection of its larger whole(s). As a part of various wholes in global politics, ‘China’ is thus never an entity in and of itself, but holographic reflections of them. Its rise is best understood as a phenomenon of holographic transition, in which characteristics of those larger wholes are being enfolded into what is known as ‘China’. Thus, both the ‘China’ challenges and ‘China’ opportunities, rather than some inherently ‘Chinese’ properties, are products of China’s holographic relations. This ontology has broader conceptual and methodological as well as policy implications for IR in East Asia and beyond.

Abstract:
The representation of emotions in Early Byzantine historical texts is still a field rich in potential for further investigations and interpretations. In this article, we aim to approach just a small section of this, looking at how some specific emotions: fear, love, anger, sorrow and joy, and their particular expressions, appear in Procopius' History of Wars. We look particularly at manifestations of emotions depicted in military and political contexts and ask how and why these fitted with societal norms and expectations, what were the gender specificities, real or imagined, of expressing emotions.

858. The Private Life of Family Matters: Curtailing Human Rights Protection for Migrants under Article 8 of the ECHR?

Abstract:
This article critically examines the evolving practice of the European Court of Human Rights (ECtHR) towards the definition and use of the concepts of family life and private life in cases involving migrants who seek to resist deportation by invoking Article 8 of the European Convention on Human Rights. The examination reveals an approach on the part of the Court that has the effect of shrinking the protection potential of Article 8 for migrant applicants, allowing state interest in expulsion to carry the day. This is symptomatic of Strasbourg’s deference to state sovereignty in the realm of migration. While the ECtHR has issued a number of landmark rulings roundly vindicating migrants’ rights, these are the exception to the rule of Strasbourg’s deference to state powers of immigration control. This approach has far-reaching implications for migrants in the member states of the Council of Europe. The article concludes by highlighting the tools at the Court’s disposal that could be employed to construct a more human rights-consistent approach in this strand of jurisprudence, which is an issue all the more relevant in light of the growing number of migrants seeking to establish a life in Europe.

859. Maritime Legal Black Holes: Migration and Rightlessness in International Law

Abstract:
This article explores the trope of the ‘legal black hole’ to reveal questions of legal theory arising from contemporary migrant drownings. The theme was popularized during what was then called the ‘war on terror’, but its trajectory is longer and more complex. Its material history, as well as its intellectual history within legal scholarship, suggest three distinct ‘legacies’ of legal black holes: the counterterrorism legacy; the migrant-detention legacy; and the legacy of the maritime legal black hole. The tripartite division provides a conceptual typology of instances where persons are rendered rightless. While the two former types are characterized by de facto rightlessness due to a violation of international law, the latter exposes a seldom acknowledged, yet crucial, characteristic of international law; the age-old doctrine on the division of responsibilities between states and individuals at land and at sea is now creating the conditions in which some people are rendered de jure rightless. Moreover, the typology sheds light on the specifically legal reasons for the seeming failure to end mass drowning of migrants and refugees in the Mediterranean Sea. Tracing the ways in which people become de jure rightless is ultimately suggested as a broader research agenda for scholars of international law.

860. The Return of Cultural Genocide?

Abstract:
Cultural genocide, despite contemporary thinking, is not a new problem in need of normative solution, rather it is as old as the concept of genocide itself. The lens of law and history allows us to see that the original conceptualization of the crime of genocide – as presented by Raphael Lemkin – gave cultural genocide centre stage. As Nazi crime was a methodical attempt to destroy a group and as what makes up a group’s identity is its culture, for Lemkin, the essence of genocide was cultural. Yet the final text of the Convention on the Prevention and Punishment of the Crime of Genocide (Genocide Convention) does not prohibit cultural genocide as such, and it is limited to its physical and biological aspects. What led to this exclusion? In this article, we examine the various junctures of law, politics and history in which the concept was shaped: the original conceptualization by Lemkin; litigation in national and international criminal courts and the drafting process of the Genocide Convention. In the last part, we return to the mostly forgotten struggle for cultural restitution (books, archives and works of art) fought by Jewish organizations after the Holocaust as a countermeasure to cultural genocide. Read together, these various struggles uncover a robust understanding of cultural genocide, which was once repressed by international law and now returns to haunt us by the demands of groups for recognition and protection.
