1. Civilian Protection in Libya: Putting Coercion and Controversy Back into RtoP

Abstract:
As noted by other contributors to this roundtable, the response of the international community to civilian deaths in Libya—and the threat of further mass atrocities—is unusual in two key respects. First, Security Council Resolution 1973 authorized “all necessary measures” to protect civilians without the consent of the “host” state. The Council's intentions, and actions, could not be interpreted as anything other than coercive. Second, in contrast to other crises involving alleged crimes against humanity (most notably Darfur), diplomacy produced a decisive response in a relatively short period of time. Both of these features suggest that many analysts of intervention (including myself) need to revise their previously pessimistic assessments of what is possible in contemporary international politics.

In June 2010 intercommunal violence exploded in Kyrgyzstan's southern cities of Osh and Jalalabad, resulting in the dramatic scene of thousands of ethnic Uzbeks fleeing their homes to avoid persecution by groups of ethnic Kyrgyz (allegedly backed by government troops). Reports of arson, rape, and other atrocities were widespread, accompanied by varying accounts of the number of civilians killed.1 The response to the persecution and displacement followed a pattern that we have seen before: calls for urgent international action by nongovernmental organizations, such as Human Rights Watch and the International Crisis Group, followed by a muted response on the part of international organizations (in this case, the Organization for Security and Co-operation in Europe and the United Nations Security Council). While both Russia and the United States were active in supporting efforts to organize humanitarian assistance to those affected by the violence, neither state was prepared to tackle the political and logistical challenge of deploying military forces to the region to protect civilians.

Abstract:
The past two decades have witnessed the proliferation of comprehensive international missions of peacebuilding and reconstruction, aimed not simply at bringing conflict to an end but also at preventing its recurrence. Recent missions, ranging from relatively modest involvement to highly complex international administrations, have generated a debate about the rights and duties of international actors to reconstruct postconflict states. In view of the recent growth of such missions, and the serious challenges and crises that have plagued them, we seek in this article to address some of the gaps in the current literature and engage in a critical analysis of the moral purposes and dilemmas of reconstruction. More specifically, we construct a map for understanding and evaluating the different ethical imperatives advanced by those who attempt to rebuild war-torn societies. In our view, such a mapping exercise is a necessary step in any attempt to build a normative defense of postconflict reconstruction. The article proceeds in two stages: first, we present the various rationales for reconstruction offered by international actors, and systematize these into four different "logics"; second, we evaluate the implications and normative dilemmas generated by each logic.
