51. Non-tariff Trade Policy Analysis: An Ex-post Assessment of the EU-Korea Agreement

Abstract:
Many different approaches have developed for the evaluation of non-tariff measures (NTMs) and free trade agreements (FTAs). Moving on from models using simple dummy variables, today a range of databases can capture different aspects of NTMs and FTAs. Some assess the depth of FTAs by extracting information from legal texts. Other data sources are based on surveys, on complaints by trading partners at the World Trade Organization (WTO) or notifications by companies or countries. This paper uses a gravity model to assess the value added of information on FTAs and NTMs by evaluating ex-post their ability to predict the trade effects of the EU-South Korea Free Trade Agreement, the first ‘second-generation’ FTA of the EU, applied since 2011. Our results show that, when accounting for information on the FTA components, no extra trade effect is attributable to the EU-South Korea FTA. The message from the evolution of NTMs differs considerably according to the indicator used, but trade predictions are hardly affected. On the aggregate country level, provisions on investments exhibit a particularly strong positive effect, while regulations on intellectual property rights seem to hamper bilateral trade. Most specifications, furthermore, point to a negative effect of differences in the number of technical barriers to trade (TBT) applied and sanitary and phytosanitary measures (SPS) against which trading partners issued complaints at the WTO.

Abstract:
Eight multilateral rounds of negotiations under the General Agreement on Tariffs and Trade (GATT) and international agreements under the World Trade Organisation (WTO) have contributed significantly to the reduction of tariffs among WTO members. However, over the years legitimate reasons for the imposition of non-tariff measures (NTMs) within regulations have triggered their extensive use. Among these measures, technical barriers to trade (TBTs) and sanitary and phytosanitary (SPS) measures allow countries to impose restrictions on the import of low-quality products suspected of harming domestic consumers’ health, plant life or the environment. Such trade policy instruments may lead to higher standards in the import market, in addition to improving market efficiency through information requirements such as mandatory labelling. This paper analyses two types of regulative and standard-like NTMs – TBTs and SPS measures – and the quality improvement of traded products that is driven by their imposition, which might be a general underlying motive for the adoption of such regulations. Based on a model framework involving both the supply and the demand side of trade and using four types of measures of these NTMs, this paper assesses the impact of TBTs and SPS measures on the quality of traded products. A dummy variable measuring the existence of these NTMs and a count variable indicating their stringency are used in the analysis. Moreover, two other variables indicate flows of NTMs imposed in each year and stocks of these NTMs accumulated over years. The results indicate that TBTs and SPS measures do indeed imply a higher quality of traded products, which is also consistent with the model when NTMs enter as a specific trade cost. Stringent TBTs with more regulations imposed in each year (i.e. flows of count TBTs) have the largest impact on the quality of traded products. However, for SPS measures only the existence of a regulation (i.e. the dummy variable on flows of SPS measures) on a traded product has the strongest impact on its quality.

53. The Collapse of Multilateral Trade Negotiations in Cancún

Abstract:
The Doha Round or the Doha Development Agenda (DDA), which was officially launched in 2001, is the very first trade round of the World Trade Organisation (WTO). Since developed and developing countries have different priorities and interests, the Doha Round has witnessed a series of deadlocks over ten years until the Bali Ministerial Conference in 2013. The first deadlock occurred at the Cancún Ministerial Conference in 2003. The primary points of dispute between developed and developing countries were agriculture and the so-called Singapore issues. This study investigates the Cancún Ministerial Conference as it is a remarkable example of how participant countries strive to secure their interests even at the expense of the collapse of the multilateral trade negotiations. In that regard, this study aims to examine the opposing negotiation behaviour has witnessed and determine how their insistence on different proposals lead to the failure of trade negotiations in Cancún. The primary argument of this study is that developing countries’ common stance and the creation of so-called G-20under the leadership of Brazil, along with India and China, prove the triumph of these countries as they succeeded to block any agreement that disrupts their interests at the Cancún Ministerial Conference. Although the Cancún failure damages the Doha Round of multilateral trade negotiations, developing countries appreciate their coherent coalition strategies, which trigger the shift in the balance of power within the WTO in their favour.

President Donald Trump has embarked on an ambitious and disruptive trade agenda, driven by his belief that the United States has lost “many billions of dollars” to trading partners and that “trade wars are good, and easy to win.”[1] During his term, the president has escalated trade tensions with China; has renegotiated trade agreements with countries such as Mexico, Canada, and South Korea; and has withdrawn US involvement in trade deals such as the Trans-Pacific Partnership. The 2019 Chicago Council Survey finds that though Republicans and Democrats differ on whether President Trump’s strategy is an effective approach to trade policy, the American public is more likely than ever to say that international trade benefits the United States.

The World Trade Organization (WTO) is at a crossroad. Each of WTO’s three main functions—monitoring and transparency, negotiation, and dispute settlement—is under stress. There is no single source for that stress. Some pressure flows from individual members, and other pressure flows from members’ inability to reach consensus on long-standing irritants. Pressure has also come from the rise of China and its state-driven economy, the rapid pace of technological change and its impact on the global economy, persistent economic inequality, and a recent tilt towards nationalism in the recent decade in countries that have otherwise consistently advocated for free trade. How will this essential institution navigate these challenges? In its latest report, the CSIS Scholl Chair in International Business provides a roadmap of three possible future scenarios for the WTO—continuation of status quo gridlock, U.S. withdrawal from the WTO, and successful reform—and examines what happens to the global trading order in each. In addition to the report, the Scholl Chair has assembled two resources to chart the future of the WTO: a database to track WTO reform proposals and a series of flowcharts that map future scenarios for the WTO

56. The Economic Losses from Ending the WTO Moratorium on Electronic Transmissions

This paper is co-authored with Badri Narayanan, PhD, Associate Professor at University of Washington, Consultant at McKinsey Global Institute, UN ESCWA, FAO, Commonwealth Secretariat and GTAP Research Centre. Since 1998, the WTO Members have applied a moratorium against tariffs on international electronic transmissions (commonly referred to as the WTO ‘E-Commerce’ Moratorium). However, some WTO Members have recently debated whether the moratorium remains in their economic interest, given the potential revenues that might be generated by imposing tariffs on electronic transmissions. The study examines the impact on India, Indonesia, South Africa and China (and the general case for developing countries) and concludes that imposing such tariffs would be fiscally counter-productive. Putting aside any legal questions, a country that opted out of the moratorium may apply tariffs affecting a wide range of cross-border business activities. Our research shows that if countries ceased to uphold the moratorium and levied import duties on digital goods and services, they would suffer negative economic consequences in the form of higher prices and reduced consumption, which would in turn slow GDP growth and shrink tax revenues. Yet our research indicates that the payoff in tariff revenues would ultimately be minimal relative to the scale of economic damage that would result from import duties on electronic transmissions.

Abstract:
This paper investigates the effects on firms' occupational structure of shocks induced by the introduction of Technical Barriers to Trade (TBTs) in importing countries. We rely on the Specific Trade Concern (STC) data released by the WTO to identify trade-restrictive TBT measures, combined with matched employer-employee data for the population of French exporters over the period 1995-2010, and with information on the list of product-destinations served by each French exporter. Controlling for time-invariant firm/occupation effects and for time-varying sector/occupation shocks, IV estimates show that exporters respond to increased complexity associated with restrictive TBTs at destination by raising the share of managers at the expense of blue collars, white collars and professionals. This evidence is consistent with the growing literature exploring how firms organize their workforce composition in presence of exogenous (foreign) shocks; and it is also related to the well-beaten literature on the labour market effects of trade.

The U.S.-China trade dispute has dominated headlines over the past year, disrupting trade and investment flows and increasing uncertainty at a time when the global economy is already facing headwinds. The conflict has left many countries in the Asia Pacific feeling caught in the crossfire seeking to navigate the tensions without alienating either country. While the World Trade Organization (WTO) would ideally help reduce the frictions, it has not been up to the task. The paralysis at the WTO points to a deeper problem: it’s inability to keep up with the pace of change or address the challenges of new developments in advanced technologies and the digital economy. Simply put, the trade regime is in trouble and in need of reform. At this dynamic and uncertain time in trade, the Asia Society Policy Institute (ASPI) convened a group of leading trade experts and former trade officials from across the Asia Pacific, led by ASPI Vice President Wendy Cutler. In this issue paper, the authors examine the major developments in the international trading system, including the U.S.-China trade dispute, FTA activity in the Asia Pacific, and efforts to reform the WTO. In this challenging environment, the authors find that the Asia Pacific is uniquely well-positioned to lead reforms to get the system back on track. This paper is the latest product of the ASPI initiative, “Building a High Standard and Inclusive Asia-Pacific Trade Architecture.” It builds on the work of two previous reports published in March 2017 and January 2018.

Abstract:
With Chinese President Xi Jinping willing to make some concessions to the US, the world may yet avoid a trade war. But the reason Sino-American relations have soured is the Trump administration's worldview, not external balances. BEIJING – Last month, US President Donald Trump’s administration fired the opening salvo in what is quickly shaping up to become a full-blown trade war. While trade friction has long been an issue in the Sino-American relationship, few expected such an escalation, not least because economists widely view trade wars as damaging to all parties. So how did we get to this point, and can we turn back before it’s too late? ...... According to the USTR report, the problem is that the policy tools the Chinese government is using to achieve the goals of Made in China 2025 “are largely unprecedented, as other WTO members do not use them.” Moreover, they “include a wide array of state intervention and support designed to promote the development of Chinese industry in large part by restricting, taking advantage of, discriminating against, or otherwise creating disadvantages for foreign enterprises and their technologies, products, and services.” Yet the report fails to identify those interventions, which is not surprising, given that the State Council has not yet specified the policy tools it will use. And while America’s grievances regarding IPR issues are understandable, they could be addressed through the WTO. The fact that the Trump administration has taken the approach it has suggests that it does not merely want to ensure that China complies with existing rules; it wants to prevent China from catching up to the US technologically. This is obviously not acceptable to China.

60. Adapting International Trade Institutions to New Realities

The institutional order governing world trade is going through a critical period. Debate over its future form and design will be a dominant theme on the global agenda for the coming years. The Donald J. Trump administration has questioned the benefits of the multilateral trading order and is pulling the United States back from its traditional leadership role. In December 2017, the Eleventh Ministerial Conference (MC11) of the World Trade Organization (WTO) ended in disappointment with no substantive multilateral achievements. The shift in economic power from the West to the East and the growth of nonstate actors further complicate the search for consensus on international trade rules, leading to a so-called multiplex world. In a multiplex world, actors with different cultural values and relative power inequalities—such as nation-states, international and regional institutions, corporations, and nongovernmental organizations—compete against each other. To ensure a resilient trading system, multilateral trading rules and institutions need to be adapted to these new realities of trade, investment, and the distribution of global power. Unlike the international system as it functioned after World War II, today’s trading system does not reflect the interests of a single power or an alliance of powers with sufficient clout to impose their will on others in a sustained way. This is not a Group of Twenty (G20) or Group of Seven–led world: it is a G-Zero world, with no established lineup of who should be invited to the table where decisions are made. In this vacuum of global leadership it is increasingly difficult to identify who will create the new rules of international competition. Actors pursue their own self-interest, which results in less certainty for the international trade system.
