1. Naming Terror: Impact of Proscription on Negotiations with Non-State Armed Groups

Abstract:
This article explores what impact terrorist blacklists have on negotiated solutions to armed conflicts involving listed non-state armed groups. Even though conflicts that involve non-state armed groups do not usually end through these groups’ military defeat, governments around the globe tend to adopt hard-security approaches with regard to inner-state conflicts. Especially when groups resort to terrorist tactics, governments tend to be reluctant to engage peacefully with these actors and instead commonly rely on terrorist blacklists in order to delegitimize and restrict groups’ activities. While these blacklists are effective in criminalizing the operations of these groups, they can also severely impede peaceful dialogue and thus negatively impact the resolution of conflicts. Especially the work of NGOs and third-party peace practitioners is greatly constrained by criminalizing any form of interaction with listed groups. Additionally, in the absence of a universal definition of what constitutes a terrorist group, lists vary from country to country and the criteria for groups and individuals to get listed are often extremely vague. Furthermore, most lists fail to re-evaluate the proscribed groups on a regular basis and delisting procedures lack transparency. This article finds that blacklists severely disincentivize peaceful engagement with non-state armed groups and thus calls for a revision of contemporary proscription regimes in order to shift the focus of counterterrorism approaches towards viewing peaceful dialogue as a first option and not a last resort.

Abstract:
The disastrous event of 9/11 changed the Political and Security dynamics of the world. The event of 9/11 provided a chance for India to enter into Afghanistan. Afghanistan attracts the world powers due to its strategic importance. Afghanistan is a gateway to the energy rich Central Asian Republics. India’s involvement in Afghanistan is quite realistic. India had never established cordial relations with the Taliban regime in Afghanistan. The event of 9/11 gave India a chance to establish cordial relations with the Afghan political government. India participated in the Bonn Conference and announced its support for the people of Afghanistan in the reconstruction of the country. India enjoyed its best relations with the governments of Hamid Karzai and Ashraf Ghani in Kabul. India enhanced its ties with Iran to secure its interest in Afghanistan and to counter Pakistan. India and Iran have some common interests in Afghanistan. New Delhi has invested a big amount in various sectors in Afghanistan to enhance its influence in Afghan society. India has worked hard to facilitate Afghan Nationals to boost its soft power. India now influences the internal politics of Afghanistan. The world considers India a major market in South Asia. India’s presence in Afghanistan has always been a source of worry for Pakistan. Pakistan considers India’s presence in Afghanistan a threat to its National Security. Pakistan thinks India should work for the betterment of Afghan people but she should avoid using Afghan soil against Pakistan. Pakistan has already suffered a lot due to the disturbance in Afghanistan. Peaceful Afghanistan is in the favor of South Asia and for the Global Powers. This paper focuses on the Indian presence in Afghanistan and India’s role to bring peace in Afghanistan.

Abstract:
The existing literature on state-building has focused mainly on post-conflict cases and ‘conventional’ examples of statehood, without taking into consideration the particularities of states that remain internally and/or externally contested. The EU’s engagement in Palestinian state-building through the deployment of EUPOL COPPS and EUBAM Rafah has generated various types of unintended consequences: anticipated and unanticipated, positive and negative, desirable and undesirable, some of which fulfill and some of which frustrate the initial intention. These have important reverberations for the EU’s conflict resolution strategies in Israel and Palestine, the most important being the strengthening of power imbalances and the enforcement of the status quo.

Abstract:
On 8 July 2011, the Security Council established the United Nations Mission in South Sudan (UNMISS) to consolidate peace and security, and to help implement conditions for development. On 15 December 2013, violence broke out in the capital Juba and spread to several other locations, resulting in a countrywide armed conflict. The crisis had disastrous consequences for human rights in many parts of the country, especially in areas of greatest military confrontation. During the hostilities, UNMISS estimates that thousands of people were killed. Both parties to the conflict failed to comply with international humanitarian and human rights law directing attacks on civilians based on their ethnicity. As a result, a large number of Internally Displaced Persons (IDPs) sought refuge in UNMISS bases.

Abstract:
Over the years, the Taliban have overwhelmingly grown in influence and their stature is being well recognized; exerting more pressure on Washington’s future orientation in Afghanistan. Amidst the backdrop of transitions taking place in Afghanistan’s political landscape, the foreseeable future has, ostensibly, rekindled the prospects of peace. Although peace process is gradually moving further, yet both sides are reluctant to compromise on each others’ terms. Since the assumption of power, President Trump’s approach to Afghanistan has been oscillating in consulting varying options to bring the Taliban to their terms rather to indulge, in true spirits, in a widely acknowledged political framework for peace. These chosen policy actions posit more challenges and less opportunities for peace in war-ridden Afghanistan. The emergent scenario requires a comprehensive, well-crafted and compromising structure to be devised, featured with inclusiveness of all stakes and issues involved in this prolonged conflict. Evaluating and analyzing President Trump’s strategic policy toward Afghanistan, this paper aims to explore the manifesting failures and grey areas of Trump’s Afghan strategy and also attempts to provide strategic foresight while considering the framework of endgame in Afghanistan.

Abstract:
Economic development tends to bring stability in conflict ridden areas and mostly acts as a prescription for political stability and sustainability. In this context, Balochistan is one such study which implicates that deprivation and economic backwardness have been key players in intensifying conflict within and between the federal and provincial governments. Relative economic deprivation in Balochistan has become one of the root causes of conflict in the area. This study would focuses on developmental projects introduced by President General Pervez Musharraf in 2005 to pacify the intensity of insurgency in Balochistan.

Abstract:
The Trump Administration Middle East Plan appears to call for a Palestinian “Bantustan” (maybe two with Gaza) and legally enforced separation of communities based on ethnic grounds. It is difficult to believe that this resurrection from the discredited past could be acceptable to anyone but its authors, who appear to be completely oblivious to the history of South Africa. That includes Netanyahu, who has obviously been fully engaged in the plan’s development. However the plan will be unacceptable to everyone else, including Saudi Arabia and other Arab governments who have been flirting with Israel and the US in an informal anti-Iranian alliance. The plan would certainly exacerbate – if that is possible – the relationship between Israel and the Palestinians. The Kushner Plan would be like throwing oil on a fire; it will end badly for everyone concerned.

Abstract:
This article investigates whether international law prohibits the prosecution of children for war crimes and, if it does not, whether it should do so. In particular, the interplay between restorative and retributive post-conflict justice mechanisms, on the one hand, and juvenile rehabilitative justice mechanisms, on the other, is discussed in detail. The article suggests that in certain, narrow, circumstances children having committed war crimes should be prosecuted.

A strong army plays an important role for the defense and security of any country. Without a strong army, no country can survive smoothly. Unfortunately, in Pakistan, army remained dominant in the political and constitutional development since independence because of some loopholes in the political and constitutional system. Consequently, Pakistan had to face various military coups. In British India, Army neither tried to overrule the Constitutional and political decisions taken by the Government, nor took over the country and the same rule was followed by the Indian army after independence which ultimately strengthens their political institutions. Whereas Pakistan has to face various successful as well as unsuccessful coups which not only derail the political institutions but also destabilizes the social, economic and legal systems of the country. The purpose of this article is to critically analyze the role of army in the political and Constitutional development of Pakistan especially the role of courts in validation of the different coups imposed by military dictators. This article deals with the recent constitutional amendments and judgments delivered by superior courts and to look how far the judiciary can go to stop further military intervention in the political affairs of Pakistan?

Abstract:
Pakistan and India, two vital South Asian states have been at loggers head since 1947. The hostility and enmity has remained at top in their foreign policies for most of their mutual history. Both states have engaged in number of wars, border conflicts and diplomatic clashes. The trust deficit, blame game and relational gap has increased with the passage of time. The hostility has not only affected their mutual relationship but also has played the role in instable South Asian Region. There has been numerous conflict management efforts through diplomacy, negotiations and mediation but have ended in new conflict. These conflicts have created new hostilities and clashes between both neighboring states. Both shared same border but have never shared same policies and aspects on same page. This has led to the relational gap at both governmental level and social grounds.
